2019-11-06 CAIB ![CDATA[Resolució de la consellera d’Administracions Públiques i Modernització de 5 de novembre per la qual s’estableixen els serveis mínims en l’àmbit de la ràdio autonòmica per a la jornada de vaga dels dies 10 i 11 de novembre]] 2019-11-07 2019-11-07 44063 text/html 628365 44060 ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Els delegats de personal de l'empresa Videoreport SA, empresa contractista del servei d'operació tècnica dels equips i sistemes d'IB3 Ràdio (emissora de l'Ens Públic de Radiotelevisió de les Illes Balears) han fet un preavís de convocatòria de vaga per als dies 10 de novembre —amb inici a las 00.00 hores— i 11 de novembre de 2019— amb finalització a les 23.00 hores.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Constitució espanyola estableix en l'article 28.2, com a dret fonamental, el dret a la vaga dels treballadors per a la defensa dels seus interessos, i disposa que la llei que regula l'exercici d'aquest dret ha d'establir les garanties que calguin per tal d'assegurar el manteniment dels serveis essencials de la comunitat. La falta d'una llei que desenvolupa aquest dret obliga a aplicar el Reial decret llei 17/1977, de 4 de març, que en l'article 10 disposa que "quan la vaga es declari en empreses encarregades de la prestació de qualsevol gènere de serveis públics o de necessitat reconeguda i inajornable i es presentin circumstàncies d'especial gravetat, l'autoritat governativa pot acordar les mesures necessàries per assegurar el funcionament dels serveis”.</span><em style="font-family:&quot;Times New Roman&quot;,Times,serif"> </em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">A aquests efectes és indiferent que el servei es presti per mitjà d'una relació funcionarial o simplement mitjançant empleats units per una relació laboral, atès que el que és determinant és el caràcter i la finalitat de les funcions exercides.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">L'article 6.2 de la Llei 15/2010 de 22 de desembre, de l'Ens Públic de Radiotelevisió de les Illes Balears EPRTVIB, estableix que l'Ens Públic de Radiotelevisió de les Illes Balears (EPRTVIB) resta formalment adscrit a l'Administració de la Comunitat Autònoma de les Illes Balears per mitjà de la conselleria competent en matèria de comunicació audiovisual.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, determina l'adscripció de l'Ens Públic de Radiotelevisió de les Illes Balears a la Conselleria d'Administracions Públiques i Modernització.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">D'acord amb la Sentència del Tribunal Constitucional 33/1981, l'al·lusió a l'autoritat governativa que conté l'article 10 del Reial decret llei 17/1977, fa referència, respectivament, a l'Estat o a la comunitat autònoma amb competències en els serveis afectats. Així, aquesta Sentència reconeix competències dins el seu àmbit a les comunitats autònomes per establir les mesures de garantia dels serveis essencials. El Tribunal Constitucional reconeix que “quan es tracta de serveis, que considerats conjuntament, estan compresos en l'àrea de les competències autonòmiques (...) vetllar pel seu funcionament correspon a la titularitat i a la responsabilitat de les autoritats autonòmiques”. Així doncs, s'ha de considerar que la Conselleria d'Administracions Públiques i Modernització, és l'òrgan legitimat per proposar els serveis mínims que afecten a l'àmbit dels serveis essencials de l'Ens Públic de Radiotelevisió de les Illes Balears.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La Jurisprudència constitucional ha matisat l'exercici del dret fonamental de vaga si la fixació dels serveis mínims afecta el serveis essencials per a la comunitat, atès que el dret de la comunitat a aquestes prestacions vitals és prioritari respecte del dret de vaga (fonament jurídic 18 de la Sentència del Tribunal Constitucional 11/1981, de 8 d'abril). A aquest efecte, es consideren serveis essencials els destinats a garantir el contingut essencial dels drets constitucionals; és a dir, el dret a la vida, a la salut, a la llibertat personal, a la lliure circulació, a comunicar i rebre lliurement informació veraç per qualsevol mitjà de difusió, a la tutela judicial efectiva i a l'educació.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">L'EPRTVIB té encomanat per mandat estatutari la prestació del servei públic de ràdio i televisió autonòmica. La Llei 15/2010 estableix en l'article 2 el caràcter essencial del servei públic de televisió i ràdio de titularitat autonòmica. D'altra banda, la prestació del servei públic de ràdio i televisió té una incidència directa sobre l'exercici del dret fonamental a comunicar i a rebre lliurament informació veraç per qualsevol mitjà de difusió, consagrat en l'article 20.1</span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">.d)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> de la Constitució espanyola.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Per tant, durant la vaga convocada pels dies 10 i 11 de novembre que afecta a&nbsp; Videoreport SA, l'exercici del dret de vaga ha de ser compatible amb el manteniment dels serveis mínims destinats a garantir aquest servei essencial.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El 5 de novembre de 2019 s'ha negociat amb el Comitè de vaga i l'empresa Videoreport SA, i s'ha arribat a un acord sobre els serveis mínims, que són els que es fixen en aquesta Resolució.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Per tot això, ateses les consideracions anteriors i d'acord amb el que disposa el Decret 16/1985, de 21 de febrer, sobre l'establiment de serveis mínims de l'Administració de la Comunitat Autònoma de les Illes Balears, dict la següent</span></p> <p style="text-align:center"><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Resolució</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Fixar, com a serveis mínims per a la vaga convocada per als dies 10 i 11 de novembre, els establerts en l'annex 1 que s'adjunta a aquesta Resolució.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Disposar, sense perjudici del que estableix l'annex 2, que la vigilància i la designació del personal concret que ha d'atendre els serveis mínims correspon als directius de Videoreport SA, responsables de la gestió dels recursos humans. Els serveis mínims s'han de cobrir prioritàriament pel personal que no secundi la vaga. En cas que sigui insuficient, les vacants s'han de cobrir obligatòriament.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3.
