2019-10-11 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El Batle de l'Ajuntament de Ses Salines, dia 9 d'octubre de 2019, va dictar resolució que es transcriu a continuació:</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">“Considerant que hi ha un lloc de treball vacant a la categoria d'oficial del cos de policia local de Ses Salines.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Considerant allò previst a l'article 64 del Real Decret 364/1995, de 10 de març, pel qual s'aprova el Reglament General d'ingrés del personal al servei de l'Administració General de l'Estat i de provisió de llocs de treball i promoció professional dels funcionaris civils de l'Administració General de l'Estat, aplicable supletòriament a les Entitats Locals.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Considerant igualment allò previst a l'article 192 del Decret 40/2019, de 234 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears i es modifica el Decret 55/2017, de 15 de desembre. Del Fons de Seguretat Pública de les Illes Balears,</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En ús de les atribucions que m'han estat legalment conferides, concretament l'article 21.1.h) i i) de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, resolc:</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Primer.-</strong> Aprovar les bases que figuren a continuació, i que regiran la convocatòria d'un borsí extraordinari i urgent per a la cobertura provisional en comissió de serveis pel sistema de concurs d'una plaça de la categoria d'oficial del cos de policia local de Ses Salines.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Segon.- </strong>Convocar les proves selectives per a la creació d'una borsa extraordinària per a la cobertura en comissió de serveis pel sistema de concurs d'una plaça de la categoria d'oficial del cos de la Policia Local de Ses Salines.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Tercer.-</strong> Publicar les bases i la convocatòria en el BOIB, al web municipal www.ajsessalines.net i al tauler d'anuncis de l'Ajuntament”.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"> </p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">ANNEX<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"> </span></span></span></strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>BASES DE LA CONVOCATÒRIA D'UNA BORSA EXTRAORDINÀRIA I URGENT PER A LA COBERTURA EN COMISSIÓ DE SERVEIS D'UNA PLAÇA DE LA CATEGORIA D'OFICIAL DEL COS DE LA POLICIA LOCAL DE SES SALINES. </strong></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>PRIMERA</strong>. Escala i Grup: administració especial, subescala serveis especials, classe policia local, categoria oficial, Grup C, subgrup C1. </span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>SEGONA</strong>. Objecte: crear una borsa extraordinària i urgent, mitjançant el sistema de concurs, per a la cobertura, quan un lloc de treball amb dotació pressupostària no tengui titular o quedi vacant de manera temporal o definitiva, i pugui ser ocupat en comissió de serveis de caràcter&nbsp;</span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">voluntari, amb personal funcionari de carrera del mateix grup i escala que compleixi els requisits establerts per ocupar-lo. </span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>TERCERA</strong>. Normativa: Seran d'aplicació en aquesta convocatòria: La Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques; la Llei 4/2013, de 17 juliol, de coordinació de les policies locals de les Illes Balears, modificada per la Llei 11/2017, de 20 de desembre; el Reial decret legislatiu 5/2015, de 30 d'octubre, text refós de la Llei de l'estatut bàsic de l'empleat públic; la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears; la Llei 4/2016, de 6 d'abril, de mesures de capacitació lingüística per a la recuperació de l'ús del català en l'àmbit de la funció pública; el Decret 100/2012, de 7 de desembre, que estableix els criteris de revalidació i actualització dels diplomes dels cursos d'aptitud dels policies locals de les Illes Balears; el Decret 40/2019, de 24 de maig, reglament de les policies locals de les Illes Balears; el Decret Llei 1/2017, de 13 de gener, de modificació de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, i de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, i de mesures en matèria de coordinació de les policies locals de les Illes Balears, i altres disposicions legals vigents en matèria de policia local de la Comunitat Autònoma de les Illes Balears Illes Balears. </span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>QUARTA</strong>. Requisits de les persones aspirants: per participar en aquesta convocatòria, les persones aspirants hauran de reunir els requisits següents referits en la data de finalització del termini d'admissió de sol·licituds: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) Tenir la nacionalitat espanyola. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Tenir els 18 anys fets. </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) Estar en possessió del títol de Batxillerat, tècnic o equivalent, o estar en condicions d'obtenir-lo en la data en què finalitzi el termini de presentació de sol·licituds. En el cas de titulacions expedides a l'estranger, caldrà aportar la corresponent homologació del Ministeri d'Educació i Ciència, o d'una universitat espanyola. La titulació s'ha d'acreditar mitjançant l'expedició dels títols corresponents de l'autoritat acadèmica competent. Aquesta mateixaautoritat podrà declarar també l'equivalència de títols.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">d) Tenir la condició de personal funcionari de carrera del cos de la Policia Local de l'Ajuntament de Ses Salines en la categoría de Polica Local en el moment de l'aprovació de les bases que regeixen la convocatoria i una antiguitat mínima de 2 anys en situación de servei actiu en aquesta categoría &nbsp;(ja sigui com a policía interi o com a funcionari de carrera).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">e) No patir cap malaltia o defecte físic o psicofísic que impedeixi o menyscabi el correcte desenvolupament de les funcions, en relació amb el quadre d'exclusions de l'annex 5 delDecret 40/2019, de 24 de maig, reglament de les policies locals de les Illes Balears.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">f) No haver estat separat o separada del servei de l'Administració local, autonòmica o estatal, ni estar inhabilitat ni inhabilitada per a l'exercici de la funció pública.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">g) No estar sotmès a cap causa d'incapacitat específica d'acord amb la normativa vigent.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">h) Estar en possessió dels permisos de conducció de les classes A2 i B.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">i) Compromís de portar armes de foc i, si cal, a utilitzar-les, mitjançant declaració jurada.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">j) Acreditar els coneixements de la llengua catalana corresponent al nivell B2 mitjançant certificat emès per l'òrgan competent en matèria de política lingüística del Govern dels Illes Balears o equivalent per l'administració d'acord amb la normativa vigent.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>CINQUENA</strong>. Protecció de dades personals: de conformitat amb l'article 5 de la Llei orgànica 15/1999, de 13 de desembre, de protecció de dades personals, s'informa a les persones aspirants que les dades personals contingudes a la sol·licitud d'admissió, la documentació que l'acompanyi i la que es generi a resultes d'aquesta convocatòria, s'incorporaran a un fitxer de dades de caràcter personal del qual és responsable l'Ajuntament de Ses Salines, i que té per finalitat, entre d'altres, la convocatòria, tramitació, qualificació i resolució d'aquesta convocatòria.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Cas que sigui necessari, algunes dades personals poden ser publicades al BOIB, al tauler d'edictes de l'Ajuntament i al lloc web d'aquesta institució (www.ajsessalines.net) d'acord amb el que disposen les bases d'aquesta convocatòria i la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>SISENA. </strong>Procediment: la creació d'una borsa extraordinària i urgent per a la provisió mitjançant comissió de serveis d'una plaçade la categoria d'oficial del cos de la Policia Local de Ses Salines, es regirà pel sistema de concurs, de acord amb els articles 190 i 192 del Reglament marc de coordinació de les policies locals de les Illes Balears, aprovat per Decret 40/2019, de 24 de maig.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Si en qualsevol moment del procés selectiu el tribunal tengués coneixement que algun aspirant no compleix un o diversos dels requisits exigits en aquesta convocatòria, l'alcalde, prèvia audiència a l'interessat, haurà de proposar-ne l'exclusió i es comunicarà, als efectes oportuns, a la persona aspirant les inexactituds o falsedats consignades en la seua sol·licitud d'admissió.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>SETENA</strong>. Comissió de serveis i funcionament de la borsa: la comissió de serveis finalitza quan el lloc de treball es proveeix amb caràcter definitiu o si la persona titular s'incorpora.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El lloc de treball ocupat en comissió de serveis ha de ser inclòs en la següent convocatòria de selecció o provisió pel sistema que correspongui, tret que tengui titular.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El personal funcionari en comissió de serveis té dret a la reserva del lloc de treball de procedència i percep les retribucions corresponents al lloc que efectivament ocupa.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Tendran la condició de persones disponibles en la borsa aquelles que formin part de la borsa i es trobin en situació de servei actiu, excepte aquelles que es trobin en situació d'incapacitat temporal de llarga durada o accident de treball de llarga durada a l'Ajuntament de Ses Salines.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Tendran la condició de persones no disponibles en la borsa aquelles que formin part de la borsa i no es trobin en situació de servei actiu, en situació de suspensió de funcions i aquelles que es trobin en situació d'incapacitat temporal de llarga durada o accident de treball de llarga durada a l'Ajuntament de Ses Salines.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El nomenament en comissió de serveis es regeix per l'ordre de puntuació resultant de la suma de mèrits d'acord amb aquesta convocatòria, en ordre de major a menor, sempre que tenguin la condició de persones disponibles.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La resolució amb la composició de la borsa objecte d'aquesta convocatòria en comissió de serveis, es publicarà al tauler d'anuncis i al lloc web www.ajsessalines.net.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>VUITENA</strong>. Sol·licitud i documentació: Les sol·licituds per participar en el borsa es s'han d'adreçar a l'alcalde de l'Ajuntament de Ses Salines i s'han d'ajustar al model normalitzat de sol·licitud (annex I).</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">També es podran presentar mitjançant els sistemes previstos a l'article 16 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El termini de presentació de sol·licituds serà de SET DIES HÀBILS tal i com estableix l'article 192.8 del Decret 40/2019 de 24 de maig, reglament de les policies locals de les Illes Balears, comptadors a partir del dia següent a la publicació de les bases i la convocatòria en el Butlletí Oficial de les Illes Balears.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La no presentació de les sol·licituds en el termini adequat i en la forma escaient determinarà la no admissió de les persones aspirants.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Les persones aspirants han d'adjuntar a la sol·licitud, correctament emplenada, l'original o la fotocòpia compulsada de la documentació que s'indica a continuació:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) Declaració responsable de les persones aspirants que compleixen totes les condicions exigides a la base quarta, referides sempre a la data de finalització del termini assenyalat per a la presentació de sol·licituds.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Fotocòpia compulsada del Document Nacional d'Identitat en vigor, o el resguard de la sol·licitud de renovació.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) Fotocòpia compulsada de la titulació exigida.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">d) Fotocòpia compulsada dels permisos de conducció A i B en vigor, o amb el resguard de la sol·licitud de renovació.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">e) Fotocòpia compulsada acreditativa del coneixement del nivell B2 de la llengua catalana.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">f) Relació dels mèrits aportats segons model annex II, en què es recullin ordenadament els mèrits al·legats, estructurada segons els blocs en què es divideix el barem de mèrits recollit a la base onzena.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">g) La documentació acreditativa dels mèrits al·legats en la forma establerta a la base novena d'aquesta convocatòria. La comissió de valoració no valorarà els mèrits que no s'acreditin juntament amb la instància de sol·licitud de participació en el procés selectiu.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">h) A la sol·licitud, haurà de constar-hi una adreça de correcu electrònic i telèfon, a efectes de comunicació amb l'Ajuntament de Ses Salines.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>NOVENA</strong>. Admissió de les persones aspirants: Finalitzat el termini de presentació de sol·licituds, en un termini màxim de tres dies hàbils es publicarà al tauler d'anuncis i al lloc web de l'Ajuntament la resolució per la qual s'aprova la llista provisional de persones aspirants admeses i excloses, la identitat de les quals s'indicarà amb el número de document nacional d'identitat de la persona aspirant.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Les persones aspirants excloses o omeses disposaran d'un termini de tres dies hàbils, comptadors des de l'endemà de la publicació, per esmenar el defecte o adjuntar el document que sigui preceptiu, i se'ls advertirà que es considerarà no presentada la sol·licitud si no escompleix el requeriment. Un cop finalitzat el termini i esmenades, si escau, les sol·licituds, l'alcalde dictarà resolució en el termini màxim de tres dies hàbils, aprovant la llista definitiva de persones admeses i excloses, que serà publicada al tauler d'anuncis i al lloc web de l'Ajuntament.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Finalitzat el termini de presentació d'al·legacions a la llista provisional d'admesos i exclosos, cas que no existeixin, es considerarà la llista provisional aprovada com a definitiva sense necessitat de publicació.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>DESENA</strong>. Tribunal qualificador.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">1. L'òrgan encarregat de la selecció és el tribunal qualificador, que es determinarà per resolució de l'Ajuntament de Ses Salines. S'ha de publicar en el tauler d'anuncis i al web corporatiu, la composició del tribunal qualificador, abans de la publicació de la llista definitiva d'admesos i exclosos.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2. L'òrgan de selecció serà col·legiat, la seua composició s'ajustarà als principis d'imparcialitat i professionalitat dels seus membres i es procurarà, així mateix, la paritat entre dona i home. La seua composició serà predominantment tècnica i els membres hauran d'estar en possessió de titulació o especialització igual o superior a l'exigida per a l'accés a la plaça convocada.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">3. El personal d'elecció o de lliure designació política, els funcionaris interins i el personal eventual no poden formar part dels òrgans de selecció. Tampoc poden formar-ne part els representants dels empleats públics, sense perjudici de les funcions de vigilància i custòdia del bon desenvolupament del procediment selectiu. Els representants sindicals que participin en el procediment selectiu, amb aquestes funcions de vigilància i custòdia, han d'estar acreditats i&nbsp;</span></span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">com a màxim pot haver-n'hi un per cada sindicat amb un màxim de quatre en cada procediment.</span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. La pertinença als òrgans de selecció serà sempre a títol individual, i no es podrà ostentar en representació o a compte de ningú altre.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">5. El tribunal qualificador estarà constituït per cinc membres, i se n'ha de designar el mateix nombre de suplents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) President o presidenta: designat per l'Ajuntament de Ses Salines entre el personal funcionari de carrera.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Vocals: un vocal proposat per la Direcció General d'Interior competent en matèria de coordinació de policies locals, un altre proposat per l'Escola Balear d'Administració Pública i un de designat per l'Ajuntament de Ses Salines.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) Secretari o secretària: designat per l'Ajuntament de Ses Salines, amb veu i vot.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">6. El tribunal pot acordar la incorporació de personal assessor o especialistes en totes o alguna de les proves, que pot actuar amb veu però sense vot.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">7. El tribunal no es podrà constituir ni actuar sense l'assistència de més de la meitat dels seus membres, titulars o suplents indistintament, ni sense la presidència ni la secretaria, i les seues decisions s'adoptaran per majoria.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">8. Els membres del tribunal poden ser nomenats entre els membres de la corporació o entre el personal al servei de les administracions públiques.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">9. Els membres del tribunal s'abstindran d'intervenir, i ho notificaran a l'autoritat convocant, quan concorri alguna de les circumstàncies previstes en la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">10. Les decisions adoptades pel tribunal es poden recórrer en les condicions que estableix la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">11. Són funcions del tribunal qualificador:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) Valorar els mèrits al·legats i acreditats per les persones aspirants, en la forma establerta en aquestes bases.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Requerir, si escau, a les persones aspirants que hagin acreditat mèrits amb defectes formals per tal que els esmenin, o quan necessitin l'aclariment d'algun dels mèrits acreditats dins el termini i en la forma adequada.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) Confeccionar una llista, per ordre de prelació, de les persones que formen part de la borsa.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">d) Resoldre les reclamacions presentades per les persones aspirants en el termini establert i en la forma adequada.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">e) Elevar a l'Alcaldia la composició definitiva de la borsa.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">f) Expedir els justificants d'assistència que demanin els aspirants.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>ONZENA</strong>. Puntuació màxima i documentació que s'ha de presentar: El barem de mèrits és el que s'estableix a l'annex 6 del Reglament marc de coordinació de les policies locals de les Illes Balears, aprovat per Decret 40/2019, de 24de maig.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La puntuació màxima que poden assolir els mèrits al·legats és de 60 punts, d'acord amb el que s'estableix en els apartats següents, per a cada tipus de mèrit. Els mèrits que al·leguin les persones candidates s'han d'acreditar mitjançant la presentació de l'original o de la còpia compulsada de la documentació següent:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a. Antiguitat: certificat expedit pels ajuntaments o administracions públiques corresponents.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b. Cursos i accions formatives: certificats d'aprofitament, certificats d'assistència i certificats d'impartició de cursos d'accions formatives expedits per les escoles de formació de les policies locals, per l'Escola Balear d'Administració Pública o homologats o concertats per l'EBAP, per universitats de l'àmbit de la Unió Europea, per centres de formació acreditats en altres administracions públiques de l'Estat espanyol o centres que imparteixen plans de formació contínua.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c. Estudis acadèmics oficials: còpia compulsada correctament del títol o del resguard acreditatiu (dret i revés). En cas de presentació de títols d'estudis fets a l'estranger, s'ha d'acreditar l'homologació concedida pel Ministeri d'Educació, Cultura i Esport.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">d. Coneixement de la llengua catalana: certificats expedits per l'Escola Balear d'Administració Pública (EBAP), expedits o homologats per l'òrgan competent de la Conselleria d'Educació, Cultura i Universitats o reconeguts d'acord amb la normativa autonòmica vigent.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">e. Coneixement d'altres llengües: certificats expedits per l'Escola Balear d'Administració Pública, per les escoles oficials d'idiomes (EOI), per les universitats, per altres escoles d'administració pública i altres entitats, equivalents amb els nivells del Marc comú europeu.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Barem de puntuació de mèrits</strong>: El tribunal avaluarà els mèrits que les persones aspirants al·leguin i hagin justificat correctament, d'acord amb el barem següent i l'Ajuntament establirà els criteris de valoració amb la puntuació máxima que consideri pertinent tal i com ve regulat a l'articule 192.9 del Decreto 40/2019 de 24 de maig, Reglament Marc de coordinació de les policies locals de les Illes Balears:</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>1. Antiguitat:</strong></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La puntuació màxima d'aquest apartat serà de 4 punts. Per cada any complet de serveis prestats i reconeguts com a personal funcionari en qualsevol categoria de policia local, com a policia en un ajuntament que no hagi constituït cos de policia local o com a policia auxiliar: 0.5 punts per any.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La data de referència per fer la valoració és la de finalització del termini per presentar la sol·licitud de participació i s'ha d'acreditar mitjançant un certificat expedit pels ajuntaments corresponents.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>2. Cursos i accions formatives</strong></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">S'han de valorar els cursos i les accions formatives següents:</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Els diplomes o els certificats de cursos i activitats formatives impartits per les escoles de formació de les policies locals, els cursos impartits per l'Escola Balear d'Administració Pública o que tenguin la condició de concertats o homologats per l'EBAP, els cursos d'interès policial manifest superats en universitats en l'àmbit de la Unió Europea o en altres administracions públiques de l'Estat espanyol amb centres de formació acreditats i els plans de formació contínua, amb un certificat que acrediti que s'han superat amb aprofitament o, si escau, amb certificat d'assistència, que estiguin directament relacionats amb les funcions del lloc de treball que s'hagi de cobrir. A aquest efecte, es consideren directament relacionats amb les funcions de qualsevol lloc de treball els cursos referits a les àrees professionals de policia, seguretat, emergències, salvament, ciències forenses, criminologia, violència de gènere, diversitat sexual i de gènere, delictes d'odi i formació sanitària relacionada amb la professió de policia local.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Els cursos o les accions formatives de contingut idèntic només es poden valorar una vegada. En aquest cas, s'ha de valorar l'acció formativa amb més hores de durada.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">No han de ser objecte de valoració els cursos que s'exigeixin com a requisit específic del lloc de treball convocat.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.1 Formació relacionada amb l'àrea professional.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.1.1 Accions formatives relacionades.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La puntuació màxima d'aquest apartat és de 5,5 punts. Es valoren, per a cada lloc de treball, les accions formatives sempre que estiguin directament relacionades amb les funcions pròpies del lloc al qual s'accedeix. En concret, només es valoren els cursos referits a les àrees professionals de policia, seguretat, emergències, salvament, ciències forenses, criminologia, violència de gènere i formació sanitària relacionada amb la professió de policia local d'acord amb els criteris que s'indiquen a continuació:</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">- Per cada certificat d'aprofitament: 0,005 punts per hora.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">- Per cada certificat d'assistència: 0,0025 punts per hora.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">- Per cada certificat d'haver impartit cursos d'accions formatives relacionades amb les funcions pròpies del lloc al qual s'accedeix: 0,0075 punts per hora.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Pel que fa als cursos o activitats expressats en crèdits, s'entén que cada crèdit equival a 10 hores.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">No es valoren els certificats que no indiquin el nombre d'hores o crèdits, el contingut de la formació o que tinguin un contingut indefinit.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">No es valorarà la formació que constitueix una part dels cursos de capacitació per accedir a qualsevol categoria de les forces o cossos de seguretat i la formació repetida, excepte que s'hagi fet un canvi substancial en el contingut.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.1.2 Formació universitària no oficial relacionada amb les funcions del lloc de treball convocat. La puntuació màxima d'aquest apartat és de 3,5 punts.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) Títol propi de graduat en seguretat i ciències policials de la Universitat de les Illes Balears: 1 punt</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) Títols propis de graduat universitari relacionats amb les àrees de policia, seguretat, emergències, salvament, ciències forenses, criminologia, violència de gènere i formació sanitària, amb càrrega lectiva de, com a mínim, 180 crèdits ECTS: 0,75 punts per títol , fins a un màxim de 1,5 punts.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) Màsters, experts i diplomes universitaris relacionats amb les àrees de policia, seguretat, emergències, salvament, ciències forenses, criminologia, violència de gènere i formació sanitària: 0,1 punts per crèdit ECTS, fins a un màxim d'1 punt. Els títols amb càrrega lectiva inferior a 30 crèdits ECTS no es valoren en aquest apartat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.2 Formació no relacionada amb l'àrea professional.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">2.2.1 Accions formatives no relacionades.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La puntuació màxima d'aquest apartat és de 3 punts. S'han de valorar, per a cada lloc de treball, les accions formatives que, encara que no estiguin directament relacionades amb les funcions pròpies del lloc al qual s'accedeix, es consideren d'interès general. Estudis acadèmics oficials: </strong></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">S'han de valorar els estudis o titulacions oficials amb validesa en tot el territori nacional que siguin de nivell superior a la titulació exigida per ingressar en la categoria del lloc de treball. Recursos.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Contra la resolució que aprova les bases, que exhaureix la via administrativa, es pot interposar recurs de reposició davant del mateix òrgan que l'ha dictada, conformement amb el que disposa l'article 123 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques. El termini per interposar-lo és d'un mes, comptador des de l'endemà de la publicació de les bases. En aquest cas, no es podrà interposar el recurs contenciós administratiu fins que s'hagi resolt el de reposició.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El recurs de reposició potestatiu s'ha de presentar al registre general d'aquest Ajuntament o a les dependències a què es refereix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, abans esmentada, i s'entendrà desestimat quan la resolució no s'hagi resolt i notificat en el termini d'un mes, comptadors des de l'endemà de la seua interposició.
