    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:10,0000pt; margin-top:6,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) d' 1 de març de 2016 per la qual s'aprova la convocatòria de les ajudes, per al foment de l'agricultura ecològica, per l'any 2016 especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident del FOGAIBA, en data &amp;nbsp;12&amp;nbsp;de setembre&amp;nbsp;de 2019, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;“RESOLUCIÓ DE DENEGACIÓ&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Programa de Desenvolupament Rural de les Illes Balears 2014-2020&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Mesura 11.2- Foment de l'Agricultura Ecològica.&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Convocatòria 2016_RD4&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En data de 1 de març de 2016 es va publicar, en el BOIB núm. 28, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2016 de les ajudes destinades al Foment de l'Agricultura Ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Els interessats assenyalats a l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Annex I adjunt han presentat, dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria, i s'ha comprovat que &amp;nbsp;no compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:14,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.En data &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;16&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;d&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'abril&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8&amp;nbsp;es va publicar en la pagina WEB del FOGAIBA una proposta provisional de resolució de denegació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, de la vinya.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:14,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Llei 30/1992, de 26 de novembre de règim jurídic de les administracions públiques i del procediment administratiu comú&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:14,0000pt; margin-top:0,0000pt; text-align:justify"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Resolució de denegació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:10,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, dicto una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-right:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar total o parcialment &amp;nbsp;l'ajuda sol·licitada als beneficiaris detallats a l'Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Publicar la resolució en el BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Agricultura,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 114 i 115 de la Llei 30/92, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, modificada per la Llei 4/99, de 13 de gener.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:14,0000pt; text-align:justify"&gt; &lt;/p&gt;
