&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:2,8500pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data de 30/04/2016 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 54, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) que modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 10 de setembre de 2015, per la qual es convoquen, per als anys 2015 a 2019, subvencions per a la creació d'empreses de joves agricultors.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El interessat abans indicat ha sol·licitat, en data 17 de juliol de 2019, el desistiment de l'ajuda&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;&amp;nbsp;concedida&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;L'article 21.1 de la Llei 39/2015, de 1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Atès tot això, s'informa favorablement i es proposa fer la revocació total de l'ajuda a causa del desistiment de les persones beneficiàries que figuren a l'annex I. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
