font-size:12px"><span style="line-height:100%">Les sol·licituds s'han d'adreçar, dins del termini establert en la convocatòria corresponent, mitjançant l'imprès normalitzat inclòs en l'annex 1, al Registre General de l'Ajuntament de Ferreries o per mitjà de qualsevol de les formes admeses en dret, juntament amb la documentació següent: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>a)</em> DNI de la persona sol·licitant i/o de la persona que la representi.</span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:100%"><strong>Termini de presentació de sol·licituds</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">El termini de presentació de sol·licituds s'obrirà juntament amb el termini de matrícula de l'escoleta i continuarà obert durant el curs escolar fins a esgotar el límit pressupostari establert en les bases.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 7</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Criteris en la concessió dels ajuts</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7.1 Els ajuts es concediran d'acord amb els principis d'objectivitat, transparència, igualtat, no discriminació i publicitat per mitjà del procediment de concurrència competitiva.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7.2 L'inici de l'expedient s'efectuarà per mitjà de l'aprovació de la convocatòria corresponent per part de l'òrgan municipal competent de l'Ajuntament. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">7.3 En la selecció de les sol·licituds i la graduació dels ajuts, les sol·licituds seran valorades d'acord amb l'ordre de prioritats següent i tenint en compte la dotació pressupostària recollida en l'article 2 i els criteris següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- Els imports màxims i les condicions dels ajuts seran els recollits en els articles 3 i 4.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">- La manca d'ingressos es calcularà sobre la declaració de la renda del darrer exercici presentat davant Hisenda o certificat d'ingressos d'aquest darrer exercici, en el cas de no tenir l'obligació de presentar-la.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Finalment, s'atendran els ajuts, primer, pels trams més baixos del barem d'ingressos quan es lliurin en el mateix període de matrícula i, en segon lloc, per ordre de matrícula <span style="color:#000000">o</span> registre d'entrada.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Forma de concessió dels ajuts</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">La concessió d'aquests ajuts es realitzarà en règim de concurrència competitiva, mitjançant la comparació de les sol·licituds presentades, a fi d'establir la prelació d'aquestes segons els criteris prevists en els articles 3, 4 i 8 d'aquestes bases.</span></span></p> <p style="margin-bottom:0px; Les funcions de la comissió avaluadora són les següents:</span></span></p> <ol class="circle"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Examinar, avaluar i qualificar les sol·licituds d'acord amb els criteris i els requisits que estableixen aquestes bases.</span></span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Aixecar acta dels acords presos, que serviran de base per elaborar la proposta de resolució.</span></span></p> </li> </ol> <p> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 10</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Tramitació i resolució dels ajuts</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.1 La treballadora social serà l'òrgan instructor del procediment de concessió d'aquests ajuts.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.2 La treballadora social analitzarà el compliment dels requisits establerts en aquesta convocatòria, avaluarà les sol·licituds presentades i n'evacuarà un informe. Amb aquesta finalitat, la treballadora social ha d'examinar les sol·licituds presentades i la documentació adjunta per tal de determinar si l'ajuda s'adequa a l'objecte d'aquesta convocatòria. En particular, realitzarà totes les actuacions necessàries per a la determinació, el coneixement i la comprovació de les dades, en virtut de les quals s'ha de dictar una resolució sobre la concessió dels ajuts. Si es considera necessari disposar de documentació complementària per poder fer una valoració correcta de la necessitat sol·licitada, podrà sol·licitar la documentació que consideri oportuna.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.3 La comissió avaluadora d'ajuts socials examinarà la documentació i l'informe previ de la instructora sobre les sol·licituds presentades, i aixecarà acta dels acords presos concretant el resultat de l'avaluació efectuada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.4 La regidora de Serveis Socials, vist l'expedient i la proposta de la comissió avaluadora, formularà una proposta de resolució a la batlessa, que dictarà resolució sobre la concessió o denegació dels ajuts.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.5 La resolució de l'expedient d'atorgament de les subvencions ha de ser expressa i motivada d'acord amb els criteris de valoració establerts en les bases, i ha de fixar, amb caràcter definitiu, la quantia específica de cadascuna de les subvencions concedides.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.6 Els ajuts s'atorgaran per decret de batlia prenent com a base la proposta de la Regidoria de Serveis Socials. El termini màxim per resoldre serà de dos mesos comptadors des de la data de presentació de la sol·licitud o l'esmenada definitiva de les deficiències, si són necessàries. Si no recau resolució en el termini indicat, les sol·licituds presentades s'entendran desestimades.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.7 La resolució del procediment es notificarà a les persones interessades d'acord amb el que preveu l'article 40 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">10.8 La resolució de concessió dels ajuts es publicarà al tauler d'anuncis de l'Ajuntament amb expressió de tots els elements indicats a l'article 18 de la Llei general de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 11</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Obligacions de les persones beneficiàries</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Són obligacions de les persones beneficiàries de les ajudes:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>a)</em> Destinar l'import de l'ajuda a l'objecte per al qual s'ha sol·licitat.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>b)</em> Sotmetre's a les actuacions de comprovació que efectuï l'Ajuntament sobre aquestes.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>c)</em> Comunicar a l'Ajuntament l'obtenció de subvencions o ajudes per a idèntica finalitat, procedents de qualsevol ens públic o privat, estatal o internacional.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>d)</em> Comunicar a l'Ajuntament la modificació de les circumstàncies que van motivar l'ajut.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>e)</em> Justificar l'ajuda concedida a petició de l'Administració.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 12</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Abonament dels ajuts</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">12.1 Atesa la naturalesa i l'objectiu social d'aquests ajuts, l'import de la subvenció es comunicarà a l'empresa gestora de l'escoleta municipal perquè ho descompti del preu públic corresponent i ho presenti en la justificació anual del contracte, la qual cosa no n'eximeix la plena justificació.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">12.2 En els supòsit que no es justifiqui totalment la realització de l'activitat subvencionada però s'hagi acomplert parcialment la finalitat per a la qual va ser concedida, es revisarà la quantia i es minorarà proporcionalment a la part no justificada.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 13</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Reintegrament dels ajuts concedits </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">13.1 D'acord amb el que disposen els articles 37 i 38 de la Llei 38/2003, de 17 de novembre, general de subvencions, la persona beneficiària ha de reintegrar totalment o parcialment les quantitats rebudes i, si n'és el cas, l'interès de demora, en els casos següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>a)</em> L'incompliment de la finalitat per a la qual es va concedir la subvenció.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>b) </em>L'obtenció de la subvenció sense que es compleixin les condicions requerides per a això, o quan s'alterin les condicions tingudes en compte per concedir-la, sempre que sigui per causes imputables a la persona beneficiària.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>c)</em> L'incompliment de l'obligació de justificació o la justificació insuficient, en els termes establerts en l'article 30 de la Llei 38/2003, de 17 de novembre.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>d)</em> La concurrència de subvencions incompatibles per a la mateixa activitat.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">e) La negativa a sotmetre's a les actuacions de comprovació i control previstes en la Llei 38/2003, de 17 de novembre, o l'obstrucció injustificada d'aquestes actuacions.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><em>f)</em> Altres supòsits establerts en les bases reguladores.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">13.2 Per tal de reintegrar les ajudes s'han d'aplicar els procediments que preveuen a aquest efecte els articles 41, 42 i 43 de la Llei 38/2003, de 17 de novembre, general de subvencions, en els quals s'ha de garantir l'audiència a les persones interessades.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">13.3 Les quantitats reintegrades tenen la consideració d'ingressos de dret públic i es poden exigir per la via de constrenyiment.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 14</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Modificació de la resolució de concessió</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Qualsevol alteració de les condicions tingudes en compte per a la concessió de l'ajuda i, en qualsevol cas, l'obtenció concurrent de subvencions o ajudes atorgades per altres administracions o ens públics o privats, estatals o internacionals, pot donar lloc a la modificació de la resolució de concessió.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Article 15</strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Revocació dels ajuts concedits</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">D'acord amb el que disposa l'article 37 de la Llei 38/2003, de 17 de novembre, general de subvencions, s'ha de revocar la subvenció quan, posteriorment a la resolució de la concessió, la persona beneficiària d'aquesta incompleixi totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció.
