&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. En data 15 de maig de 2019 la consellera de Serveis Socials i Cooperació va dictar Resolució per la qual es convoca el concert del servei ocupacional per a persones amb diagnòstic de salut mental greu, per als anys 2019-2020, a l'illa d'Eivissa. Aquesta resolució es va publicar al BOIB núm. 69, de 23 de maig de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. En data 27 de maig de 2019 l'entitat Associació Pitiüsa de Familiars de Persones amb Malaltia Mental (APFEM)&lt;em&gt;, &lt;/em&gt;amb NIF G07728751, va presentar sol·licitud amb la documentació necessària per participar en aquesta convocatòria. El nombre de places per les que es sol·licita el concert és de 12.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. L'entitat APFEM compleix amb els requisits establerts en la convocatòria, d'acord amb els punts 4.1 i 4.2 de la resolució de la consellera de 15 de maig de 2019 mitjançant la qual es convoca aquest concert. El nombre total de places ofertes per la convocatòria és de 12 i no s'ha presentat cap altra entitat a la convocatòria. Això suposa que existeix disponibilitat pressupostària suficient per atendre la totalitat de les places sol·licitades per l'entitat APFEM. Així, la concertació de totes les places sol·licitades per l'entitat APFEM, segons el preu de referència màxim de 37,32 euros per plaça/dia a intensitat completa resulta un import màxim de 98.524,80 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. En data 10&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;juny&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; e&lt;/span&gt;l director general de Dependència va dictar la proposta de resolució relativa a la sol·licitud de l'entit&lt;span style="color:#000000"&gt;at APFEM&lt;span style="color:#000000"&gt; &lt;/span&gt;pe&lt;/span&gt;&lt;span style="color:#000000"&gt;l que fa&lt;/span&gt;&lt;span style="color:#000000"&gt; a la &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatòria del &lt;/span&gt;&lt;span style="color:#000000"&gt;concert del &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;servei &lt;/span&gt;&lt;span style="color:#000000"&gt;ocupacional&lt;/span&gt;&lt;span style="color:#000000"&gt; per a persones amb diagnòstic de salut mental greu, per al&lt;/span&gt;&lt;span style="color:#000000"&gt;s &lt;/span&gt;&lt;span style="color:#000000"&gt;any&lt;/span&gt;&lt;span style="color:#000000"&gt;s 2019-2020, a l'illa d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La Llei 3/2018, de 29 de maig, del tercer sector d'acció social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. El Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. El Decret 9/2019, de 2 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. El Decret 12/2019, de 2 de juliol, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. La Resolució de la consellera de Serveis Socials i Cooperació, de 15 de maig de 2019, per a la convocatòria del concert del servei ocupacional per a persones amb diagnòstic de salut mental greu, per als anys 2019-2020, a l'illa d'Eivissa (BOIB núm. 69, de 23 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Aprovar l'expedient de concert social amb l'entitat APFEM&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb &lt;/span&gt;&lt;span style="color:#000000"&gt;N&lt;/span&gt;&lt;span style="color:#000000"&gt;IF &lt;/span&gt;&lt;span style="color:#000000"&gt;G07728751&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; per a &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; places,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;al preu ofert de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;37,32 €&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;per plaça, per prestar el servei de &lt;/span&gt;&lt;span style="color:#000000"&gt;servei ocupacional per a persones amb discapacitat associada a un diagnòstic de salut mental greu&lt;/span&gt;&lt;span style="color:#000000"&gt;, per un import total de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;98.524,80&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;€&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;(IVA exempt). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;2. Autoritzar i disposar una despesa a favor de l'entitat APFEM&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;amb &lt;/span&gt;&lt;span style="color:#000000"&gt;N&lt;/span&gt;&lt;span style="color:#000000"&gt;IF &lt;/span&gt;&lt;span style="color:#000000"&gt;G07728751&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;p&lt;/span&gt;&lt;span style="color:#000000"&gt;er import de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;98.524,80&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; €&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;IVA exempt) amb càrrec a les següents partides i anualitats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- 201&lt;/span&gt;9&lt;span style="color:#000000"&gt;, 41.052,00&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;€ &lt;span style="color:#000000"&gt;corresponents als mesos&lt;/span&gt; de juliol a no&lt;span style="color:#000000"&gt;vembre de 201&lt;/span&gt;9&lt;span style="color:#000000"&gt;, amb càrrec a la partida 17301.313B01.26104.00 &lt;/span&gt;dels pressuposts de la comunitat autònoma per a l'any 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- 2020, 57.472,80 € corresponents al mes de desembre de 2019 &lt;span style="background-color:#ffffff"&gt;a juny d&lt;/span&gt;e 2020, amb càrrec a la partida 17301.313B01.26104.00, (o equivalent que la substitueixi), dels pressuposts de la comunitat autònoma per a l'any 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Establir que el concert s'ha de regir per les estipulacions del document en què es formalitzi el concert i pel Plec general de prescripcions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.&amp;nbsp;Notificar aquesta Resolució a l'entitat interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució –que exhaureix la via administrativa– es pot interposar un recurs potestatiu de reposició davant la consellera d'Afers Socials i Esports en el termini d'un mes comptador des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
