text/html 2019-07-30 CAIB ca 2019-07-30 ca 160 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fets</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.&nbsp;El Decret 46/2019, de 7 de juny, publicat en el BOIB de dia 8 del mateix mes, estableix les autoritzacions de lloguer de vehicles amb conductor d'àmbit insular i caràcter temporal a l'illa de Mallorca (vlc-TM). En la disposició addicional primera, fixa en 25 el nombre d'autoritzacions per atorgar per a la temporada corresponent a l'any 2019 i dona un termini de deu dies hàbils per presentar-hi sol·licituds. </span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2.</span><strong style="font-family:&quot;Times New Roman&quot;,Times,serif"> </strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Dins del termini atorgat, que va finalitzar el dia 22 de juny, es varen presentar 59 sol·licituds.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Una vegada revisades les sol·licituds, juntament amb la documentació que s'hi adjunta, resulta que el nombre de sol·licituds és superior al nombre d'autoritzacions de vlc-TM que es poden expedir per a aquesta temporada, motiu pel qual correspon aplicar el barem que estableix l'article 8 del Decret.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. Una vegada confeccionada una llista provisional de totes les sol·licituds amb les observacions oportunes respecte del compliment correcte dels requisits exigits i l'aplicació del barem, d'acord amb l'article 45.1.</span><em style="font-family:&quot;Times New Roman&quot;,Times,serif">b)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques,&nbsp; com que és un procediment de concurrència competitiva, s'ha publicat en el BOIB núm. 100, de dia 20 de juliol de 2019, i en la pàgina web d'aquesta Direcció General, i s'ha atorgat un termini de 5 dies per consultar l'expedient i presentar les al·legacions que els interessats considerin oportunes.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. En el termini concedit no s'ha presentat cap al·legació a la llista provisional,&nbsp; motiu pel qual aquesta llista passa a ser la definitiva.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">6. font-size:12px"><strong><span style="color:black">Fonaments de dret</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Llei 4/2014, de 20 de juny, de transports terrestres i mobilitat sostenible de les Illes Balears.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decret 46/2019, de 7 de juny, pel qual s'estableixen les autoritzacions de lloguer de vehicles amb conductor d'àmbit insular i caràcter temporal a l'illa de Mallorca.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, dict la següent</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolució </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Expedir l'autorització de lloguer de vehicles amb conductor, d'àmbit insular i caràcter temporal de l'any 2019 (vlc-TM), així com els distintius corresponents, a les empreses i els vehicles compresos en la taula que figura en l'apartat 6 d'aquesta Resolució.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Excloure la resta de sol·licituds del procediment per atorgar les autoritzacions de vlt-TM perquè no han assolit la puntuació suficient per obtenir l'autorització vlt-TM per a la convocatòria de 2019.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.
