&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.- En data 8 de maig de 2018 la consellera de Serveis Socials i Cooperació va dictar Resolució per la qual es convoca el concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2018-2019. Aquesta Resolució es va publicar al BOIB núm. 59, de 12 de maig de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.- En data 9 de juliol de 2017 es va signar el concert entre la Conselleria de Serveis Socials i Cooperació i l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt; per dur a terme el servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2018-2019, per a un total de 11 places concertades de baixa intensitat i 7 places d'alta intensitat i amb un cost total del servei de 273.178,20 €. Aquest concert tenia una durada de 12 mesos i finalitza el 30 de juny de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.- En data 5 de febrer de 2019 la consellera de Serveis Socials i Cooperació va dictar resolució relativa a l'ampliació del concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu per a l'any 2019, a l'illa de Mallorca, amb l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt;, per la qual es va incrementar el crèdit del concert amb l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt;&lt;em&gt; &lt;/em&gt;per atendre una ampliació amb un nombre total de 13 places estimades d'alta intensitat, per prestar el servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, durant el període que va de dia 1 de març de 2019 fins a 30 de juny de 2019, atès que a partir de l'1 de març de 2019 la Conselleria de Serveis Socials i Cooperació va passar a gestionar els serveis d'atenció residencial comunitària (SARC) per a persones amb diagnòstic de salut mental, gestionats pel Servei de Salut de les Illes Balears (IB-Salut), segons determina &lt;span style="background-color:#ffffff"&gt;Acord del Consell de Govern de &lt;/span&gt;dia 9 de novembre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Així doncs, el nombre total de places del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu actualment concertades amb l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER &lt;/em&gt;és de 11 places places de baixa intensitat i 20 places d'alta intensitat fins dia 30 de juny de 2019. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.- En data 22 de març de 2019 l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt; va presentar un escrit on s'exposa la voluntat de renovar el concert vigent pel mateix nombre de places que actualment té concertades juntament amb una declaració jurada de que l'entitat segueix complint els requisits exigits a la firma del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.- En data &lt;/span&gt;&lt;span style="color:#000000"&gt;2&lt;/span&gt;&lt;span style="color:#000000"&gt;5&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;m&lt;/span&gt;&lt;span style="color:#000000"&gt;arç&lt;/span&gt;&lt;span style="color:#000000"&gt; de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; es va emetre &lt;/span&gt;&lt;span style="color:#000000"&gt;Informe justificatiu del director general de Dependència, relatiu a la necessitat i la urgència de la renovació del concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu per a l'any 2019-2020&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;A aquest informe es considera necessari renovar el concert amb l'entitat &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;per un total d&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;11&lt;/span&gt;&lt;span style="color:#000000"&gt; places &lt;/span&gt;&lt;span style="color:#000000"&gt;places &lt;/span&gt;&lt;span style="color:#000000"&gt;de baixa intensitat &lt;/span&gt;&lt;span style="color:#000000"&gt;i &lt;/span&gt;&lt;span style="color:#000000"&gt;20&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;places &lt;/span&gt;&lt;span style="color:#000000"&gt;d'alta intensitat &lt;/span&gt;&lt;span style="color:#000000"&gt;durant el període de l'1 de juli&lt;/span&gt;&lt;span style="color:#000000"&gt;ol&lt;/span&gt;&lt;span style="color:#000000"&gt; de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;span style="color:#000000"&gt; a&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt;0&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;juny&lt;/span&gt;&lt;span style="color:#000000"&gt; de 20&lt;/span&gt;&lt;span style="color:#000000"&gt;20&lt;/span&gt;&lt;span style="color:#000000"&gt;, per tal &lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;seguir &lt;/span&gt;&lt;span style="color:#000000"&gt;dona&lt;/span&gt;&lt;span style="color:#000000"&gt;nt&lt;/span&gt;&lt;span style="color:#000000"&gt; cobertura a aquest col·lectiu d&lt;/span&gt;&lt;span style="color:#000000"&gt;e persones amb discapacitat atès qu&lt;/span&gt;&lt;span style="color:#000000"&gt;e &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;subsisteixen les causes d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;e necessitat&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;de les demandes del servei&lt;/span&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.- En data 26 de març de 2019,&lt;/span&gt;&lt;span style="color:#000000"&gt; el director general de Dependència va dictar &lt;/span&gt;&lt;span style="color:#000000"&gt;la &lt;/span&gt;&lt;span style="color:#000000"&gt;proposta de resolució relativa a la renovació del concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2019 i 2020, amb l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;1. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;2. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3. El Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;4. El Decret 6/2017, de 7 d'abril, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;5. El Decret 24/2015, de 7 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;6. La Resolució de la consellera de Serveis Socials i Cooperació de 8 de maig de 2018 per la qual es convoca el concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2018-2019, publicada al BOIB núm. 59, de 12 de maig de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot això, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.- Autoritzar i disposar una despesa a favor de l'entitat &lt;em&gt;FUNDACIÓ ES GARROVER&lt;/em&gt;, amb CIF G57356057, per import de 541.860,12 euros (IVA exempt), amb càrrec a les següents partides i anualitats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- 2019, 225.775,05 € corresponents als mes&lt;span style="background-color:#ffffff"&gt;os &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de juliol&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; a novem&lt;/span&gt;bre de 2019, amb càrrec a la partida 17301.313B01.26104.00, dels pressuposts de la comunitat autònoma per a l'any 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- 2020, 316.085,07 €, corresponents als mesos de desembre de 2019 a juny de 2020, amb càrrec a la partida 17301.313B01.26104.00, (o equivalent que la substitueixi), del pressuposts de la comunitat autònoma per a l'any 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;3.- El concert es regirà per les estipulacions del document &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; concert &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;signat en data &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;9&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;juliol&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt; de 201&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;8&lt;em&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/em&gt;i pel Plec General de prescripcions tècniques. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;4.- Notificar aquesta resolució a l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;'entitat interessada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució –que exhaureix la via administrativa– es pot interposar un recurs potestatiu de reposició davant la consellera de Serveis Socials i Cooperació en el termini d'un mes comptador des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 124 de la Llei 39/2015, d '1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà d'haver rebut la notificació de la Resolució, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
