&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports en funcions, en data 3 de juny de 2019, ha dictat la següent resolució que transcric literalment a continuació:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;"&lt;/span&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports va aprovar, mitjançant resolució de dia 11 de desembre de 2018, la convocatòria&lt;strong&gt; &lt;/strong&gt;d'ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; als fons de creació i producció d'arts plàstiques i visuals 2019 per donar suport a la realització de projectes expositius d'arts plàstiques i visuals, i les normes que la regeixen. Aquesta resolució es va publicar en el Butlletí Oficial de les Illes Balears núm. 2, de 3 de gener de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La comissió tècnica avaluadora va emetre, mitjançant acta de sessió del dia 2 de maig de 2019, l'informe proposta relatiu a la concessió de la convocatòria d'ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; als fons de creació i producció d'arts plàstiques i visuals 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. En data 2 de maig de 2019, l'òrgan instructor ha emès l'informe sobre el compliment dels requisits de la convocatòria esmentada per part de les persones beneficiàries proposades i, per altra banda, s'ha emès informe favorable sobre els aspectes jurídics de la concessió dels ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. L'existència de crèdit pressupostari adequat i suficient per dur a terme l'esmentada convocatòria, resta acreditada en l'expedient amb càrrec a les partides pressupostàries del pressupost de despeses del Consell de Mallorca de l'exercici 2019, núm. 20.33430.47900 per un import de 60.000,00 € per a les galeries i la partida pressupostària 20.33430.48902 per un import de 60.000,00 € pels artistes, en virtut de les operacions comptables en fase “A” núms. 2201890001043 (núm. de ref. 22019/1914) i 2201890001044 (núm. de ref. 22019/1915), respectivament, així com el contingut de l'acta de la comissió tècnica avaluadora per atendre la concessió dels ajuts proposats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Dia 30 de maig de 2019, la Intervenció Delegada.- Centre la Misericòrdia ha emès informe favorable de fiscalització de la proposta de resolució de la concessió de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. L'Ordenança General de Subvencions del Consell de Mallorca, de 23 de desembre de 2016 (BOIB núm. 21, de 18 de febrer de 2017), modificada per acord del Ple de 14 de juny de 2018 (BOIB núm. 96, de 4 d'agost de 2018&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. La Llei 38/2003, de 17 de novembre, general de subvencions (BOE núm. 276, de 18 de novembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. El Reial Decret 887/2006, de 21 de juliol, pel qual s'aprova el reglament de la Llei 38/2003 general de subvencions (BOE núm.176, de 25 de juliol de 2006).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Les pròpies normes que regulen la convocatòria de subvencions, aprovada per resolució del vicepresident primer i conseller executiu del Departament de Cultura, Patrimoni i Esports de data 11 de desembre de 2018 i publicada en el BOIB núm. 2, de 3 de gener de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. L'òrgan competent per resoldre la convocatòria és el vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports, de conformitat amb l'article 1.g) del Decret d'Organització del Consell de Mallorca de dia 9 de juny de 2017 (BOIB núm. 73, de 15 de juny de 2017), correcció d'errors de 15 de juny de 2017 (BOIB núm. 74 de 17 de juny), modificat per decret de 20 de juny de 2017 (BOIB núm. 77 de 24 de juny), correcció d'errors (BOIB núm. 82 de 6 de juliol de 2017), modificat per decret de 24 de juliol de 2017 (BOIB núm. 92 de 29 de juliol) i per decret de 16 de gener de 2018 (BOIB núm. 12 de 25 de gener de 2018, amb concordança amb la base 23.5 d'execució del pressupost per a l'any 2019, i amb el punt sisè de la convocatòria..&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Llei 8/2000, de 27 d'octubre, de consells insulars (BOIB núm. 134, de 2 de novembre de 2000).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. Llei 39/2015, d'1 d'octubre del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;8. Llei 40/2015, d'1 d'octubre de règim jurídic del sector públic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;9. 7. Reglament núm. 1407/2013 de la Comissió, de 18 de desembre de 2013, relatiu a l'aplicació dels articles 107 i 108 del Tractat de Funcionament de la UE a les ajudes de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis &lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt;(Diari Oficial de la Comunitat Europea núm. L 352 de 24 de desembre de 2013).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Atesos el antecedents i els fonaments de dret exposats, d'acord amb el Reglament d'organització vigent del Consell del Mallorca, dicto la següent,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Concedir la quantitat total de 9.000,00 €. a favor de les entitats (galeries) amb les sol·licituds admeses que s'assenyalen en l'”Annex 1A-Concessions Galeries d'Art” i disposar-ne la despesa a favor seu, pels imports que s'hi indiquen, amb càrrec a la partida pressupostària 20.33430.47900, operació comptable en fase “A” núm. 2201890001043 (núm. de ref. 22019/1914), d'acord amb les normes de la convocatòria d'ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis&lt;/span&gt;&lt;/em&gt; &lt;span style="color:black"&gt;al fons de creació i producció d'arts plàstiques i visuals 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Tenir per desistides les sol·licituds que recull l'”Annex 2 A-Excloses Galeries” i pels motius que s'hi indiquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Tenir per desistides les sol·licituds que recull l'”Annex 2 B-Excloses Artistes” i pels motius que s'hi indiquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. Anul·lar l'autorització de despesa (A) amb núm. d'operació 2201890001043 (núm. de ref. 22019/1914), la quantitat de 51.000,00 €, com a romanent resultant de la diferència entre la quantitat de la dotació pressupostària destinada als ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; dels projectes expositius d'arts plàstiques i visuals de galeries d'art (60.000 €) i la suma agregada dels imports dels ajuts de &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;minimis&lt;/span&gt;&lt;/em&gt; &lt;span style="color:black"&gt;de les sol·licituds admeses (9.000,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5. Anul·lar l'autorització de despesa (A) amb núm. d'operació 2201890001044 (núm. de ref. 22019/1915) la quantitat de 60.000,00 €, com a romanent resultant de la diferència entre la quantitat de la dotació pressupostària destinada a subvencionar els projectes expositius d'arts plàstiques i visuals dels artistes (60.000,00 €) i la suma agregada dels imports de subvenció de les sol·licituds admeses (0,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Comunicar aquesta resolució a la Intervenció Delegada. Centre la Misericòrdia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;7. Publicar aquesta resolució al &lt;/span&gt;&lt;em&gt;&lt;span style="color:black"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra aquesta resolució, que no posa fi a la via administrativa, podeu interposar el recurs d'alçada, dins el termini d'un mes, davant aquest conseller executiu/consellera executiva o davant la presidència, comptador a partir de l'endemà al de la recepció d'aquesta notificació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra la desestimació expressa dels recurs d'alçada, hi podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma, en el termini de dos mesos, comptadors des de l'endemà de rebre la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Un cop transcorregut tres mesos des de la interposició del recurs d'alçada i no n'heu rebut la notificació de resolució expressa, s'entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma, sense limitació de temps.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;N'obstant l'anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d'1 d'octubre, del&amp;nbsp; procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
