<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Pla director sectorial de residus no perillosos de l'illa de Mallorca (PDSRNPM) és l'instrument d'ordenació territorial que té per objecte regular el planejament, la projecció, l'execució i la gestió dels sistemes generals d'infraestructures, d'equipaments i de serveis necessaris per a la gestió dels residus no perillosos.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 2. Àmbit d'aplicació</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. L'àmbit territorial d'aplicació del present PDSRNPM és la illa de Mallorca</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. L'àmbit material són els residus no perillosos. D'acord amb la Llei 2/2001, de 7 de març, d'atribució de competències als consells insulars en matèria d'ordenació del territori, queden exclosos d'aquest pla director sectorial els residus perillosos.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">Prèvia sol·licitud per part d'un municipi i autorització per part del Consell de Mallorca es podrà establir la gestió a fora de l'àmbit del servei públic insularitat i per un període temporal determinat.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Són residus no perillosos de tractament obligatori al servei públic insularitzat de gestió de residus de construcció i demolició, d'equips elèctrics i electrònics i voluminosos- sempre i quan el servei disposi de les instal·lacions de tractament adequades amb la capacitat necessària- els següents:</span></span></span></p>

Amb autorització i aprovació prèvia de tarifa específica del Consell Insular de Mallorca, es podran admetre a les instal·lacions de tractament dels serveis públics insularitzats en règim de lliure concurrència, aquells residus previstos a les corresponents Autoritzacions ambientals integrades o autoritzacions sectorials en matèria de residus.</span></span><span style="line-height:115%"> </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 3. Objectius del PDSRNPM</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. L'objectiu del PDSRNPM és regular en l'àmbit de la gestió de residus no perillosos de Mallorca el planejament, la projecció, l'execució i la gestió dels sistemes generals d'infraestructures. Aquest objectiu es concreta en: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Unificar en un sol pla director totes les tipologies de residus no perillosos simplificant així les eines de planejament i aprofitant les sinèrgies. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Definir la xarxa d'infraestructures públiques per a la gestió correcte dels residus no perillosos de l'àmbit d'aplicació del pla d'acord a les necessitats de gestió actual i futura en base als objectius de gestió de residus que es preveuen a nivell autonòmic, estatal i europeu</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Establir una xarxa d'instal·lacions pel tractament de residus orgànics propera a la població per tal de minimitzar l'impacte i el cost del transport d'aquests residus i apropar el tancament del cicle de la matèria als llocs d'origen.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Facilitar i potenciar l'establiment d'una xarxa d'instal·lacions que permetin potenciar la preparació per a la reutilització i les recollides selectives optimitzant els impactes vinculats al transport i tractament. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Definir la ubicació de la xarxa d'infraestructures maximitzant l'ús de les reserves territorials actuals definides per al tractament de residus i reduir d'aquesta manera l'ocupació de sòl addicional. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Identificar les millores d'accessos i infraestructures auxiliars a les diferents zones de tractament de residus</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g) Ordenar i protegir el medi ambient rural i urbà, el patrimoni cultural i el paisatge d'acord amb el Conveni Europeu del Paisatge i el seu desplegament estratègic a l'illa de Mallorca procurant la integració paisatgística i a tots els nivells dels equipaments i infraestructures per a la prevenció i el tractament dels residus en el seu entorn. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">h) Definir a través de l'Estudi d'Impacte ambiental elements de protecció per a la salut de la població i del medi minimitzant els efectes negatius derivats de la xarxa d'instal·lacions definida.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Les estacions de transferència són instal·lacions on els residus que provinguin de la recollida municipal admesos (paper i cartró, vidre, envasos lleugers i resta) es compacten (a excepció del vidre) per ser traslladats a les plantes de tractament amb vehicles de major capacitat.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El PDSRNPM té com a objectiu la modificació i adequació de les instal·lacions actuals per tal d'optimitzar la logística de transport de les diferents fraccions. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Els residus recollits en els municipis es destinaran a les següents estacions de transferència, les quals els donaran servei amb la següent distribució:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Els residus procedents de Palma, Bunyola, Esporles, Valldemossa, Sóller, Deià, Fornalutx, Llucmajor, Estellencs, Banyalbufar, Marratxí i Puigpunyent seran lliurats directament a les respectives plantes de tractament insulars. En el cas de les fraccions de paper-cartró i vidre la planta de destí estarà localitzada fora de l'àmbit insular ja que actualment no existeix cap a les Illes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. El Consell Insular de Mallorca podrà autoritzar, amb caràcter temporal i condicionat a la seva capacitat, el canvi de destí dels residus generats per un municipi prèvia petició raonada del seu ajuntament.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. El Consell Insular de Mallorca, així mateix, prèvia motivació i en funció de les necessitats del servei, podrà ordenar el canvi de destí, dins de les instal·lacions del servei públic, dels residus generats per un municipi.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">7. El Consell Insular de Mallorca estudiarà la possibilitat d'incloure la transferència d'altres residus de la seva competència si resulta una opció d'interès des de la perspectiva ambiental, social i econòmica. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 8. Centres de transferència i pretractament dels residus de construcció – demolició, residus d'aparells elèctrics i electrònics, voluminosos i PFU</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus de construcció - demolició, voluminosos i els pneumàtics fora d'ús (PFU) recollits pels ajuntaments o per transportistes registrats i que seran tractats en l'àmbit territorial de l'illa de Mallorca s'han de destinar a les corresponents plantes de tractament o als següents centres de transferència i pretractament (CTP):</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquestes instal·lacions són la fracció orgànica dels residus domèstics/municipals, el tractament insularitzat de la qual és competència del Consell Insular, i restes vegetals. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Les plantes de compostatge de FORM previstes són les següents:</span></span></span></p>

El Consell Insular determinarà l'ordre d'execució de les plantes de compostatge en funció de les necessitats de tractament de la FORM. En el moment de la realització de l'avantprojecte es realitzarà un anàlisi de les millors tècniques disponibles. Les prioritzacions de les inversions també hauran d'ajustar-se a les necessitats de noves instal·lacions.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En funció de les necessitats del servei, el Consell Insular de Mallorca podrà autoritzar el tractament de llots a aquestes plantes de compostatge de FORM.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Per tal de donar resposta als principis basics de l'economia circular i de preparació per a la reutilització i avançar en el compliment de la normativa comunitària i estatal en matèria de residus, es permeten tant l'autocompostatge com aquelles iniciatives, incloses les municipals, que tinguin com a objectiu el tractament de matèria orgànica de forma ambientalment segura als efectes d'obtenir compost, amb un límit de tractament de 300 tones de residus LER 20 01 08 i LER 20 02 01 en total, per any, i dins cada municipi, i prèvia obtenció de les autoritzacions que corresponguin. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tot cas serà obligatori informar semestralment al Consell Insular de Mallorca de les tones de residus tractades, les tones de compost obtingut i la qualitat d'aquest compost.</span> </span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 11. Planta de metanització i compostatge</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquesta instal·lació són la fracció orgànica dels residus domèstics/municipals, els llots de les depuradores d'aigües residuals i altres residus orgànics, així com restes vegetals per al procés de compostatge.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de metanització i compostatges s'ubica a la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En funció de les necessitats del servei s'aniran posant en marxa els tres digestors previstos a l'avantprojecte de la instal·lació. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. El digestat resultant del procés de metanització serà compostat a la mateixa instal·lació de forma diferenciada segons el seu origen (llots o FORM).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Les característiques tècniques de la instal·lació es troben recollides en l'avantprojecte.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. El Consell Insular de Mallorca podrà substituir la tipologia de residu tractat en cada digestor en funció de les necessitats reals d'ambdós fluxos. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 12. Plantes de compostatge de llots</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquestes instal·lacions són la fracció de llots que s'obtenen com a residus del procediment de la depuració de les aigües així com restes de podes i altres residus vegetals com a estructurant. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Les plantes de compostatge de llots previstes són les següents:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Zona 2 (Santa Margalida)</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Zona 6 (Felanitx)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. A causa de les disfuncionalitats identificades, s'estableix la desafectació de les instal·lacions existents en els següents municipis:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Ariany</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Sa Pobla</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En el moment de la realització dels avantprojectes es realitzarà un anàlisis de les millors tècniques disponibles. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. Els titulars de les estacions depuradores d'aigües residuals urbanes seran responsables de:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Complir les condicions d'entrada de les instal·lacions que inclouen un percentatge d'humitat dels llots a entrar amb un màxim del 80%. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Transportar els llots fins a les plantes de tractament que designi el Consell Insular de Mallorca. Els mitjans de transport utilitzats estaran hermèticament tapats i seran estancs per tal d'evitar la dispersió de mals olors durant l'esmentat transport de llots.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Complir la normativa vigent en quant a la producció i control dels llots produïts a les estacions depuradores d'aigües residuals. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. En funció de les necessitats del servei, el Consell Insular de Mallorca podrà autoritzar el tractament de FORM en aquestes plantes de compostatge de llots.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 13. Planta d'assecatge de llots digerits i digestat</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquesta instal·lació són els llots digerits procedents de les EDAR i el digestat procedent de la planta de metanització. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta d'assecatge de llots digerits i digestat s'ubica a la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 14. Altres possibles tractaments per als llots de les EDAR i digestat</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El Consell Insular de Mallorca podrà tractar el digestat de metanització i els llots digerits i no digerits que no es puguin destinar a compostatge,metanització o assecatge solar a través de la planta incineradora amb valorització energètica mitjançant la instal·lació d'una tremuja per a facilitar la seva descàrrega.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El Consell Insular de Mallorca podrà autoritzar altres tractaments específics segons el desenvolupament científic-tecnològic que vingui establert per les noves tecnologies de tractament d'aquests residus sense perjudici de l'obtenció de les corresponents autoritzacions sectorials competència del Govern de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 15. Planta selecció envasos i planta de comptatge i emmagatzematge</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El residu admès en aquesta instal·lació és la fracció d'envasos lleugers provinents de la recollida municipal o de les plantes de transferència. El Consell Insular podrà ampliar la tipologia de residus acceptats en aquesta instal·lació, amb o sense modificacions dels processos, si així ho permet la legislació vigent.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de selecció d'envasos s'ubica a la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En funció de l'evolució del model de gestió d'envasos, a la Zona 1 s'ampliarà la planta de triatge d'envasos lleugers o s'implantarà una planta de comptatge i emmagatzematge.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Les ampliacions futures seran modulars per tal de facilitar la incorporació de les Millors Tècniques Disponibles (MTDs), afavorint d'aquesta manera:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) L'increment de l'eficiència de la planta.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) La viabilitat de separació i posterior recuperació dels fluxos de residus valoritzables.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 16. Planta incineradora amb valorització energètica</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquesta instal·lació provenen de la fracció resta dels residus municipals. També es poden tractar altres residus com els residus sanitaris tipus II o restes d'animals així com altres residus autoritzats pel Consell Insular de Mallorca com a alternativa a la disposició final. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta incineradora amb valorització energètica s'ubica a la Zona 1. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Es preveu la incorporació d'una tremuja per a la canalització de llots als forns per a què, en cas de necessitat, se'n pugui gestionar una part a través de la planta incineradora amb valorització energètica.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. El Consell Insular de Mallorca tancarà les línies 1 i 2 d'incineració quan la quantitat mensual de rebuig no superi les 40.000 t durant un període consecutiu de tres anys i, durant l'any, es pugui realitzar la parada de manteniment.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 17. Tractament residus d'origen animal i sanitaris de grup II</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Es durà a terme el tractament de residus d'origen animal i el grup II de residus sanitaris en la planta incineradora amb valorització energètica. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Pel que fa al tractament de residus d'origen animal el Consell Insular de Mallorca podrà autoritzar altres tractaments, en base a la normativa vigent.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En cas de cadàvers d'animals que no poden ser incinerats per raons tècniques, s'han de dipositar a la cel·la específica per a cadàvers animals a l'abocador de residus no perillosos de la zona 1 (abocador de coa).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 18. Dipòsit controlat de cendres</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquesta instal·lació són les cendres estabilitzades procedents de la depuració de gasos de la incineració de les etapes de valorització energètica del rebuig; sense perjudici de la possibilitat de valorar altres destins que s'ajustin a la piràmide jeràrquica de la gestió de residus de les directives europees i la legislació estatal i autonòmica, prèvia autorització sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El dipòsit controlat de cendres estabilitzades s'ubica a la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 19. Planta de tractament d'escòries</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquesta instal·lació són les escòries procedents de la incineració amb valorització energètica; sense perjudici de la possibilitat de valorar altres destins que s'ajustin a la piràmide jeràrquica de la gestió de residus de les directives europees, la legislació estatal i l'autonòmica.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. La planta de tractament d'escòries s'ubica a la Zona 1. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. L'emmagatzematge temporal de les fraccions procedents del tractament de les escòries, com a pas previ a la seva valorització material, s'ubica a la Zona 1. El Consell Insular de Mallorca pot autoritzar altres zones que no estiguin específicament detallades en el present pla director sectorial sense perjudici de les autoritzacions sectorials pertinents. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 20. Dipòsit de rebuig</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els residus admesos en aquestes instal·lacions són els residus no valoritzables materialment i que, per raons tècniques o en situacions excepcionals, no puguin ser destinats a la planta incineradora amb valorització energètica.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Existeixen dos dipòsits de rebuig a l'illa de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Dipòsit d'emergència (Abocador de coa) a la Zona 1 a l'àrea de Son Reus.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Dipòsit de rebuig de la Zona 2 (Abocador Corral Serra)</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 21. Xarxa de deixalleries municipals</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Tots els municipis han de garantir el servei de deixalleria als seus ciutadans, ja sigui de forma independent o mancomunada, per a la recepció, emmagatzematge selectiu i preclassificació de productes usats destinats a la reutilització de residus municipals en espera de tractaments posteriors, com la preparació per a la reutilització, la valorització i l'eliminació. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Les deixalleries s'han de preveure en els respectius instruments de planejament urbanístic, havent de complir amb les prescripcions tècniques que siguin aprovades pel Govern de les Illes Balears i comptar amb les autoritzacions previstes per la normativa sectorial en matèria de residus.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Correspondrà als municipis, o als ens en què hagin delegat, regular les normes de funcionament de les deixalleries a través de les ordenances corresponents.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 22. Altres instal·lacions per a la gestió i prevenció de residus</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Es garanteix la disponibilitat de sòl per a activitats de gestió de residus no perillosos, per a la reutilització com a matèria primera d'alguns d'ells i per a la preparació per a la reutilització a l'àrea empresarial de gestió de residus (AGIR) de la Zona 1.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Aquest AGIR garanteix disponibilitat de sòl per a la instal·lació d'una planta de rentat d'envasos per donar resposta a un canvi de model en la seva gestió.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Per al foment de la prevenció i la correcta gestió dels residus es disposa del Centre d'informació i educació ambiental (CIEA) de la Zona 1 de tractament de residus com una eina estructural de formació, divulgació i suport de les activitats i iniciatives ambientals segons un pla d'usos i gestió que és aprovat i revisat periòdicament pel Consell Insular de Mallorca. </span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">CAPÍTOL II. UBICACIÓ DE LES ACTUACIONS I PRIORITZACIÓ </span></span></span></strong></p>

La priorització del desenvolupament del PDSRNPM respon a una previsió de necessitats de tractament per flux on, de manera immediata, es procedeix a efectuar aquelles millores necessàries en la gestió actual relatives a incrementar capacitat de tractament de llots de depuradora, FORM i millores en les estacions de transferència, entre d'altres.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En funció de la consecució dels objectius del model de gestió de residus de Mallorca, s'aniran posant en marxa les altres instal·lacions.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">CAPÍTOL III. EFICIÈNCIA ENERGÈTICA</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 25. Eficiència energètica</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La implantació de les instal·lacions de residus previstes en aquest Pla Director Sectorial, incloses les deixalleries, es regirà sota els criteris d'eficiència energètica, mitjançant la incorporació de mesures ambientals i d'ecodisseny en els edificis i potenciant l'ús d'energies renovables. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En la fase de clausura dels abocadors i en altres espais degradats es potenciaran les instal·lacions d'energies renovables en els termes previstos en el Pla Director Sectorial Energètic de les Illes Balears. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En la fase d'autorització caldrà realitzar l'avaluació sobre la viabilitat de les solucions tecnològiques implantades. </span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTOL III. VINCULACIONS A PLANS URBANÍSTICS I REGULACIÓ SECTORIAL ESPECÍFICA</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 26. Vinculació al planejament urbanístic municipal</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Les previsions d'aquest pla director sectorial relatives a zones d'ubicació d'instal·lacions, infraestructures, equipaments, serveis o activitats d'explotació, usos del territori i altres determinacions assimilades, d'acord amb el previst a l'article 15 de la Llei 14/2000, de 21 de desembre, d'ordenació territorial, vinculen a tots els instruments de planejament urbanístic, per tractar-se d'aspectes en què predomina l'interès públic insular.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Els ajuntaments de l'illa de Mallorca que resultin afectats per les previsions a què es refereix l'apartat 1 anterior, han d'adaptar els seus instruments de planejament urbanístic corresponents en el termini màxim d'un any des de l'entrada en vigor d'aquest pla director sectorial, sens perjudici de l'aplicació directa de les determinacions vinculants previstes. La superació del termini d'adaptació legitima la subrogació del Consell Insular de Mallorca en l'exercici de la competència municipal per dur a terme la redacció i la tramitació del planejament urbanístic afectat.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. En tot cas, si el municipi duu a terme la formulació del nou planejament urbanístic o la seva revisió abans del termini d'un any des de la vigència d'aquest pla director sectorial, s'ha d'adaptar necessàriament a les seves previsions.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En els supòsits en què la previsió d'instal·lacions, infraestructures, equipaments, serveis o activitats d'explotació pròpies d'aquest pla director sectorial no estiguin previstes amb grau de detall, concreció i programació de les obres associades, el Consell Insular de Mallorca ha d'elaborar i aprovar en desplegament d'aquestes determinacions els plans especials que siguin necessaris, d'acord amb l'article 45 de la Llei 12/2017, de 29 de desembre, d'urbanisme de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 27. Declaració d'utilitat pública i exempció del règim d'autorització preventiva</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Totes les obres, instal·lacions i serveis, siguin de primera implantació, ampliació, modificació o reforma, inclosos els accessos necessaris i els traçats de línies de subministrament elèctriques que correspongui, que es preveuen de forma concreta en aquest pla director sectorial o en els plans especials que el despleguin, duen implícita la declaració d'utilitat pública a l'efecte previst a la legislació sobre expropiació forçosa, d'acord amb allò que determina l'article 16 de la Llei 14/2000, de 21 de desembre, d'ordenació territorial, i l'article 67 de la Llei 12/2017, de 29 de desembre, d'urbanisme de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Les actuacions a què es refereix l'apartat 1 anterior, s'exclouen de la subjecció a llicència o del règim de comunicació prèvia, d'acord amb l'apartat 2 de l'article 149 de la Llei 12/2017, de 29 de desembre, d'urbanisme de les Illes Balears.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 28. Sòls subjectes a regulació sectorial específica (AP)</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Queden exclosos de les determinacions d'aquest Pla Director Sectorial de Residus No Perillosos els sòls subjectes a la següent regulació sectorial específica:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les zones de Servei Aeroportuari d'acord amb la Llei 13/1996</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Així en relació amb els Àmbits amb regulació específica corresponents als terrenys inclosos a les zones de servei dels Aeroports de Palma o de Son Bonet, s'hi estarà al disposat a la normativa estatal en matèria aeroportuària i, en el seu cas, a les disposicions dels Plans Directors dels Aeroports de Palma o de Son Bonet, segons correspongui, essent el usos admissibles en aquests terrenys exclusivament l'ús públic aeroportuari.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Les zones definides com de servei portuari dels ports de Palma i d'Alcúdia així com el sòl de domini públic portuari afecte com sistema general portuari i la resta de prescripcions desenvolupades al Text Refós de la Llei de Ports de l'Estat i de la Marina mercant (RD 2/2011).</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) D'acord amb la Llei 10/2005 de Ports de les Illes Balears, i el Decret 11/2011 pel qual s'aprova el reglament que la desenvolupa s'exclouen de la regulació d'aquest pla les zones de servei portuàries relatives als ports de competència del Govern de Illes Balears.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Les zones de domini públic marítim terrestres.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Aquests sòls es regeixen per la seva normativa sectorial corresponent i els usos que en elles es permeten estan lligats a l'interès específic sectorial pel qual han estat exclosos d'aquest pla.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTOL IV. MINIMITZACIÓ I IMPACTES AMBIENTALS DE LES INFRAESTRUCTURES</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 29. Compensació ambiental</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Els pressupostos dels projectes que desenvoluparan les instal·lacions previstes en aquest pla director sectorial hauran d'incloure una partida econòmica relativa als recursos naturals afectats. Específicament en la fase d'avantprojecte de la infraestructura s'analitzarà el cost de les mesures necessàries per evitar amb caràcter preventiu els danys previsibles sobre la qualitat ambiental, el paisatge i els recursos naturals, i per establir l'adequada aplicació dels processos econòmics terciaris amb la conservació i el manteniment del patrimoni natural i paisatgístic.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 30. Programa de Vigilància Ambiental</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">EI Consell Insular de Mallorca supervisarà la vigilància ambiental de les instal·lacions previstes en el present pla director sectorial d'acord amb les autoritzacions ambientals integrades i la resta d'autoritzacions sectorials que li siguin d'aplicació.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTOL V. FINANÇAMENT</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 31. Finançament de les actuacions del servei públic</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El finançament de les actuacions del servei públic derivades del present pla director sectorial es realitzarà a càrrec de:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les tarifes de tractament aprovades pel Consell de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) La venta de productes i sub-productes resultat del tractament dels residus.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Els Sistemes Integrats de Gestió prevists a la Llei 11/1997, de 24 d'abril, d'envasos i residus d'envasos que estiguin autoritzats a les Illes Balears mitjançant les aportacions econòmiques contemplades en els corresponents convenis de col·laboració signats amb el Consell Insular de Mallorca.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Subvencions o aportacions d'altres Administracions Públiques. </span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 33. Revisió</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquest Pla Director Sectorial s'haurà d'avaluar i revisar als sis anys de la seva aprovació en compliment del punt 5 de l'article 14 de la Llei 22/2011, de 28 de juliol, de residus i sòls contaminats.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">TÍTOL VII. GESTIÓ D'INFORMACIÓ I TRANSPARÈNCIA</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 34. Subministrament d'informació</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Els Municipis que realitzin la recollida en massa i selectiva prevista en el present pla pels seus propis mitjans han de presentar al Consell Insular de Mallorca, anualment i abans del 31 de gener, la següent informació:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les dades de la recollida en massa i selectiva, separant per tipus de residus. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) El tipus de recollida selectiva, indicant si es fa només a generadors singulars qualificats o a tots els usuaris.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El Consell Insular de Mallorca, anualment i durant el primer trimestre de l'any, lliurarà a la Conselleria de Medi Ambient del Govern de les Illes Balears el corresponent informe de l'any anterior sobre el tractament dels residus; amb el següent contingut mínim: </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Producció total de residus urbans, en tones/any, separant per municipis i/o mancomunitats.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Percentatge de residus tractats mitjançant les diferents tècniques previstes. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Llistat de municipis amb sistemes de recollida selectiva. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Dades de la recollida selectiva, separant per tipus de residus i per municipis i/o mancomunitats. </span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Tota la informació es subministrarà en suport informàtic i, si escau, es detallarà mitjançant els formularis previstos a la normativa vigent. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 35. Comissió de seguiment</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. La Comissió de seguiment estarà formada per representants dels grups polítics que formen el plenari del Consell Insular de Mallorca, dels ajuntaments amb instal·lacions en el seu termini municipal, representants de grups ecologistes, representants de col·legis professionals, Universitat de les Illes Balears, associacions de veïns dels municipis afectats per instal·lacions, fundacions que treballen en el sector, representants del sector dels gestors de residus, representants dels sistemes de responsabilitat ampliada del productor presents en l'illa, representants dels concessionaris dels serveis públics de la gestió de residus, sense detriment d'altres incorporacions i es reunirà, com a mínim, una vegada a l'any.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En el marc de la comissió el Consell Insular de Mallorca informarà i exposarà les memòries anuals, els canvis produïts i proposats en les instal·lacions, compliments d'objectius en matèria de residus, així com les dades del programa de mesures i vigilància ambiental.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Aquesta Comissió té caràcter consultiu i informatiu i tindrà la funció de debatre, reflexionar, proposar i recomanar tot allò que sigui una millora significativa en la gestió dels residus urbans de l'illa de Mallorca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. Correspondrà a la Comissió fer un exhaustiu seguiment del compliment dels objectius de recollida selectiva i de la conseqüent disminució de la incineració.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 36. Transparència en les dades</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El Consell Insular de Mallorca posarà a disposició de les ciutadanes i ciutadans tota la informació en matèria de residus mitjançant:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) La “Comissió de Seguiment de la gestió de residus de Mallorca”. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Un visor que permetrà fer el seguiment de les dades de les instal·lacions.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) La pàgina web on es publicaran les dades vinculades a la gestió de residus no perillosos de l'illa.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONS ADDICIONALS</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició addicional primera. Tractament de residus no procedents de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Encara que, en un principi, els residus que s'han de tractar a les instal·lacions previstes en aquest Pla Director Sectorial són els procedents de Mallorca, en casos justificats a nivell ambiental, social i econòmic es podran tractar residus procedents de Menorca, Eivissa i Formentera a petició dels respectius Consells Insulars, respectant el compliment de la normativa en matèria de trasllat de residus, amb acord del Govern de les Illes Balears, i prèvia acceptació del Consell Insular de Mallorca que avaluarà unes condicions de temporalitat, de volum i d'entrada, sense que es pugui acceptar fracció de rebuig que no hagi estat sotmesa a un tractament previ.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició addicional segona. Intervencions dins l'Àmbit d'Intervenció Paisatgística – AIP II</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tant no es redacti el Pla Especial a que fa esment la norma 39 del Pla Territorial Insular de Mallorca (PTIM) amb relació a l'Àmbit d'Intervenció Paisatgística - AIP II «Entorns de Son Reus», les actuacions, les intervencions i els projectes d'implantació dins aquest àmbit s'ajustaran als criteris i els continguts de l'annex III del Pla Territorial Insular de Mallorca.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Igualment, en aplicació de la Disposició transitòria desena del Pla Territorial Insular de Mallorca, s'haurà de sol·licitar el corresponent informe al Departament del Consell Insular de Mallorca competent en matèria d'ordenació del territori, per tal d'analitzar la compatibilitat de l'actuació, intervenció o projecte amb els objectius d'integració paisatgística prevists per a l'AIP.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició addicional tercera. Desplegament de mesures correctores per recuperar sòls contaminats</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Estaran obligats a realitzar les operacions de neteja i recuperació dels possibles sòls contaminats afectats per aquest Pla Director Sectorial, els causants de la contaminació, que quan siguin més d'un respondran d'aquestes obligacions de forma solidaria i, subsidiària, per aquest ordre, els posseïdors dels sòls contaminats i els propietaris no posseïdors. Aquestes obligacions de neteja i recuperació dels sòls contaminants seran exigibles d'acord amb el que estableix la Llei 22/2011 i el Reial Decret 9/2005, de 14 de gener, pel que s'estableix la relació d'activitats potencialment contaminants del sòl i els criteris i estàndards per a la declaració de sòls contaminats.</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"></span></strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició addicional quarta. Afeccions aeronàutiques</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. L'execució del PDSRNPM es troba sotmesa al compliment de les obligacions legals i reglamentàries derivades de les restriccions imposades per la normativa en matèria de seguretat aeronàutica segons els apartats següents. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. En les Zones de Servei dels Aeroports de Palma de Mallorca i de Son Bonet, s'estarà a allò que disposa la normativa estatal en matèria aeroportuària i, si escau, a les disposicions dels respectius Plans directors. L'ús públic aeroportuari és l'únic ús admissible en aquests terrenys. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Els instruments de planejament que s'elaborin, revisin o modifiquin en desplegament del PDSRNPM, quan l'àmbit dels quals es trobi totalment o parcialment afectat per les Servituds aeronàutiques acústiques de l'Aeroport de Palma de Mallorca o per l'empremta acústica inclosa dins el Pla director de l' aeroport de Son Bonet, hauran d'incorporar els plànols de les servituds esmentades. En els àmbits afectats no es consideren compatibles els nous usos residencials, dotacionals educatius o sanitaris, ni les modificacions de l'ordenació que suposin l'increment del nombre de persones afectades en relació al planejament vigent. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. En les Zones de Servituds Aeronàutiques corresponents als aeroports de Palma de Mallorca i de Son Bonet i de les instal·lacions radioelèctriques aeronàutiques VOR / DME, NDB, centres de comunicacions, centres emissors i centres receptors existents, sintetitzats en els plànols de l'Annex 3 "Afeccions aeronàutiques ", s'aplicaran les següents restriccions en aplicació de la normativa aeronàutica:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les superfícies limitadores de les servituds aeronàutiques de les infraestructures esmentades determinen l'altura respecte del nivell del mar que no ha de sobrepassar cap modificació del terreny, element de construcció o d'instal·lació fixa, així com el gàlib viari i de les vies de ferrocarril. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Les propostes de noves infraestructures i la revisió o modificació que s'elaborin en el PDSRNPM, l'àmbit dels quals es trobi totalment o parcialment afectat per les servituds aeronàutiques de les instal·lacions esmentades, s'hauran d'informar per la Direcció General d'Aviació Civil en aplicació i en els termes que estableix la normativa vigent de seguretat aeronàutica. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) A les zones i àmbits afectats per servituds aeronàutiques, l'execució de qualsevol construcció, instal·lació, mitjans necessaris per a la construcció o plantació, requerirà d'acord favorable previ de l'Agència Estatal de Seguretat Aèria (AESA) en aplicació i en els termes que estableixi la normativa vigent de seguretat aeronàutica. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">5. La superfície compresa dins de la projecció ortogonal sobre el terreny de l'àrea de les servituds aeronàutiques dels aeroports de Palma de Mallorca i Son Bonet, en aplicació de la normativa de seguretat aeronàutica resta subjecta a una servitud de limitació d'activitats, en virtut de la qual AESA pot prohibir, limitar o condicionar activitats que puguin suposar un perill per a les operacions aèries o el correcte funcionament de les instal·lacions radioelèctriques. Aquesta prohibició es podrà estendre als usos del sòl que facultin per a la implantació de les activitats esmentades. Entre d'altres s'inclouran:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Les activitats que suposin o impliquin la construcció d'obstacles que puguin induir turbulències. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) L'ús de lluminàries, inclosos projectors o emissors làser, que puguin crear perills o induir a confusió o error de navegació. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Les activitats que impliquin la utilització de molt grans superfícies reflectants que puguin provocar enlluernament. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Les actuacions que puguin estimular l'activitat de la fauna a l'entorn de la zona de moviments de l'aeròdrom.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Les activitats que donin lloc a la implantació o funcionament de fonts de radiació no visible o la presència d'objectes fixos o mòbils que pugin interferir en funcionament dels sistemes de comunicació, navegació i vigilància aeronàutiques o afectar negativament. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Les activitats que facilitin o impliquin la implantació o funcionament d'instal·lacions que produeixin fum, boires o qualsevol altre fenomen que suposi un risc per a les aeronaus. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g) L'ús de mitjans de propulsió o sosteniment aeri per a la realització d'activitats esportives o de qualsevol altre tipus. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. En aplicació de la normativa vigent en seguretat aeronàutica, en els terrenys inclosos en les Zones de seguretat de les instal·lacions radioelèctriques per a la navegació aèria es prohibeix qualsevol construcció, o modificació temporal o permanent del terreny, de la superfície o dels elements que es trobin sobre ella, sense consentiment previ de l'Agència Estatal de Seguretat Aèria (AESA). </span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONS TRANSITÒRIES</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició transitòria primera. Plantes d'Ariany i Calvià</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Fins a la recepció definitiva de la fase 2 de la planta de metanització s'ha de mantenir operativa la instal·lació que actualment estan en funcionament a Ariany.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Fins a la seva substitució per la nova planta de compostatge de Calvià, s'haurà de mantenir operativa l'actual instal·lació de Calvià per al tractament de llots de depuradora.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició transitòria segona. Tractament de residus perillosos</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mentre sigui vigent l'actual contracte de gestió de servei públic relatiu a la transferència i tractament de residus de construcció, demolició, voluminosos i pneumàtics fora d'ús, els residus amb consideració de perillosos amb LER 20 01 21*, 20 01 23*, 20 01 35* i del 16 02 11* s'han d'entregar al centres i instal·lacions previstos en els articles 8 i 9 del present Pla Director Sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició transitòria tercera. Tractament de pneumàtics fora d'ús</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mentre sigui vigent l'actual contracte de gestió de servei públic relatiu a la transferència i tractament de residus de construcció, demolició, voluminosos i pneumàtics fora d'ús, els pneumàtics fora d'ús amb LER 16 02 16 s'han d'entregar als centres i instal·lacions previstos en els articles 8 i 9 del present Pla Director Sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició transitòria quarta. Règim transitori AGIR de la zona 1</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mentre no sigui elaborat un pla especial d'acord amb el que preveu l'apartat 4 de l'article 26 d'aquestes normes, mantenen la seva vigència les normes complementàries i subsidiàries de planejament aprovades pel ple del Consell Insular en data 7 de maig de 2007 relatives a l'AGIR 1.1 per a la seva aplicació a l'AGIR de la zona 1 del present Pla Director Sectorial.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició transitòria cinquena. Emmagatzematge de fracció vegetal</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Mentre no es posin en marxa les instal·lacions de compostatge, la fracció vegetal es podrà emmagatzemar en condicions adients que garanteixin la conservació de les seves propietats per tal de poder incorporar-les al procés de compostatge de la FORM.</span></span></span></p>
<p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">DISPOSICIONS DEROGATÒRIES</span></span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició derogatòria primera. Pla Director Sectorial per a la gestió de residus urbans de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. A l'entrada en vigor d'aquest pla director sectorial, queda derogat el document de revisió del pla director sectorial per a la gestió dels residus urbans de l'illa de Mallorca, aprovat pel ple del Consell Insular de Mallorca, en sessió celebrada en data 6 de febrer de 2006 (BOIB Núm. 35, de 9 de març de 2006), i queda sense aplicació el règim establert a l'article 21 del Decret 21/2000, de 18 de febrer, d'aprovació definitiva del Pla Director per a la Gestió dels Residus Urbans de Mallorca per a les àrees empresarials de residus de les zones 1 i 2.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. No obstant el que estableix l'apartat anterior, mentre no siguin objecte d'una regulació específica, es mantenen vigents: els articles 16 i 17, i DA 5ª, DA 9ª i DA 10ª de la Revisió del Pla Director Sectorial per a la gestió dels residus urbans de l'illa de Mallorca aprovat definitivament mitjançant acord del Ple del Consell Insular de Mallorca de 6 de febrer de 2006 (BOIB Núm. 35, de 9 de març de 2006).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Disposició derogatòria segona. Pla Director Sectorial per a la gestió de residus de construcció-demolició, voluminosos i pneumàtics fora d'ús de l'illa de Mallorca</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. Queda derogat el Pla Director Sectorial per a la gestió de residus de construcció-demolició, voluminosos i pneumàtics fora d'ús de l'illa de Mallorca publicat en el BOIB núm. 141, de 23 de novembre de 2002.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. No obstant el que estableix l'apartat anterior, mentre no siguin objecte d'una regulació específica, es mantenen vigents els següents preceptes: l'article 9 amb la redacció conferida per l'article 20 de la Llei 25/2006, de 27 de desembre, els articles 11 i 12 i les DA 3ª i 4ª.</span></span></span></p>
