&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;CAPÍTOL PRIMER&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;DISPOSICIONS GENERALS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;ARTICLE 1.- CONCEPTE.-&lt;/strong&gt; S'entén per subvenció tota disposició gratuïta de fons públics realitzada a favor de persones o entitats públiques o privades per fomentar una activitat d'utilitat pública o interès social o per promoure la consecució d'una fi pública, sempre que compleixin les condicions exigides en l'art. 2 de la Llei 38/2003, de 17 de novembre, General de Subvencions (en endavant LGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 2.- ÀMBIT D'APLICACIÓ.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. La present Ordenança general de subvencions serà aplicable tant per l'Ajuntament com per als seus organismes autònoms.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 3.- REQUISITS PER OBTENIR LA CONDICIÓ DE PERSONA O ENTITAT BENEFICIÀRIA&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. No podran obtenir la condició de persona o entitat beneficiaria en la qui concorri alguna de les circumstàncies establertes en l'art. 13.2 de la LGS, llevat que per la naturalesa de la subvenció ho exceptuï en les bases de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. A més serà necessari estar al corrent de les obligacions pecuniàries de qualsevol classe amb l'Ajuntament de Sa Pobla o, si s'escau, amb els Ens que en depenen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Aquesta obligació s'ha de fer amb relació a la data de la publicació de la convocatòria (en el supòsit de subvencions en concurrència competitiva), o abans de l'aprovació de la subvenció directa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. L'acreditació d'aquests requisits podrà realitzar-se mitjançant testimoni judicial, certificats telemàtics o transmissions de dades o certificació administrativa, segons els casos, i pot substituir per una declaració responsable de la persona o entitat sol·licitant atorgada davant una autoritat administrativa o notari públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. L'acreditació d'estar al corrent de les obligacions amb la Institució municipal correspondrà incorporar-la, amb base en el disposat en l'art. 23.3 de la LGS, a la pròpia Administració, mitjançant certificació de la Tresoreria municipal expedida a l'efecte. El certificat municipal tindrà un període de validesa de dotze mesos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ARTICLE 4.- REGISTRES DE SOL·LICITANTS DE SUBVENCIONS.-&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Els centres gestors o òrgan competent de l'Administració poden crear registres en què es poden inscriure voluntàriament les persones o entitats sol·licitants de subvencions, aportant la documentació acreditativa de la seva personalitat i capacitat d'obrar, així com, si és el cas, la que acrediti la representació de qui actuïn en nom seu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Els certificats expedits per aquests registres eximiran de presentar en cada concreta convocatòria els documents acreditatius dels requisits ressenyats en l'apartat anterior, sempre que no s'hagin produït modificacions o alteracions que afectin les dades inscrites.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 5.- ÒRGANS COMPETENTS PER A LA CONCESSIÓ.- &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Les Bases d'Execució del Pressupost de recollir, per a cada anualitat, els òrgans competents per a la concessió de subvencions. En cas de pròrroga del Pressupost, s'entendran prorrogades les seves Bases i, per tant, la regulació dels òrgans competents per a la concessió de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 6.- PERSONES O ENTITATS BENEFICIÀRIES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Quan la&lt;/span&gt; &lt;span style="line-height:115%"&gt;persona o entitat beneficiària&lt;/span&gt; &lt;span style="line-height:115%"&gt;sigui una persona jurídica, i sempre que així es prevegi en les bases reguladores, els membres associats de l'entitat beneficiària&lt;/span&gt; &lt;span style="line-height:115%"&gt;que es comprometin a efectuar la totalitat o part de les activitats que fonamenten la concessió de la subvenció en nom i per compte del primer tindran igualment la consideració de persones beneficiàries&lt;span style="color:#00b050"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Quan es prevegi expressament en les bases reguladores, podran accedir a la condició de persona o entitat beneficiària, les agrupacions de persones físiques o jurídiques, públiques o privades, les comunitats de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat que, encara mancant de personalitat jurídica, puguin dur a terme els projectes, activitats o comportaments o es trobin en la situació que motiva la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Prohibicions&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) No podran ser beneficiàries de subvencions de l'Ajuntament de sa Pobla, en virtut del que disposa l'article 11.2 de la Llei 11/2016 de 28 de juliol, d'igualtat de dones i homes, les empreses i entitats sancionades o condemnades en resolució administrativa o judicial ferma en els tres anys anteriors a l'aprovació de la corresponent convocatòria, per haver exercit o tolerat pràctiques laborals considerades discriminatòries per raó de sexe o de gènere.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Les empreses o entitat sancionades o condemnades en resolució administrativa o judicial ferma amb anterioritat als tres anys immediatament anteriors a l'aprovació de la corresponent convocatòria per haver exercit o tolerat pràctiques discriminatòries per raó de sexe o de gènere podran ser beneficiàries de subvencions de l'Ajuntament de Sa Pobla sempre i quan hagin complert amb la sanció o pena imposada i hagin elaborat un pla d'igualtat en les condicions previstes a la Llei 11/2016 de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Acreditació de no incórrer en les prohibicions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Als efectes previnguts a l'apartat 3) a) del present article les empreses i entitats sol·licitants hauran de presentar com a documentació annexa o s'inclourà a l'imprès de la mateixa sol·licitud una declaració responsable de no haver estat objecte de sancions administratives fermes o sentencies condemnatòries fermes en les que s'acrediti que han exercit o tolerat pràctiques laborals discriminatòries per raó de sexe o de gènere en els tres anys anteriors a l'aprovació de la corresponent convocatòria i en cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Als efectes previnguts a l'apartat 3) b) del present article les empreses i entitats que es trobin en els supòsit contemplat al mateix hauran de presentar una declaració responsable acreditativa de que han complert la sanció o pena imposada i han elaborat un pla d'igualtat en els condicions previstes a la Llei 11/2016 de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:120%"&gt;ARTICLE 7.- OBLIGACIONS DE LES PERSONES O ENTITATS BENEFICIÀRIES&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Juntament amb les imposades en l'art. 14 de la LGS, les persones o entitats beneficiàries&lt;/span&gt; &lt;span style="line-height:115%"&gt;de les subvencions han de complir les obligacions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Realitzar en termini l'activitat objecte de l'ajuda, així com presentar en termini la modalitat justificativa (compte justificatiu, acreditació per mòduls o presentació d'estats comptables) en els termes establerts en les bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Realitzar les mesures de difusió en els termes establerts a l'art. 31 del Reglament de la Llei General de Subvencions, aprovat per Reial Decret 887/2006, de 21 de juliol (en endavant RGS), que, en tot cas, s'han d'adequar a l'objecte subvencionat, tant en la seva forma com en la seva durada, i hauran de tenir anàloga rellevància a les mesures de difusió realitzades per altres Ens cofinançadors del programa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;D'aquesta obligació seran eximides aquelles subvencions en què, per la seva naturalesa, la publicitat pugui ser contrària al respecte i salvaguarda de l'honor, la intimitat personal i familiar de les persones físiques, en virtut del que estableix la Llei Orgànica 1/1982, de 5 de maig, de protecció civil del dret a l'honor, a la intimitat personal i familiar i a la pròpia imatge; i aquelles altres en què, per la seva impossibilitat material, es justifiqui la seva exempció en la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Aplicar a la seva finalitat dels fons rebuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 8.- FINANÇAMENT DE LES ACTIVITATS SUBVENCIONADES.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. L'import de les subvencions en cap cas, en concurrència amb ajudes o altres ingressos d'altres administracions públiques o d'altres ens públics o privats, nacionals o internacionals, podrà ser superior al cost de l'activitat a desenvolupar per la persona o entitat beneficiària. En cas contrari es reduirà l'aportació de la Ajuntament de sa Pobla al finançament del projecte o de l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Tota alteració de les condicions tingudes en compte per a la concessió de la subvenció, i en tot cas l'obtenció concurrent de subvencions, ajudes, o altres ingressos d'altres administracions públiques o ens públics o privats, nacionals o internacionals, podrà donar lloc a la modificació de la resolució de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Les bases de la convocatòria no podran subvencionar l'activitat a desenvolupar, llevat que s'acrediti un especial interès públic, en una quantitat superior al 90%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ARTICLE 9.- PUBLICITAT DE LES SUBVENCIONS CONCEDIDES.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Quan resulti preceptiu, el Servei o Centre Gestor de la despesa procedirà a la publicació de les subvencions concedides, de conformitat amb el que assenyala l'art. 30 del RGS:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a. La publicació de les subvencions concedides s'ha de fer durant el mes següent a cada trimestre natural i s'inclouran totes les concedides durant aquest període, qualsevol que sigui el procediment de concessió i la forma d'instrumentació, excepte aquelles la publicació estigués exclosa per la Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b. Quan la resolució comprengui tant l'atorgament de subvencions que individualitzadament superin el límit de 3.000 euros com de subvencions que no arriben aquesta quantia, en la publicació s'hauran d'assenyalar, a més de les dades individualitzades de les subvencions superiors a 3.000 euros, el lloc o mitjà en el qual, d'acord amb la normativa reguladora de la subvenció, apareixen publicats a la resta de les persones o entitats beneficiàries&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c. En la publicació haurà d'expressar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. La convocatòria i la identificació de les subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. El programa i crèdit pressupostari a què s'imputen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. L'existència de finançament amb càrrec a fons de la Unió Europea i, si escau, percentatge de finançament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Nom o raó social de la persona o entitat beneficiària, número d'identificació fiscal, finalitat o finalitats de la subvenció, amb expressió, si s'escau, dels diferents programes o projectes subvencionats, i quantitat concedida. En cas de subvencions plurianuals, import total concedit i distribució d'anualitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Quan les subvencions, individualment considerades, no siguin superiors a 3.000 euros les oficines gestores hauran d'exposar al públic en el seu tauler d'anuncis la relació de les persones o entitats beneficiàries&lt;/span&gt; &lt;span style="line-height:115%"&gt;de les ajudes concedides, havent recollir aquesta previsió en les bases reguladores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;ARTICLE 10.- BASE DE DADES NACIONAL DE SUBVENCIONS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;1.Els Centres Gestors obligats a donar publicitat de les subvencions concedides, en els termes establerts en l'article anterior, remetran a la Secció de Subvencions dependent de la Intervenció, en el termini de deu dies naturals a partir de la finalització de cada trimestre natural, la següent informació de les subvencions concedides en aquest trimestre:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;a. Informació sobre la normativa aplicable:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;. Disposició normativa per la qual s'aproven les bases reguladores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;. Informació identificativa dels beneficiaris de subvencions amb l'abast establert en l'art. 11 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;c. Informació sobre la gestió de les concessions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;. Resolucions de concessió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Informació de la resolució del procediment de reintegrament de subvenció i de la seva recaptació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;e. Informació de la resolució ferma del procediment sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;f. Les dades identificatives, així com el període durant el qual no podrà tenir la condició de la persona o entitat sol·licitant i/o entitat col·laboradora, de persones o entitats culpables en algunes de les prohibicions de l'art. 13 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#00000a"&gt;2. Rebuda la documentació, abans de la finalització del mes següent a la finalització d'aquest trimestre natural, es remetrà aquesta informació a la Intervenció General de l'Administració de l'Estat en els termes establerts en l'art. 39 del RGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;ARTICLE 11.- GARANTIES.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Amb caràcter general, llevat de previsió en contra a les bases de la convocatòria, queden exonerats de la constitució de garantia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Les persones o entitats sol·licitants&lt;/span&gt; &lt;span style="line-height:115%"&gt;de subvencions concedides per import no superior a 3.000 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Les entitats no lucratives, així com les federacions, confederacions o agrupacions de les mateixes, que desenvolupin projectes o programes d'acció social i cooperació internacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Les administracions públiques, els seus organismes vinculats o dependents i les societats mercantils locals, així com les altres entitats que per llei estiguin exemptes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. En els supòsits que preveu l'apartat anterior, així com en les subvencions de caràcter i durada plurianual, podrà abonar-se, sense necessitat de la constitució de garantia prèvia, en concepte de bestreta, fins a un 75% de l'import anual concedit. El 25% restant requerirà la remissió i acceptació de la justificació exigida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Quan es financin projectes d'inversió, podran realitzar-se pagaments en quantia equivalent al 50% de la justificació presentada a compte del certificat final d'obra, i no és necessari aportar garantia amb caràcter previ al pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Per a la resta de les subvencions, es podrà anticipar el 100%, prèvia constitució de l'aval pel muntant de la quantitat anticipada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. No obstant el que disposen els apartats anteriors, es podrà exigir garantia quan es consideri necessari per assegurar el compliment dels compromisos assumits per les persones o entitats sol·licitants i/o entitats col·laboradores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 12.- EN RÈGIM DE CONCURRÈNCIA COMPETITIVA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.- Disposicions generals:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.1. El funcionari en qui delegui el o la Cap&lt;/span&gt; &lt;span style="line-height:115%"&gt;del Servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.3. L'òrgan instructor serà el o la Cap&lt;/span&gt; &lt;span style="line-height:115%"&gt;de la Dependència Administrativa encarregada de la tramitació del procediment, qui, per a la remissió a l'òrgan col·legiat, d'ofici o a instància d'aquest, demanarà tots els informes tècnics que calguin per a la valoració de les sol·licituds presentades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Aquest òrgan, coneguts els possibles beneficiaris, sol·licitaran de la Tresoreria Municipal l'expedició de la certificació d'estar al corrent de les obligacions amb la Institució Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.- Procediment de concessió:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.1. Iniciació: El procediment s'inicia sempre d'ofici, mitjançant convocatòria aprovada per l'òrgan competent (llevat que prèviament s'hagin aprovat les bases reguladores de la subvenció amb el contingut mínim de l'art. 17.3 de la LGS, en aquest cas la convocatòria tindrà necessàriament el contingut de l'art. 23.2 de la LGS), amb el contingut exigit en els arts. 17.3 i 23.2 a), b), h), i), j), k), i m), de la LGS, i a més:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Les bases reguladores de la subvenció:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Podran admetre la substitució de la presentació de determinats documents per una declaració responsable de la persona o entitat sol·licitant, en els termes de l'article 3.4 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Podran preveure el prorrateig de l'import global màxim previst en la convocatòria entre les persones o entitats sol·licitants&lt;/span&gt; &lt;span style="line-height:115%"&gt;de les subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Podran establir l'existència d'altres persones o entitats sol·licitants, en els supòsits a què es refereix l'article 6 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d) Podran admetre com a despesa subvencionable les despeses de les garanties bancàries que, si escau, se li exigeixin a les persones o entitats sol·licitants, així com els costos indirectes, en els termes que estableix l'article 14.5 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;e) Hauran de recollir el règim de publicitat que preveu l'article 9 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;f) Hauran, si escau, fer menció expressa que la sol·licitud de la subvenció per part de la persona o entitat sol·licitant porta implícita l'autorització a l'Ajuntament de sa Pobla o Organisme Autònom Administratiu per a demanar els certificats d'estar al corrent de les obligacions tributàries i de seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Les bases de la convocatòria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Hauran d'establir el termini previst per a la realització de l'activitat. Si la mateixa no està realitzada, el termini s'ha de computar a partir de la notificació de la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Han de fixar la quantia total màxima destinada a les subvencions convocades i els crèdits pressupostaris als quals s'imputen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Excepcionalment, podran fixar una quantia addicional, l'aplicació a la concessió de la subvenció no requerirà d'una nova convocatòria, d'acord amb les regles de l'art. 58.2 del RGS. En aquest supòsit, l'òrgan concedent ha de publicar la declaració de crèdits disponibles i la distribució definitiva, amb caràcter previ a la resolució de concessió, en els mateixos mitjans que la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d) Podran establir la no exempció de la presentació de garanties, sempre que es trobin en algun dels supòsits establerts en l'art. 11.1 de l'OGS i es consideri necessària per a assegurar el compliment dels requisits exigits.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;e) Podran elevar el percentatge mínim establert en l'article 22.b) de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.2. Instrucció:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) L'òrgan instructor, a la vista de l'expedient i de l'informe de l'òrgan col·legiat, llevat que calgui complir el tràmit d'audiència, formularà proposta de resolució definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) L'expedient de concessió de la subvenció contindrà l'informe de l'òrgan instructor, en el qual consti que de la informació que obra en el seu poder es dedueix que les persones o entitats sol·licitants&lt;/span&gt; &lt;span style="line-height:115%"&gt;compleixen tots els requisits per accedir-hi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) La proposta de resolució definitiva es remetrà a l'òrgan interventor per a la seva fiscalització, en els termes de l'art. 214 del Text Refós de la Llei Reguladora de les Hisendes Locals (en endavant TRLRHL).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.3. resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Si hi ha objeccions, per part de l'òrgan interventor, s'iniciarà el procediment de discrepància previst en l'art. 217 del TRLRHL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Si hi ha conformitat per l'òrgan interventor, a la vista de la proposta formulada, l'òrgan competent ha de resoldre en el termini de quinze dies des de la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. En el procediment hauran de quedar acreditats els fonaments de la resolució que s'adopti. La resolució ha de contenir, a més de les persones o entitats sol·licitants, la desestimació de la resta de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.4. Reformulació: En els supòsits i amb les condicions establertes en l'art. 27 de la LGS, llevat de la de les bases reguladores, es pot admetre la reformulació de sol·licituds sempre que no s'hagi dictat proposta definitiva de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 13.- DE FORMA DIRECTA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Es consideren subvencions nominatives, a més de les previstes nominativament en el Pressupost, les que apareguin individualitzades en les Bases d'Execució del Pressupost.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Excepte en aquelles ajudes de quantia no superior a 12.000 euros i en les d'emergència, el conveni serà l'instrument habitual per canalitzar aquest tipus de subvencions, que ha de contenir, entre altres, els següents extrems:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) L'objecte de la subvenció, en el qual s'especifiqui el desenvolupament de l'activitat, les despeses que genera i el seu finançament, que no ha de ser amb caràcter general superior al 91%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) El crèdit pressupostari al qual s'imputa l'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Les obligacions generals de l'article 7 de la present Ordenança, així com altres específiques de la persona o entitat sol·licitant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d) El termini de realització de l'activitat i de presentació de la justificació i pròrroga, si s'escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;e) La justificació del compliment de les obligacions i modalitat de compte justificatiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;f) Les mesures de garantia que, si s'escau, calgui constituir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;g) Els criteris de graduació dels possibles incompliments.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;h) La possibilitat d'efectuar pagaments anticipats o abonaments a compte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Les subvencions que no s'articulin a través de convenis hauran de regular en l'acord de concessió, com a mínim, els apartats a), b), c), d), e), i g).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. En les subvencions directes, excepte raons d'especial interès públic, la persona o entitat sol·licitant de la subvenció haurà de justificar 1,10 vegades la quantitat concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. En les subvencions a què fa referència l'art. 22.2 c) de la LGS, per a l'acreditació de les raons per a la concessió de la subvenció directa, cal acompanyar un informe de l'òrgan gestor, competent per raó de la matèria, justificatiu del caràcter singular de les subvencions, de les raons que acrediten l'interès públic, social, econòmic o humanitari, o altres que justifiquen la dificultat de la seva convocatòria pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;6. L'òrgan instructor, prèviament a la resolució de l'expedient, ha d'acreditar que la persona o entitat sol·licitant no es troben incurs en cap de les prohibicions de l'article 3 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;7. Quan així és consideri oportú, la comprovació formal per a la liquidació de la subvenció ha de comprendre exclusivament els següents documents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) La memòria d'actuació justificativa del compliment de les condiciones imposades a la concessió de la subvenció, amb indicació de les activitats realitzades i dels resultats obtinguts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) La relació qualitativa classificada de les despeses i inversions de l'activitat, amb identificació del creditor i del document, el seu import, data d'emissió, i si escau, la data de pagament. En el cas que la subvenció s'atorgui d'acordar amb el pressupost, s'indicaran els desviacions esdevingudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) El detall d'altres ingressos o subvencions que hagin finançat l'activitat subvencionada, amb indicació de la seva&amp;nbsp; procedència i import.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;En aquest supòsit, la revisió de les factures o documents de valor probatori equivalent en el tràfic jurídic mercantil, o amb eficàcia administrativa, han de ser objecte de comprovació anual plena per l'interventor sobre la base de la mostra representativa de les subvencions atorgades mitjançant aquest sistema.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El control financer d'aquestes subvencions és regirà pel que Disposa el Títol III, especialment pel que preveu l'art. 51, de la LGS. Els informes que s'emetin en exercici d'aquesta funció, de conformitat amb el que disposa l'art. 219.3 del TRLRHL, és remetran al Ple amb els observacions que haguessin efectuat a els Òrgans Gestors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;CAPÍTOL TERCER&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&amp;nbsp;PROCEDIMENTS DE JUSTIFICACIÓ I PAGAMENT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 14.- DESPESES subvencionables.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. De conformitat amb el que disposa l'art. 31 de la LGS, es consideren despeses subvencionables aquelles que de manera indubtable responguin a la naturalesa de l'activitat subvencionada i es realitzin en el termini establert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Es consideren despeses realitzades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Per a les subvencions amb pagaments anticipats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Per l'import anticipat, el que hagi estat efectivament pagada amb anterioritat a la finalització del termini del període de justificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Pel muntant restant, la despesa degudament facturat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Per a la resta de les subvencions, i llevat que la normativa reguladora de la subvenció disposi el contrari, els facturats, entenent per tal els meritats i registrats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Amb caràcter general, no s'admetran com a justificants les despeses de manutenció ni els de quilometratge, llevat que pel Centre Gestor de la despesa s'especifiqui en les bases de la convocatòria la necessitat i l'adequació dels mateixos a l'activitat que es pretén subvencionar, en aquest cas s'han d'especificar detalladament les despeses per aquests conceptes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;En el cas que se subvencionin activitats no professionals, servirà de justificant el rebut en el qual s'acrediti: identificació de la persona o entitat sol·licitant de la subvenció i del subjecte que exerceix l'activitat, concepte, data i import.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Quan se subvencionin despeses d'inversió, s'ha d'expedir una factura detallada conforme al projecte elaborat, a la qual s'acompanyarà certificat final d'obra expedit per tècnic competent, visat pel Col·legi professional corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. Es podrà admetre com a justificació dels costos indirectes sempre que vingui recollit en les bases reguladores o bases de la convocatòria o en els convenis que es formalitzin, en la mesura que corresponguin al període en què efectivament es realitza l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La quantia dels mateixos, amb els estudis econòmics que siguin procedents, no pot superar el límit del 5% de l'import total a justificar, quantia que es pot elevar fins al 15% en el cas d'Institucions de caràcter públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;6. Es podran admetre les despeses derivades de les garanties bancàries que, si escau, s'exigeixin a les persones o entitats sol·licitants, sempre que es prevegi en les bases de la convocatòria o en la normativa reguladora de la subvenció directa. En cap cas seran subvencionables els interessos deutors dels comptes bancaris, els interessos, recàrrecs i sancions administratives i penals, així com les despeses de procediments judicials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;7. Amb caràcter general, no es considera despesa subvencionable l'impost sobre el valor afegit, llevat que la persona o entitat sol·licitant&lt;/span&gt; &lt;span style="line-height:115%"&gt;acrediti, mitjançant certificació administrativa, no estar obligat o estar exempt de la declaració d'aquest impost.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 15.- JUSTIFICACIÓ DE LES SUBVENCIONS.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. La justificació del compliment de les condicions imposades i de la consecució dels objectius prevists en l'acte de concessió de la subvenció s'ha de documentar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.1. Amb la presentació de la justificació exigida en funció de la modalitat escollida, d'entre les establertes en l'apartat següent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.2. Amb l'acreditació de les mesures de difusió establertes en les bases reguladores o en les bases de la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. La justificació exigida en el punt 1.1 del apartat anterior podrà revestir les modalitats següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.1. Compte justificatiu amb aportació de justificants de despesa, amb aportació d'informe d'auditor o simplificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.2. Acreditació per mòduls.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.3. Presentació d'Estats Comptables&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. Compte justificatiu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3.1. Simplificada: Per a subvencions concedides per import inferior a 60.000 € la modalitat de justificació de les subvencions que amb caràcter general s'estableix, excepte modificació expressa en les bases de la convocatòria, és el de compte justificatiu simplificat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1r. El compte justificatiu simplificat contindrà la següent informació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Una memòria d'actuació justificativa del compliment de les condicions imposades en la concessió de la subvenció, amb indicació de les activitats realitzades i dels resultats obtinguts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Una memòria econòmica, en la qual es reflectirà:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) La relació classificada de les despeses i inversions de l'activitat, amb identificació del creditor i del document, el seu import, desglossant la base imposable i l'impost sobre el valor afegit, data d'emissió i, si escau, data de pagament. En el cas que la subvenció s'atorgui d'acord amb un pressupost estimat s'indicaran les desviacions esdevingudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Un detall d'altres ingressos o subvencions que hagin finançat l'activitat subvencionada, amb indicació de l'import i la procedència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. Si és el cas, carta de pagament de reintegrament en el supòsit de romanents no aplicats així com dels interessos derivats dels mateixos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2n. L'òrgan concedent, a través de les tècniques de mostreig que s'acordin a les bases reguladores, un cop finalitzat el termini de justificació i, si s'escau, el d'esmena de l'art. 71.2, així com els de requeriment establerts en els arts. 31.3.a) i 70.3, tots ells del RGS, ha de comprovar els justificants que estimi oportuns i que permetin obtenir evidència raonable sobre l'adequada aplicació de la subvenció, a la qual cosa podrà requerir la persona o entitat sol·licitant la remissió dels justificants de despesa seleccionats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La mostra escollida haurà de ser representativa almenys del 20% de l'import de la convocatòria i / o del 20% de les persones o entitats sol·licitants de la mateixa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3.2. Amb aportació de justificants de despesa: En el cas que s'exigeixi aquesta modalitat de justificació de la subvenció, les persones o entitats sol·licitants hauran de presentar la documentació exigida en l'art. 72 del RGS, podent substituir la presentació de factures originals i altres documents de valor probatori equivalent en el tràfic mercantil, a què fa referència l'art. 72.2 b) del RGS, per:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Per l'import de la subvenció concedida, fotocòpies compulsades en els originals figuri transcrita la següent diligència, que haurà d'estar transcrita i signada en el cos del document: "La factura ha estat subvencionada per la Ajuntament de sa Pobla".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Per l'import restant, fins a l'import del pressupost que va servir de base per a la concessió de l'ajut o fins a arribar al percentatge de finançament propi, cal acompanyar a més fotocòpies compulsades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3.3. En els supòsits previstos en els apartats 3.1 i 3.2, la relació de despeses i d'ingressos haurà de ser aprovada per l'òrgan competent segons el que disposi la normativa legal o els seus propis Estatuts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3.4. Amb aportació d'informe d'auditor. Sempre que així s'estableixi en les bases reguladores del compte justificatiu pot establir la possibilitat de justificar la subvenció en els termes establerts a l'art. 74 del RGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Mitjançant la presentació d'Estats Comptables. Quan l'objecte de la subvenció consisteixi en un ajut genèric a les despeses de funcionament o d'explotació de les persones o entitats sol·licitants, el compte justificatiu que es pot exigir consistirà en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) La presentació dels Estats Comptables elaborats d'acord amb les normes específiques que els sigui aplicable, aprovades per l'òrgan competent, d'acord amb el que es disposi a la normativa legal o en els seus propis Estatuts, i degudament auditats, de conformitat amb el que disposa l'art. 80 del RGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) En el cas que s'admeti el finançament de despeses financeres, haurà d'acompanyar el seu desglossament, per tal de comprovar la seva adequació als supòsits establerts en l'art. 31.7 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. Acreditació per mòduls. En aquells supòsits en què es compleixin els requisits establerts en l'art. 76.1 del RGS, les bases reguladores podran preveure l'aplicació d'aquest règim en què la justificació de la subvenció es durà a terme mitjançant la presentació de la documentació establerta en l'art. 78 de l'esmentat text reglamentari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 16.- TERMINI DE JUSTIFICACIÓ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Les subvencions concedides, si no es preveu un altre termini, s'han de justificar en el termini de tres mesos des de la finalització del termini previst per a la realització de l'activitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. Per tant, en tot tipus de subvencions haurà de reflectir el termini d'execució de l'activitat. Aquest termini podrà ser a data fixa o data variable, en el cas computarà a partir de la notificació de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. L'Ajuntament podrà concedir, d'ofici la petició als interessats, d'una ampliació dels terminis establerts, sempre que no excedeixi de la meitat dels mateixos i amb això no es perjudiquin drets de tercers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Transcorregut el termini de justificació:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Si la justificació presentada en termini conté defectes esmenables, se li atorgarà un termini de deu dies per a la seva correcció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Si la persona o entitat sol·licitant&lt;/span&gt; &lt;span style="line-height:115%"&gt;no ha complert l'obligació de donar publicitat del finançament públic municipal rebuda, es concedirà un termini de quinze dies per emplenar, de conformitat amb el que disposa l'art. 31.3 del RGS, amb els efectes que preveu l'article 22.a) de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) Si no s'ha presentat la justificació, s'ha de requerir a la persona o entitat sol·licitant perquè la presenti en el termini improrrogable de quinze dies amb els efectes automàtics de l'article 21.a) de la present Ordenança en el requeriment s'haurà de complir el tràmit exigit en l'art. 31.3 del RGS, respecte del compliment per part de la persona o entitat sol·licitant de l'obligació de donar publicitat de la subvenció obtinguda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Si en aquest termini:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- S'aporta la documentació exigida i s'acredita que l'obligació de realitzar les mesures de difusió s'ha complert en el termini inicialment establert, es procedirà a la valoració i avaluació de la documentació aportada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- S'aporta la documentació exigida i s'acredita que l'obligació de realitzar les mesures de difusió s'ha realitzat en el termini del requeriment, s'aplicarà el que disposa l'article 22.a) de la present Ordenança. Si transcorregut aquest termini es mantingués l'incompliment de l'obligació de difusió, la pèrdua del dret al cobrament s'elevaria en el percentatge establert en l'article 22.b).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- Aquestes deduccions seran acumulatives respecte de les assenyalades en l'art. 21.a).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;- Si no es presenta la documentació justificativa es produirà la pèrdua total del dret al cobrament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 17.- PROCEDIMENT DE JUSTIFICACIÓ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Presentada la documentació exigida en l'article 15.1, pel Centre Gestor de la Despesa s'emetrà informe en el qual s'especifiqui que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a. Si el cost d'adquisició de les despeses subvencionables no supera el valor de mercat. Quan no sigui possible aquesta justificació s'ha de motivar en l'expedient les circumstàncies especials que concorren en aquest cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b. Si el compte justificatiu i altres obligacions establertes al beneficiari han estat presentades i documentades en termini.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c. Si la justificació presentada acredita que l'activitat ha estat realitzada en termini, complint-se, per tant, la fi per al qual es va concedir la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. La documentació justificativa, juntament amb l'informe del Centre gestor de la despesa, serà remesa a l'òrgan interventor per a la seva fiscalització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. En aquells supòsits en què el pagament de la subvenció es realitzi prèvia aportació del compte justificatiu en la modalitat d'aportació de justificants de despesa, la comprovació formal per a la liquidació de la subvenció pot comprendre exclusivament els següents documents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) La memòria d'actuació justificativa del compliment de les condicions imposades en la concessió de la subvenció, amb indicació de les activitats realitzades i dels resultats obtinguts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) La memòria econòmica, en la qual es detallarà:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. La relació classificada de les despeses i inversions de l'activitat, amb identificació del creditor i del document, el seu import, data d'emissió i, si escau, data de pagament. En el cas que la subvenció s'atorgui d'acord amb un pressupost, s'indicaran les desviacions esdevingudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;. El detall d'altres ingressos o subvencions que hagin finançat l'activitat subvencionada, amb indicació de la seva procedència i import.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;En aquest supòsit, la revisió de les factures o documents de valor probatori equivalent en el tràfic jurídic mercantil o amb eficàcia administrativa han de ser objecte de comprovació anual plena per l'òrgan interventor sobre la base d'una mostra representativa de les subvencions atorgades mitjançant aquest sistema.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El control financer d'aquestes subvencions es regirà pel que disposa el Títol III, especialment pel que preveu l'art. 51 de la LGS. Els informes que s'emetin en exercici d'aquesta funció, de conformitat amb el que disposa l'art. 219.3 del TRLRHL, es remetran al Ple amb les observacions que haguessin efectuat els òrgans gestors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;4. Si en l'exercici de la funció interventora l'òrgan interventor es manifesta en desacord, s'aplicarà el procediment establert en els arts. 216 i 217 del R.D. Legislatiu 2/2004, de 5 de març, pel qual s'aprova el Text refós de la Llei Reguladora de les Hisendes Locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;5. No obstant el que disposa l'art. 17.1 del RGS, correspon a la Presidència, de conformitat amb el que estableix l'art. 185.2 del TRLRHL, l'aprovació de la justificació de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 18.- PROCEDIMENT DE PAGAMENT I CONTROL FINANCER.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Aprovada la justificació de la subvenció, no podrà realitzar-se el pagament en tant la persona o entitat sol·licitant&lt;/span&gt; &lt;span style="line-height:115%"&gt;no es trobi al corrent en el compliment de les seves obligacions tributàries i davant de la Seguretat Social, sigui deutor per resolució de procedència de reintegrament o altres obligacions amb la Hisenda municipal. L'acreditació d'aquestes obligacions s'ha de fer en els següents termes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) Les persones o entitats sol·licitants&lt;/span&gt; &lt;span style="line-height:115%"&gt;assenyalats en l'art. 24 del RGS, mitjançant declaració responsable atorgada davant una autoritat administrativa o notari públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) Les altres persones o entitats sol·licitants, mitjançant certificació administrativa positiva expedida per l'òrgan competent i el termini de validesa serà de sis mesos a comptar de la data d'expedició.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c) L'acreditació de no ser deutor per resolució de procedència de reintegrament de subvencions s'acreditarà, en tot cas, mitjançant declaració responsable en els termes que estableix l'article 3.4 de la present Ordenança.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d) L'acreditació d'estar al corrent de les obligacions amb la Institució municipal, correspon incorporar-la a la pròpia Administració mitjançant certificació de la Tresoreria municipal expedida a l'efecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. L'òrgan interventor, mitjançant tècniques de mostreig, durant el termini de quatre anys a comptar des del pagament de la subvenció, podrà comprovar l'efectiva aplicació dels fons rebuts&lt;/span&gt;&amp;nbsp; &lt;span style="line-height:115%"&gt;per la persona o entitat beneficiària per la qual cosa podrà realitzar les actuacions contingudes en l'art . 44.4 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 19.- PÈRDUA DEL DRET Al COBRAMENT DE LA SUBVENCIÓ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.Es produirà la pèrdua del dret al cobrament total o parcial de la subvenció, en els següents suposats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a)Incompliment de les obligacions establertes amb motiu de la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b)Incompliment de les obligacions de justificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c)Incompliment de l'obligació d'adoptar mesures de difusió del finançament públic rebut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d)Altres causes establertes en l'art. 37 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.El procediment per a declarar la procedència de la pèrdua del dret al cobrament de la subvenció serà l'establert en l'art. 42 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 20.- INCOMPLIMENT DE LES OBLIGACIONS ESTABLERTES AMB MOTIU DE LA CONCESSIÓ DE LA SUBVENCIÓ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1.&lt;/span&gt; &lt;span style="line-height:115%"&gt;La persona o entitat sol·licitant hauran de complir tots i cadascun dels objectius, activitats i projectes que van fonamentar la concessió de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2.Quan el compliment per la persona o entitat sol·licitant s'aproximi de manera significativa al compliment total i acrediti una actuació inequívocament tendent a la satisfacció dels seus compromisos, la pèrdua al dret al cobrament de la subvenció i, si escau, la quantitat a reintegrar vindrà determinada per l'aplicació dels criteris establerts en les bases reguladores de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3.En el supòsit establert en l'apartat anterior, un dels criteris vindrà determinat pel cost efectiu final de l'activitat, si aquesta resulta inferior a la inicialment prevista. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 21.- INCOMPLIMENT DE LES OBLIGACIONS JUSTIFICACIÓ.-&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a) La manca de presentació de la documentació justificativa, en qualsevol dels terminis inicialment establerts, donarà lloc automàticament a la pèrdua del 20% de la quantia concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b) La manca de compliment de les obligacions de justificació en el termini del requeriment establert en l'art. 70.3 del RGS donarà lloc a la pèrdua total del dret al cobrament de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 22.- INCOMPLIMENT D' ADOPTAR LES MESURES DE DIFUSIÓ DEL FINANÇAMENT PÚBLIC REBUT.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a. L'incompliment de l'obligació de publicitar la subvenció concedida en el termini establert inicialment, donarà lloc a la pèrdua del dret al cobrament de la subvenció en un 5%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b. L'incompliment d'aquesta obligació en el termini del requeriment donarà lloc automàticament a la pèrdua del dret al cobrament de la subvenció d'un 10%. Les bases de la convocatòria poden elevar aquesta quantia fins a un màxim del 20%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 23.- EL REINTEGRAMENT: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Procedeix el reintegrament de la subvenció, de conformitat amb el que disposa l'art. 37.1 de la LGS, en la quantia de les quantitats anticipades i l'exigència de l'interès de demora corresponent des del moment del pagament de la subvenció fins a la data en què s'acordi la procedència de la pèrdua, parcial o total, del dret al cobrament de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 24.- INFRACCIONS I SANCIONS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;El règim d'infraccions i sancions serà l'establert en el Títol IV de la LGS, i és competent per a la seva imposició la Presidència&lt;/span&gt; &lt;span style="line-height:115%"&gt;de la Corporació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;Disposició transitòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;1. Els procediments iniciats amb anterioritat a l'entrada en vigor d'aquesta Ordenança es regiran per la normativa que en el seu moment li era d'aplicació. Es considera que un procediment s'ha iniciat quan s'hagin aprovat les bases de la convocatòria, en el règim de concurrència competitiva, o s'hagi formalitzat el corresponent conveni o concedida mitjançant resolució administrativa la subvenció directa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;2. En tot cas, tindrà caràcter retroactiu quan la seva aplicació sigui favorable per als interessats i sempre que no es perjudiquin drets de tercers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:#00000a; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Disposició final.&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;La present ordenança general, una vegada aprovada definitivament pel Ple de la Corporació, d'acord amb el procediment establert en l'art. 49 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local, entrarà en vigor una vegada s'hagi publicat íntegrament el seu text en el Butlletí Oficial de les Illes Balears i hagi transcorregut el termini previst en l'art. 65.2, en relació amb 70.2, ambdós de la Llei de Bases del Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Les subvencions directes no nominatives i en concurrència competitiva iguals o inferiors a 6.000 € s'aprovaran per Decret de la Presidència. En les de més de 6.000 € l'aprovació correspondrà a la Junta de Govern, previ dictamen de la Comissió Informativa i de Seguiment corresponent quan s'exerceixin competències delegades del Ple.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;3. SUBVENCIONS&amp;gt; 12.000 € i &amp;lt;60.000 €:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;a. Substitució del certificat per la declaració només en la concessió, no en el pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b. No hi ha possibilitat de bestreta sense garantia prèvia, llevat de les subvencions de caràcter plurianual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;c. Compte justificatiu simplificat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;d. Finalitzats els terminis de justificació i, si escau, d'esmena i requeriment l'òrgan concedent seleccionarà una mostra a la qual s'exigirà l'aportació de justificants de despesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;e. Fiscalització prèvia plena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;f. Publicitat en el BOP dins dels trenta dies naturals següents al trimestre natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;g. Subvencions directes requereixen subscripció de Conveni.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;h. Llevat de les subvencions nominatives, correspon la seva aprovació a la Junta de Govern, previ dictamen de la Comissió Informativa i de Seguiment corresponent quan s'exerceixin competències delegades del Ple.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Substitució del certificat per la declaració tant en la concessió com en el pagament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="line-height:115%"&gt;b. Hi cap la possibilitat de bestreta fins al 75% sense garantia prèvia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Règim de justificació i control financer en funció de la quantia i de la modalitat justificativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
