&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El 4 de setembre de 2018 es va publicar en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; la Resolució de la consellera de Cultura, Participació i Esports de 27 d’agost de 2018 per la qual es convoquen ajuts destinats als mitjans de comunicació audiovisuals que emeten en llengua catalana a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. El 12 de novembre de 2018 la Comissió d’Avaluació va aprovar la llista definitiva d’admesos i exclosos, que es va fer pública el mateix dia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. El 14 de novembre de 2018 la Comissió d’Avaluació es va reunir per valorar la documentació aportada pels sol·licitants i calcular l’import que havia de rebre cada beneficiari. La Comissió d’Avaluació va elaborar l’informe previst en l’apartat 11.1 de la Resolució de convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. El dia 15 de novembre de 2018 la directora general de Política Lingüística, basant-se en l’informe de la Comissió d’Avaluació, va emetre la proposta de resolució per adjudicar els ajuts destinats als mitjans de comunicació audiovisuals que emeten en llengua catalana a les Illes Balears. Aquesta proposta de resolució es va publicar el mateix dia a la pàgina web de la Direcció General de Política Lingüística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Mitjançant la Resolució de la consellera de Cultura, Participació i Esports de 20 de novembre de 2018 (BOIB núm. 147, de 24 de novembre) es concedien els ajuts destinats als mitjans de comunicació audiovisuals que emeten en llengua catalana a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6. Aquesta Resolució concedia les subvencions següents, i autoritzava i disposava la despesa amb càrrec a la partida pressupostària que es detalla en cada cas dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’any 2018:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;7. Aquesta Resolució contenia tres ajuts per import igual o superior a 30.000,00 € que s’havien concedit sense haver sol·licitat l’informe preceptiu previ de la Intervenció. Quan es va detectar l’errada, es van trametre aquests expedients a la Intervenció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;8. El dia 19 de desembre de 2018 la interventora delegada va emetre tres informes, que no tenien caràcter de fiscalització prèvia, en els quals manifestava que, en el cas d’haver-se tramitat els expedients en el moment procedimental oportú, la Intervenció els hauria fiscalitzat de disconformitat, i posava de manifest diverses objeccions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;9. Respecte a la subvenció concedida a Canal 4 Televisión de Baleares, SLU, amb NIF B07941255, per un import de 160.000,00 €, per les emissores Canal 4 Ràdio, Canal 4 Televisió i Ràdio Murta, la Intervenció va detectar dos errors: d’una banda, s’havia tractat com una única subvenció el que en realitat eren tres subvencions diferents; de l’altra, no s’havia aplicat correctament el límit previst en la convocatòria segons el qual l’import màxim que pot rebre cada beneficiari per la línia de ràdios és de 30.000,00 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;A més, la interventora delegada posava de manifest en els seus informes diverses objeccions en relació amb la informació que contenia la Resolució de concessió, que resultava insuficient.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;10. El dia 15 de març de 2019 la Comissió d’Avaluació es va reunir per revisar, sobre la base dels tres informes emesos per la interventora delegada, la tramitació de les subvencions concedides. La Comissió d’Avaluació va aprovar un informe relatiu a les subvencions concedides en el marc de la convocatòria d’ajuts destinats als mitjans de comunicació audiovisuals que emeten en llengua catalana a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;11. Les subvencions concedides a Menorca de Comunicación, SL, amb NIF B07797145, per les emissions de Ràdio Menorca SER, per un import de 20.088,03 €, i a Associació Cultural Audiovisual de Formentera, amb NIF G57574675, per les emissions de Ràdio Illa, per un import de 13.050,43 €, que no requerien de fiscalització prèvia, ja han estat abonades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;12. Les subvencions concedides a Associació Ona Mediterrània, Canal 4 Televisión de Baleares, SLU, i Organisme autònom municipal Alcúdia Ràdio no han estat abonades, i el pagament s’haurà de fer, si és el cas, una vegada esmenades les deficiències detectades, amb càrrec als pressuposts de la Comunitat Autònoma de les Illes Balears per a l’any 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;13. Hi ha crèdit adequat i suficient a les partides pressupostàries 26401 455B01 46001 10, 26401 455B01 47000 00 i 26401 455B01 48000 00 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’any 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;14. En data 2 d’abril de 2019 la directora general de Política Lingüística va emetre la proposta de resolució de rectificació de la Resolució de la consellera de Cultura, Participació i Esports de 20 de novembre de 2018 per la qual es concedeixen ajuts destinats als mitjans de comunicació audiovisuals que emeten en llengua catalana a les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;15. En data 24 de maig de 2019 el Consell de Govern ha convalidat &lt;span style="color:#000000"&gt;l’omissió del tràmit de fiscalització prèvia en els expedients de concessió de subvencions de Canal 4 Televisión de Baleares, SLU, de la línia de televisió, i d’Associació Ona Mediterrània i Organisme autònom municipal Alcúdia Ràdio, de la línia de ràdios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera de Cultura, Participació i Esports, en el termini d’un mes comptador des de l’endemà de la publicació en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 123 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà de la publicació de la Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb el que estableix l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
