    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punt 3 de l’apartat Vuitè de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 25 de gener de 2018, per la qual es convoquen ajudes destinades al pagament compensatori en zones de muntanya per a l'any 2018, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears, i es farà d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresident, en data 10 d’abril de 2019, va signar la següent resolució:&lt;/span&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“PROPOSTA DE RESOLUCIÓ / RESOLUCIÓ DE DENEGACIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Antecedents&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data de 30 de gener de 2018 es va publicar, en el BOIB núm. 14, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s’aprova la convocatòria per a l’any 2018 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 30/04/2018, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;les Illes Balears un total de 258 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. Una vegada avaluades les sol·licituds d’ajuda pels òrgans gestors, i d'acord amb els criteris d’elegibilitat establerts, l’interessat indicat a l’Annex I adjunt no compleix amb algun dels requisits previst a l’apartat Tercer de la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. En data 25 de febrer de 2019 es notifica, mitjançant publicació a la pàgina web &lt;span style="color:null"&gt;http://www.caib.es&lt;/span&gt;, l’informe desfavorable i la proposta provisional de denegació de l’ajuda, emesa pel Servei d’Ajudes al Desenvolupament Rural als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Dins el termini establert, els interessats indicats a l'Annex I adjunt no han presentat al·legacions, o han presentat al·legacions que es desestimen.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. Reglament d’execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s’estableixen disposicions d’aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l’ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. Reglament d’execució (UE) núm. 809/2014 de la Comissió, de 17 de juliol de 2014, pel qual s’estableixen disposicions d’aplicació del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control, les mesures de desenvolupament rural i la condicionalitat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Reial decret 1075/2014, de 19 de desembre, sobre l’aplicació a partir del 2015 dels pagaments directes a l’agricultura i a la ramaderia i altres règims d’ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Reial decret 1078/2014, de 19 de desembre, pel qual s’estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. Reial decret 887/2006, de 21 de juliol, pel qual s’aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre del conseller d’Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;15. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB núm. 082 de 2007&lt;/em&gt;&lt;/span&gt;&lt;em&gt;; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16. Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de denegació&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s’informa desfavorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar les sol·licituds presentades pels interessats indicats a l'Annex I, per incompliment dels requisits que s'indiquen a l'esmentat annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar conclòs el procediment i procedir a l’arxiu dels expedients detallats a l’Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Notificar la resolució als interessats de l'Annex I .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Motius:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Incompliment del punt 1.b de l’apartat Tercer de la Resolució del President del FOGAIBA per la qual s’aprova la convocatòria per a l’any 2018 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears, que referent als requisits específics dels beneficiaris estableix «que tinguin la consideració d’agricultors no pluriactius».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Incompliment del punt 1 de l’apartat Tercer de la Resolució del President del FOGAIBA per la qual s’aprova la convocatòria per a l’any 2018 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears, que referent als requisits específics dels beneficiaris estableix «poden ser beneficiaris de les ajudes que preveu aquesta convocatòria les persones físiques o jurídiques...»&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Una C.B. és una entitat sense personalitat jurídica pròpia.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En el moment de presentar la sol·licitud única per a la campanya 2018 no complia tots els requisits. La constitució de la societat es va realitzar el dia 20/12/2017, i l’alta censal el 21/12/2017, i no s’ha acreditat que durant l’exercici 2017 la societat &amp;nbsp;generàs ingressos agraris. Així mateix, tractant-se d’una S.C., tots els socis han de complir el requisit de ser agricultors no pluriactius, i aquest només s’ha demostrat per un dels socis.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Una vegada revisat el resum anual d’IVA (model 390) l’Impost de Societats (model 200) el certificat d’ingressos i la relació de factures corresponents a l’exercici 2016, es comprova que el sol·licitant no compleix amb el requisit de ser no pluriactiu. Després de notificar la proposta de denegació provisional, el sol·licitant aporta el resum anual d’IVA de l’exercici 2017, on declara com a activitat principal «Servicios Agrícolas y Ganaderos» Clave 1, Epígrafe IAE 911. Aporta les factures emeses durant l’exercici 2017, però no el certificat emès per l’administrador de l’entitat que indiqui quins són els ingressos agraris de l’entitat que corresponen a l’exercici 2017, ni tampoc aporta l’Impost de Societats de l’exercici 2017. Per tot això no queda acreditada la condició del sol·licitant de ser no pluriactiu&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;”.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
