    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;De conformitat amb el que disposa l'article 169 del text refós de la Llei Reguladora de les Hisendes Locals aprovada pel Reial Decret Legislatiu 2/2004 de 5 de març, així com l'article 112 d el a Llei 7/1985, d e2 d'abril, Reguladora de les bases de règim local, no havent-se presentat reclamacions a l'aprovació de la modificació de l'expedient d'aprovació del Pressupost del Consell Insular d'Eivissa, per a la inclusió del Pla d'actuació de FECOEV, SAU 2019, queda definitivament aprovada i es procedeix a la publicació del esmentat Pla:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PLA D'ACTUACIONS DE FECOEV 2019&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Fires, Congressos i Esdeveniments Eivissa, S.A.U. és una societat mercantil de capital públic del Consell Insular d'Eivissa, que adopta la forma de societat anònima i que va ser constituïda per part del Consell Insular d'Eivissa i Formentera a Eivissa el dia 30 de juny de 1997 (inicialment denominada Fires i Congressos de Eivissa i Formentera, SA).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tal com consta en els seus propis estatuts (art. 2.2.c)), Fires, Congressos i Esdeveniments Eivissa, S.A.U. (FECOEV SAU) ostenta, en concepte de cessió per part del Consell Insular d'Eivissa, l'ús, la gestió, l'explotació i l'administració de les instal·lacions i els béns del recinte denominat Recinte Firal d'Eivissa i del Hipòdrom de Sant Rafel , així com d'altres que per acord del Ple del Consell Insular d'Eivissa es puguin adscriure a la societat en alguna de les formes de gestió directa o indirecta previstes a la normativa. És per l'exposat que FECOEV, S.A.U. disposa de capacitat per a la contractació de les activitats que es puguin realitzar en les mateixes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En el sentit que s'exposa en els referits estatuts (art. 2.2.a)), Fires, Congressos i Esdeveniments Eivissa, S.A.U. (FECOEV S.A.U.) té per objecte social, al seu torn, la promoció econòmica, social i cultural de les illes d'Eivissa i Formentera a través de l'organització, execució o la contractació de fires, congressos, exposicions, manifestacions i espectacles culturals. És per això, que al llarg de l'any es duen a terme diferents esdeveniments públics i privats, de tota índole, en les esmentades instal·lacions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Així mateix, FECOEV, S.A.U. també organitza i coordina tot tipus d'esdeveniments en altres instal·lacions, així com en espais a l'exterior:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tal com es recull en els estatuts de l'entitat (art.1.bis.1), la societat tendrà la condició de mitjà propi del Consell Insular d'Eivissa sempre que es compleixin els requisits legals per això. Al llarg de l'any, el Consell Insular d'Eivissa, en funció de la seva capacitat organitzativa i per tal d'optimitzar els seus recursos propis, encarrega a FECOEV, SAU, com a mitjà propi, totes aquelles accions que sent de la seva competència no té recursos suficients per dur-les a terme.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;D'altra banda, FECOEV, S.A.U. ostenta competències en matèria de Promoció Turística, tal com es detalla en els corresponents estatuts (art. 2.3). És per això que, tenint en compte que el Consell Insular d'Eivissa té plenes competències en matèria de Promoció Turística mitjançant Decret 45/2015, de data 22 de maig i que en data 21 d'abril de 2018, mitjançant el Decret 7/2018 , de 23 de març, s'han revisat aquestes competències atribuïdes al Consell d'Eivissa amb la consegüent ampliació i adaptació dels serveis inherents a aquesta competència, produint-se una millora de la dotació econòmica prevista per desenvolupar-la, el Consell Insular d'Eivissa, en funció de la seva capacitat organitzativa i per tal d'optimitzar els seus recursos propis, va aprovar per acord de ple de data 27 de juny de 2017, que l'entitat Fires, Congressos i Esdeveniments Eivissa, SAO (FECOEV, SAU), entitat dependent del mateix Consell Insular d'Eivissa, pogués gestionar de forma directa les tasques pròpies que li van ser encomanades en material de promoció mitjançant el Decret 45/2015 i que han estat revisades pel Decret 7/2018, de 23 de març.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;El Consell Insular d'Eivissa, al seu torn, gestiona de manera directa a través del seu mercantil Fires, Congressos i Esdeveniments d'Eivissa, S.A.U. (FECOEV, SAU), l'organització i participació en esdeveniments de promoció de la moda Adlib i de l'artesania en general que es duguin a terme, tot això d'acord amb la competència que va ser atorgada a la Corporació per la Llei 8/1999, de 12 d'abril, d'atribució de competències als Consells Insulars de Menorca i d'Eivissa i Formentera en matèria d'Agricultura, Ramaderia, Pesca i Artesania i amb el disposat pel ple del Consell Insular d'Eivissa, en sessió ordinària de 16 de abril de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per executar aquestes actuacions en l'exercici 2019, cal comptar amb mitjans i recursos procedents del Consell Insular d'Eivissa, de manera que en el pressupost anual d'aquesta administració per a l'exercici exposat es preveuen partides a favor de l'entitat FECOEV, SAU, per un import de 3.880.500,00 €, partides que hauran de ser transferides íntegrament per al desenvolupament de les accions que es detallaran en el pla d'actuacions, que s'ha d'incloure com a annex al pressupost general del Consell Insular d'Eivissa, tal com preveu l'article 166.1.b) del Reial Decret Legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei Reguladora de les Hisendes Locals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per al desenvolupament de les accions previstes es complirà amb el que disposa la Llei 9/2017, de 8 de novembre, de Contractes del Sector Públic, per la qual es transposen a l'ordenament jurídic espanyol les Directives del Parlament Europeu i del Consell 2014/23 / UE i 2014/24 / UE, de 26 de febrer de al 2014.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;PRESSUPOST&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Partida d'ingressos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Com es pot observar, els principals ingressos que rebrà FECOEV, S.A.U. per al desenvolupament de les accions que es detallaran en els corresponents annexos tenen relació amb:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1.- La gestió directa en matèria de Moda Artesana Adlib i Artesania en general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2.- La gestió directa en matèria de Promoció turística.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3.- La Gestió del recinte Firal d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4.- La Gestió de l'Hipòdrom de Sant Rafel.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;5.- Altres serveis prestats al Consell Insular d'Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6.- Altres activitats que es duen a terme a les instal·lacions i altres en virtut de l'objecte social de Fecoev, S.A.U.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Així mateix, constatar que al llarg de l'exercici 2019 poden venir altres aportacions del Consell Insular d'Eivissa a través d'encàrrecs de gestió en accions dels diferents departaments que el Consell Insular d'Eivissa consideri necessari dur a terme durant el dit exercici, i que no formen part del present pla d'actuació al no haver estat encara encomanades i, per tant, no tenir FECOEV, S.A.U. de suficients dades objectives per a la seva inclusió en el mateix, i que, si s'escau hauran d'augmentar el pressupost, en el cas que definitivament es vagin succeint amb posterioritat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;**Aquesta partida es fixa en funció dels ingressos que es produeixen i en compensació de les pèrdues que aquesta activitat genera a l'empresa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Partida de despeses:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En aquesta partida s'inclouen totes les despeses corrents que es generen tant per les accions que provenen de la gestió directa de competències del Consell Insular d'Eivissa com per la pròpia activitat de FECOEV, S.A.U. en relació a tercers.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Així mateix, inclou també les despeses de personal adscrit a FECOEV, S.A.U. per al desenvolupament de la seva activitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En virtut de tot això, es detallen, assenyalades com a annexos IV, les actuacions previstes a dia d'avui per a l'exercici 2019 a desenvolupar per part de FECOEV, SAU, tant en l'execució de la gestió directa procedent de PROMOCIÓ TURÍSTICA i de ARTESANIA del Consell Insular d'Eivissa, com en la gestió habitual del recinte firal i l'hipòdrom, sense perjudici del que detallat a l'apartat "partida d'ingressos" pel que fa als que encara no han estat encarregats a FECOEV, SAU i puguin succeir-se en 2019, amb la seva consegüent necessitat d'ampliació del pressupost corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
