    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La Llei 14/2006, de 17 d’octubre, de l’esport de les Illes Balears, en l’article 100, crea la Comissió contra la Violència a l'Esport de les Illes Balears com a òrgan al qual li correspon prevenir qualsevol tipus d'acció o manifestació de violència, racisme o xenofòbia, o que la pugui generar, com a conseqüència d'activitats o competicions esportives en l'àmbit territorial de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Decret 12/2019, de 28 de febrer, pel qual es regula la Comissió contra la Violència a l'Esport de les Illes Balears, estableix en l’article 6 la composici´ó dels seus membres, i la lletra &lt;em&gt;c&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; disposa que els vocals han de ser nomenats pel conseller o consellera de Cultura, Participació i Esports, i que en els casos de vacant, absència o malaltia, els vocals titulars són substituïts pels suplents corresponents que hagin estat nomenats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Així mateix, la lletra &lt;em&gt;d &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;de l’esmentat precepte determina que el secretari, amb veu i vot, l’ha de designar, d'entre els vocals, el president&lt;span style="color:#000000"&gt; &lt;/span&gt;de la Comissió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Atès que s’ha de constituir l’esmentada Comissió, és convenient &lt;/span&gt;dur a terme el nomenament dels membres que hi han de formar part.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la consellera de Cultura, Participació i Esports en el termini d’un mes comptador des de l’endemà d’haver-se publicat en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l’endemà d’haver-se publicat en el&lt;em&gt; Butlletí Oficial de les Illes Balears&lt;/em&gt;, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
