font-size:12px"><span style="line-height:120%">&nbsp;<span style="color:#212121">L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) <span style="background-color:#ffffff">de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries,</span>&nbsp;</span><span style="color:#212121">corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí</span><span style="color:#212121">&nbsp;</span><span style="color:#212121"><em>Oficial de les Illes Balears</em>&nbsp;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></span></span></p> <p style="margin-bottom:0.25cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%"><span style="color:#212121">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. </span></span></span></p> <p style="margin-bottom:0.25cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Antecedents</span></strong></p> <ol class="decimal"> <li> <p style="margin-bottom:0.1cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018.</span></span></p> </li> <li> <p style="margin-bottom:0.1cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 31 de desembre de 2016. </span></span></p> </li> <li> <p style="margin-bottom:0.1cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.</span></span></p> </li> <li> <p style="margin-bottom:0.15cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Les persones interessades assenyalades a l'<strong>a</strong><strong>nnex I</strong> adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i s’ha comprovat que compleixen amb els requisits exigits per a poder ser beneficiaris d'aquesta ajuda.</span></span></p> </li> <li> <p style="margin-bottom:0.15cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">En data de 29 de octubre de 2018 es va publicar al <span style="color:#000000">web </span><span style="color:#0000ff"><span style="color:#000000"><em>http://www.caib.es</em></span></span><span style="color:#0000ff"><span style="color:#000000"> </span></span><span style="color:#000000">u</span><span style="color:#000000">na proposta provisional de </span><span style="color:#000000">concessió</span><span style="color:#000000"> de l'ajuda sol·licitada. </span></span></span></p> </li> <li> <p style="margin-bottom:0.1cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Durant el termini establert a la proposta provisional de concessió parcial els interessats corresponents als expedients INEA2016_2</span><span style="color:#000000">/0</span><span style="color:#000000">44 </span><span style="color:#000000">i INEA2016_</span><span style="color:#000000">2</span><span style="color:#000000">/13</span><span style="color:#000000">1</span><span style="color:#000000"> han presentat al·legacions dins el termini corresponent, </span><span style="color:#000000">mentre que la resta d'expedients assenyalats a </span><span style="color:#000000"><strong>l'annex I</strong> no n'han presentat.</span></span></span></p> </li> <li> <p style="margin-bottom:0.25cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="margin-bottom:0.1cm"><span style="line-height:100%">Una vegada avaluades les al·legacions presentades , i d'acord amb els criteris d’elegibilitat de la convocatòria, a les persones interessades els correspon una ajuda màxima detallada a l’annex I, després d’aplicar la deducció d’inversions i/o actuacions que no són elegibles per aquesta línia d'ajudes descrita a l'annex II</span></span></span></p> </li> </ol> <p><strong><span style="font-family:Times New Roman,Times,serif; text-align:left"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:120%">Per tot això, s'informa favorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:</span></span></p> <ol class="decimal"> <li> <p style="margin-bottom:0.15cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">Concedir l’ajuda sol·licitada a les persones beneficiàries pels imports i amb els terminis detallats a l'<strong>annex I</strong>, que són un total de 6 expedients i que comença amb GABRIEL DARDER PERICAS<span style="color:#000000"> </span>i acaba <span style="color:#000000">amb</span><span style="color:#000000"> </span><span style="color:#000000">XAMPINYONS MALLORQUINS SA</span><span style="color:#000000"> </span>que suma un import total de 500.810,14<span style="display:inline-block"> </span>euros, relativa a la línia d’ajuda “Inversions a les explotacions agràries”,deduïdes les inversions/actuacions no elegibles especificades a l’<strong>annex II</strong></span></span></p> </li> <li> <p style="margin-bottom:0.15cm"><span style="font-family:Times New Roman,Times,serif;
