Tots aquests ingressos s’instrumenten, bé mitjançant la subscripció d'un conveni, bé mitjançant la tramitació d'una sol·licitud de subvenció, i es refereixen a matèries que són gestionades per l’Institut Mallorquí d'Afers Socials (IMAS).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">III. Això, sense perjudici que s’instrumentin els mecanismes corresponents per tal que els ingressos es facin efectius en favor del Consell de Mallorca i que la Intervenció General del Consell de Mallorca exerceixi el control d’aquests ingressos, per després transferir-los a l’IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">IV. La Intervenció Delegada de l’IMAS ha emès l’informe favorable per a aquest expedient.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#000000"><strong>Consideracions jurídiques: </strong></span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">I. D’acord amb l’article 17 c) dels Estatuts de l’Institut Mallorquí d'Afers Socials, <span style="color:#000000"> </span><span style="color:#000000">aprovats per </span><span style="color:#000000">per acord </span><span style="color:#000000">del Ple de Consell de Mallorca </span><span style="color:#000000">de dia 13 d'octubre de 2016 (BOIB núm. 140 de 5 de novembre de 2016)</span><span style="color:#000000">, </span>són recursos econòmics seus les subvencions i aportacions de la Unió Europea, l’Estat, la comunitat autònoma de les Illes Balears i altres entitats públiques, o de particulars, que siguin transferits al Consell de Mallorca per a fins propis de l’IMAS.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">II. D’acord amb l’art. 2.3 dels seus Estatuts, l’IMAS exerceix qualsevol altra competència que li encomani el Consell, directament mitjançant delegació o encomana o, indirectament, a través de convenis amb altres ens territorials o institucionals amb finalitats coincidents.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">III. D’acord amb el Decret d’organització del Consell de Mallorca</span><span style="color:#000000"> de 1</span><span style="color:#000000">0</span><span style="color:#000000"> de juliol de 201</span><span style="color:#000000">5 </span><span style="color:#000000">(BOIB núm. 1</span><span style="color:#000000">09</span><span style="color:#000000"> de </span><span style="color:#000000">18</span><span style="color:#000000"> d</span><span style="color:#000000">e juliol</span><span style="color:#000000"> de 201</span><span style="color:#000000">5</span><span style="color:#000000">)</span><span style="color:#000000"> dictat pe</span><span style="color:#000000">l </span>president del Consell de Mallorca, correspon al Consell Executiu, entre d’altres, aprovar els convenis amb altres entitats públiques o privades. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La base 23.4 de les Bases d’Execució del Pressupost del Consell de Mallorca de 2019 estableix que correspon al Consell Executiu aprovar convenis independentment de la seva quantia. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">IV. L’art. 11 de la Llei 40/2015, d'1 d'octubre, de règim jurídic del sector públic preveu que la realització d’activitats de caràcter material, tècnic o de serveis de la competència dels òrgans administratius o de les entitats de dret públic pot ser encarregada a altres òrgans o entitats de la mateixa administració o d’una altra de diferent, per raons d’eficàcia. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">V. Així mateix, l’article 12 del mateix text legal preveu que els titulars dels òrgans administratius poden, en una matèria de la seva pròpia competència, delegar la signatura de les seves resolucions i actes administratius als titulars dels òrgans o les unitats administratives que en depenen, dins dels límits assenyalats per l’article 11. La delegació de signatura no altera la competència de l’òrgan delegant, i no en cal la publicació perquè sigui vàlida. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Es proposa al Consell Executiu que adopti l’acord següent:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
