    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que el Consell Insular de Menorca ha d’aprovar i publicar anualment la seva oferta pública d’ocupació, d’acord amb el que estableixen els articles 91.1 de l'LBRL i l’article 128 del TRRL, seguint els criteris fitxats en la normativa bàsica estatal;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que cada any les lleis de pressupost de l’Estat fixen, en l'exercici de la seva competència atorgada pels articles 149.1.13 i 156.1 de la Constitució, els criteris d’aplicació obligatòria per part de les administracions públiques a l’hora d’aprovar la seva oferta pública;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que dia 4 de juliol de 2018, amb la publicació al BOE núm. 161, s'ha aprovat la Llei 6/2018 de pressuposts generals de l'Estat;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que l'article 19 estableix les normes en relació a l'oferta pública d'ocupació o altres instruments de gestió de la provisió de necessitats de personal;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que l'apartat U.3 estableix la taxa de reposició del 100 % per a alguns sectors considerats essencials, entre els quals es troben alguns que afecten directament els serveis del Consell Insular de Menorca:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- F) Assessorament jurídic i gestió dels recursos públics;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- H) Prevenció i extinció d'incendis;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- O) Places de personal que presta assistència directa als usuaris dels serveis socials;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- P) Places de personal que realitza la gestió de prestacions i polítiques actives en matèria d'ocupació;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- S) Personal d'atenció als ciutadans en els serveis públics;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que per a la resta de places la taxa de reposició és del 75 %, per a les administracions que no compleixin els objectius d'estabilitat pressupostària i deute públic i la regla de despesa;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que la taxa de reposició es computarà a partir de la finalització de la prestació de serveis per jubilació, mort, renúncia, declaració d'excedència sense reserva de lloc de feina, pèrdua de la condició de funcionari de carrera o extinció del contracte de treball, i finalment les altes i baixes produïdes per concursos de trasllat a altres administracions publiques;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que aquesta taxa de reposició es podrà acumular en altres sectors dels que preveu aquest precepte;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que l'apartat U.9 del mateix article es destina a la taxa addicional d'estabilització, i pel que fa al Consell Insular de Menorca inclourà les places de naturalesa estructural que, estant dotades pressupostàriament, hagin estat ocupades de forma temporal i ininterrompudament com a mínim els tres anys anteriors a 31 de desembre de 2017 en els sectors i col·lectius següents: personal dels serveis d'administració i serveis generals, així com altres serveis públics;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès l’informe que ha emès la cap del Servei de Gestió de Persones dia 15 de novembre de 2018;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atès que la Mesa General de Negociació, dia 29 de novembre de 2018, va acordar d'aprovar l’Oferta Pública d’Ocupació de 2018 del Consell Insular de Menorca;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Atesa la proposta de la consellera executiva del Departament de Serveis Generals, Participació Ciutadana i Habitatge, s’adopta l’acord següent;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;ACORD:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aprovar l’Oferta Pública d’Ocupació de 2018 del Consell Insular de Menorca que s’adjunta com a document annex, sens perjudici que, si es produeixen modificacions en la Relació de llocs de treball del Consell Insular de Menorca que provoquin canvis en plantilla en les places incloses en aquesta oferta, no s'executaran les places afectades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra aquest acord, que no posa fi a la via administrativa, es pot interposar recurs d’alçada en el termini d’un mes a partir de l’endemà d’haver-se publicat en el BOIB. El recurs es pot interposar formalment davant el mateix Consell Executiu o davant la Comissió de Govern, que és l’òrgan competent per resoldre’l.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació expressa d’aquest recurs d’alçada es pot interposar un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui en el termini de dos mesos comptadors a partir de l’endemà de rebre la notificació de la desestimació d’aquest recurs d’alçada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Si han transcorregut tres mesos des de la interposició del recurs d’alçada i no s’ha rebut la notificació expressa, s’entén desestimat per silenci i es pot interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, sense limitació de temps.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:6pt; margin-left:0cm; margin-right:0cm; margin-top:6pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No obstant això, si escau, es pot interposar qualsevol altre recurs que consideri oportú. Tot això, de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
