font-size:12px"><span style="line-height:normal">El 17 de desembre de 2018 el Patronat de la <span style="color:black">Fundació per als Estudis Superiors de Música i Arts Escèniques de les Illes Balears (FESMAE-IB) </span>va adoptar els acords pels quals s’aproven els nous preus de les publicacions i del lloguer de les instal·lacions, les sales d’estudi i els instruments del Conservatori Superior de Música de les Illes Balears i, en general, de tots els serveis no acadèmics.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">La FESMAE-IB és el resultat de la fusió de la Fundació per a l’Escola Superior d’Art Dramàtic de les Illes Balears (ESADIB) i la Fundació per al Conservatori Superior de Música i Dansa de les Illes Balears, autoritzada per un acord del Consell de Govern de les Illes Balears de dia 17 de març de 2017. </span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Segons l’article 10 dels Estatuts de la Fundació, el control de les activitats que duu a terme depèn de la conselleria competent en matèria d’educació, actualment la Conselleria d’Educació i Universitat, a la qual, a més, corresponen les funcions de protectorat de la Fundació previstes en la disposició addicional primera del Decret 61/2007, de 18 de maig, de regulació del Registre Únic de Fundacions de la Comunitat Autònoma de les Illes Balears i d’organització de l’exercici del protectorat, i en l’article 35 de la Llei 50/2002, de 26 de desembre, de fundacions, de conformitat amb l’article únic del Decret 26/2015, de 4 de setembre, de la presidenta de les Illes Balears, pel qual es confereix a les conselleries l’exercici del protectorat de les fundacions en l’àmbit de les Illes Balears.</span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">La <span style="color:black">FESMAE-IB </span>va presentar a la Conselleria d’Educació i Universitat una sol·licitud d’autorització dels nous preus per al lloguer de les instal·lacions, les sales d’estudi i els instruments i, en general, per als serveis no acadèmics del Conservatori Superior de Música de les Illes Balears.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Ordenar la publicació d’aquesta Resolució en el <em>Butlletí Oficial de les Illes Balears</em> a l’efecte de fer públics els preus i les condicions de les publicacions i dels serveis no acadèmics del Conservatori Superior de Música de les Illes Balears, que es detallen en l’annex de la Resolució.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Tercer</strong></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Deixar sense efecte, des de l’endemà de la publicació d’aquesta Resolució, la Resolució de la consellera d’Educació, Cultura i Universitats de 7 d’octubre de 2013 per la qual s’autoritzen els preus dels serveis acadèmics i no acadèmics de la Fundació per al Conservatori Superior de Música i Dansa de les Illes Balears per al curs 2013-2014, i es publica el text refós de tots els preus dels serveis acadèmics i no acadèmics del Conservatori (BOIB núm. 153, de 7 de novembre), que fins ara fixava els preus per als serveis no acadèmics del Conservatori Superior de Música de les Illes Balears.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Interposició de recursos</strong></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">D’acord amb l’article 57.1 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears, els articles 123 i 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques, i l’article 43.1 de la Llei 50/2002, de 26 de desembre, de fundacions, contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d’Educació i Universitat en el termini d’un mes comptador des de l’endemà d’haver-se publicat.</span></span></p> <p style="margin-bottom:8pt; Es consideren horari ordinari les hores dins l’horari d’obertura ordinari del Conservatori i mentre no se sobrepassi una jornada de 7,5 hores.</span></span></p> <p style="margin-bottom:0.0001pt"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Es considera horari extraordinari qualsevol hora que sobrepassi una jornada de 7,5 hores, o qualsevol fora de l’horari d’obertura ordinari del Conservatori.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Tant els costos ordinaris com els extraordinaris reflecteixen la compensació d’unes despeses de caràcter fix i d’unes altres de caràcter variable.</span></span></p> <p style="margin-bottom:8pt; Drets d’autor</span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Totes les despeses que, per dur a terme l’activitat, es generin en concepte de pagament de tarifes de la Societat General d’Autors i Editors (SGAE) o d’altres entitats de gestió de drets d’autor són sempre, sense excepcions, a càrrec dels organitzadors de l’activitat, per la qual cosa la Fundació pot exigir als organitzadors o sol·licitants de l’ús i lloguer dels espais que presentin un document de conformitat de l’SGAE o d’altres entitats de gestió de drets d’autor, amb referència a l’activitat. </span></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. Convenis de col·laboració i bonificacions</span></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3.1. Convenis de col·laboració relatius als preus no acadèmics prevists en l’apartat 2</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>a)</em>&nbsp;&nbsp;La Fundació pot establir convenis amb altres entitats sense ànim de lucre que promoguin la música i la cultura. Els convenis han de ser aprovats <span style="color:black">pel Patronat i signats pel president del Patronat a</span> proposta, si és el cas, del gerent de la Fundació, d’acord amb els articles 20.<em>m</em> i 23.1.<em>h</em> dels Estatuts de la Fundació, publicats en el BOIB núm. 33, de 18 de març de 2017.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>b)&nbsp;&nbsp;</em>També es poden establir convenis amb empreses amb ànim de lucre sempre que hi hagi una contraprestació acadèmica a favor dels alumnes del Conservatori Superior o del Conservatori Professional. Els convenis han de ser aprovats <span style="color:black">pel Patronat i signats pel president del Patronat </span>a proposta, si és el cas, del gerent de la Fundació, d’acord amb els articles 20.<em>m</em> i 23.1.<em>h</em> dels Estatuts de la Fundació. El Patronat, el president o el gerent poden demanar un informe<span style="color:black"> al director acadèmic del Conservatori Superior i/o del Conservatori Professional, segons quina sigui l’entitat beneficiària de la contraprestació acadèmica. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>c)</em>&nbsp;&nbsp;En casos excepcionals la Fundació pot establir convenis de col·laboració amb altres entitats o empreses a les quals s’exoneri del pagament dels preus quan permetin dur a terme una activitat acadèmica que la Fundació per ella mateixa no pot dur a terme. Aquests convenis han de ser aprovats <span style="color:black">pel Patronat i signats pel president del Patronat&nbsp; </span>a proposta, si és el cas, del gerent de la Fundació, d’acord amb els articles 20.<em>m</em> i 23.1.<em>h</em> dels Estatuts de la Fundació. El Patronat, el president o el gerent poden demanar un informe<span style="color:black"> raonat al gerent i/o un informe al director acadèmic del Conservatori Superior i/o del Conservatori Professional, segons quina sigui l’entitat beneficiària de la contraprestació acadèmica. En tot cas, el Conservatori Superior o el Professional han de ser, sempre i sense excepció, els organitzadors i promotors de l’activitat, </span>encara que no necessàriament amb exclusivitat.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em><span style="color:black">d)</span></em><span style="color:black">&nbsp;Les entitats benèfiques sense ànim de lucre que organitzin un acte per recaptar fons podran gaudir de les bonificacions que s’estableixen en el punt 3.2.<em>e</em> sense haver de subscriure un conveni de col·laboració, sempre </span>que l’activitat l’organitzi i l’executi la mateixa entitat de caràcter benèfic, o bé una entitat o empresa aliena a aquesta, quan l’activitat s’ajusti als objectius de l’entitat benèfica,<span style="color:black"> i que almenys el </span>90&nbsp;% <span style="color:black">de la recaptació de la taquilla es destini directament a la causa benèfica que es promou.</span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">El dret a la bonificació del punt 3.2.<em>e</em> només el pot gaudir la mateixa entitat una vegada per any. Els actes successius de la mateixa entitat dins el mateix any gaudiran de les bonificacions de què gaudeixen les entitats del punt 3.1.<em>a</em>. </span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Per gaudir de la reducció del punt 3.2.<em>e</em>, l’entitat ha de sol·licitar l’autorització al president del Patronat, que autoritzarà o denegarà l’activitat. En tot cas, en la sol·licitud s’ha d’indicar clarament la causa benèfica que es vol impulsar, el percentatge de la taquilla que es destinarà a la causa benèfica i una relació de les altres entitats o empreses que hi participen, amb l’especificació del tipus de col·laboració o ajut que cadascuna destina a l’activitat.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>e)</em>&nbsp;&nbsp;&nbsp;&nbsp; Els centres educatius dependents de la Conselleria gaudeixen d’uns preus especials, que s’estableixen en els punts 3.2.<em>f</em> i 3.2.<em>g</em>, sense necessitat d’establir cap conveni.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>f)</em>&nbsp;&nbsp;&nbsp;&nbsp; També es poden establir convenis i mecanismes de col·laboració, al marge del que es disposa en aquesta Resolució, amb la Banda Municipal de l’Ajuntament de Palma, amb l’Orquestra Simfònica de les Illes Balears, amb la Coral Universitat de les Illes Balears i amb altres entitats semblants, a proposta d’algun membre del Patronat de la Fundació i amb l’aprovació del Patronat de la <span style="color:black">Fundació.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>g)</em>&nbsp;&nbsp;&nbsp; Les conselleries del Govern poden gaudir de les reduccions establertes en els punts 3.2.<em>c</em> i 3.2.<em>d</em> sense necessitat de subscriure un conveni.</span></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">3.2. Bonificacions dels preus no acadèmics prevists en l’apartat 2</span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">S’estableixen les bonificacions següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><em>b)</em>&nbsp;&nbsp;&nbsp; La Banda Municipal de l’Ajuntament de Palma està exempta de pagar per fer concerts a les instal·lacions del Conservatori.</span></span></p> <p style="margin-bottom:0px; Sol·licitud i forma d’abonament de les despeses relatives als preus de l’apartat 2. Facturació i liquidació</strong></span></span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">L’ús de la sala auditori o d’altres instal·lacions s’ha de sol·licitar per escrit a la Fundació. En la sol·licitud s’ha d’indicar el tipus d’activitat, el dia i l’hora en què s’ha previst fer, l’horari aproximat en què s’ocuparà l’espai (assaigs, muntatge, proves, etc.), les necessitats tècniques de muntatge i els instruments que es volen llogar, si és el cas. Cal formular la sol·licitud segons el model facilitat per l’administració del Conservatori. </span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">La Fundació ha de decidir si cedeix l’ús de les instal·lacions i ha de fer una estimació de les despeses que es poden generar, les quals, una vegada quantificades, s’han de comunicar a les persones interessades. Si estan conformes amb el pressupost, s’ha de signar <span style="color:black">un contracte </span>de cessió d’ús dels espais.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Una vegada que la Fundació hagi presentat la factura corresponent a les persones sol·licitants, l’import s’ha d’abonar segons els terminis següents:</span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Empreses i entitats sense conveni: un 25&nbsp;% quan se signi el contracte, un 25&nbsp;% un mes abans de l’acte i el 50&nbsp;% restant una setmana abans de començar l’acte. Les despeses extres s’han d’abonar 30 dies després de l’acte, com a màxim.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Empreses i entitats amb conveni: un 35&nbsp;% quan se signi el contracte i la resta, 30 dies després de la finalització de l’acte, com a màxim.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Conselleries i centres educatius: el 100&nbsp;% 60 dies després de l’acte, com a màxim.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Actes benèfics descrits en el punt 3.1.<em>d</em>: el 100&nbsp;% <span style="color:black">7 dies després de l’acte, com a màxim.</span></span></span></li> </ul> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">Els pagaments a compte no són, en cap cas, reemborsables. El gerent de la Fundació ha d’estudiar les sol·licituds i ha de decidir en cada cas si la petició s’admet o no. En el cas que s’admeti, la Fundació ha de preparar un pressupost, que el sol·licitant ha d’acceptar prèviament mitjançant el pagament per avançat del 100&nbsp;% del total previst.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">S’estableix un descompte del 25&nbsp;% únicament en l’ús de les aules d’estudi per als antics alumnes del Conservatori Superior de Música de les Illes Balears o de qualsevol conservatori professional de les Illes Balears.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Aquestes condicions també s’apliquen als alumnes del Conservatori Superior i del Conservatori Professional de Música i Dansa de Mallorca que, malgrat ser alumnes amb matrícula activa en el moment de fer la sol·licitud, vulguin desenvolupar una activitat diferent a la de la pràctica instrumental establerta en els seus estudis oficials.</span></span></p> <p style="margin-bottom:8pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:black">A tots els preus s’ha d’afegir l’IVA corresponent.</span></span></span></p> <p style="margin-left:0cm; margin-right:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">6.
