Mitjançant la Resolució de 5 de desembre de 2018 (BOIB núm. 157, de 15 de desembre) es va publicar la llista de persones aspirants que han superat les proves selectives per a l’ingrés, pel torn lliure i pel torn de promoció interna, &nbsp;al cos de gestió de la Comunitat Autònoma de les Illes Balears, convocades per la Resolució de 26 d’octubre de 2017, i es va fer pública la llista dels llocs vacants oferts a l’efecte de l’adjudicació.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Aquesta Resolució&nbsp; va ser modificada per la Resolució de 18 de desembre de 2018 (BOIB núm. 160 de 22 de desembre).</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">2.&nbsp;Després que les persones aspirants aprovades hagin presentat els documents i la sol·licitud de destinació, han de ser nomenades personal funcionari de carrera del cos de gestió de l’Administració general de la Comunitat Autònoma de les Illes Balears.</span></p> <p><strong><span style="color:black">Fonaments de dret</span></strong></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">1. La Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">2. La base 14 de la Resolució de 5 de maig de 2016, per la qual s’aproven les bases generals que han de regir els processos selectius per a la cobertura de les places vacants de personal funcionari, de l’àmbit dels serveis generals, previstes en les ofertes públiques d’ocupació que aprovi la Comunitat Autònoma de les Illes Balears, incloses les ofertes d’ocupació pública aprovades per Acord del Consell de Govern per als anys 2014 i 2015. </span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">5. Adjudicar els llocs de treball, d’acord amb el que s’indica en l’annex d’aquesta Resolució, a les persones aspirants que han superat les proves selectives per a l’ingrés, pel torn lliure i pel torn de promoció interna, al cos de gestió de l’Administració general de la Comunitat Autònoma de les Illes Balears, després d’haver presentat la documentació pertinent, d’acord amb la petició efectuada per les persones interessades i la puntuació obtinguda en el procés selectiu.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">3. Un cop publicat el nomenament, per adquirir la condició de funcionari de carrera s’ha d’efectuar el jurament o la promesa d’acatar la Constitució, l’Estatut d’autonomia de la Comunitat Autònoma de les Illes Balears i l’ordenament vigent i prendre possessió en el termini reglamentari.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">4. La presa de possessió s’ha d’efectuar en la conselleria corresponent, en el termini de tres dies hàbils comptadors a partir de l’endemà de la publicació d’aquesta Resolució en el </span><em>Butlletí Oficial de les Illes Balears.</em></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Abans de prendre possessió del lloc adjudicat, la persona interessada ha de fer constar que no ocupa cap lloc de treball ni que fa cap activitat en el sector públic de les que es comprenen en l’article 1 de la Llei 53/1984, de 26 de desembre, d’incompatibilitats del personal al servei de les administracions públiques. Si du a terme cap activitat privada, incloses les de caràcter professional, ho ha de declarar en el termini de deu dies hàbils comptadors a partir de l’endemà de la presa de possessió, perquè l’òrgan competent acordi la declaració de compatibilitat o d’incompatibilitat.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">5. Els funcionaris que obtenguin destinació definitiva no poden participar en els procediments de provisió de llocs de treball durant un termini mínim de dos anys, comptadors a partir del dia en què prenguin possessió del lloc de treball, de conformitat amb l’article 3.7 del Decret 33/1994.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Tampoc no poden participar, durant el període d’un any, en les convocatòries per atorgar comissions de serveis, excepte si hi ha hagut una primera convocatòria de la comissió de serveis corresponent a un lloc de prefectura orgànica que hagi quedat deserta per no haver-hi funcionaris de carrera que compleixin els requisits establerts.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">A les persones funcionàries que accedeixen per promoció interna, que exerceixen el dret d’opció i romanen en el lloc de treball que ocupaven, se’ls computarà el temps de serveis prestats en aquest mateix lloc en el cos de procedència.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Interposició de recursos</span></strong></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Contra aquesta Resolució, que posa fi a la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera d’Hisenda i Administracions Públiques en el termini d’un mes, comptador a partir de l’endemà de la publicació, d’acord amb els articles 123 i 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú, i l’article 57 de la Llei 3/2003, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa de Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos a comptar a partir de l’endemà que s’hagi publicat aquesta Resolució, d’acord amb els articles 8.2 i 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
