    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ple del Consell Insular de Mallorca ha dictat dia 13 de desembre de 2018 l’acord que transcric literalment a continuació:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments jurídics:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. L’article 2 del Decret 10/2003, de 14 de febrer, de regulació dels consells escolars insulars i dels consells escolars municipals de les Illes Balears, regula la representació dels membres del consells escolars insulars.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Ple del Consell de Mallorca, en sessió de dia 12 de juliol de 2018, va aprovar el Reglament nou d’organització i funcionament del Consell Escolar de Mallorca (BOIB núm. 132, 23 d’octubre de 2018).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Disposició addicional primera del ROF del Consell Escolar de Mallorca (CEM) determina la constitució del nou consell escolar i estableix els terminis per a la designació de representants. En aquesta mateixa disposició es determina que la Presidència i Vicepresidència, tant si formen part de la nova composició com si no en formen part, des del moment en que es dissol l’antic Ple passen a exercir com a Presidència i Vicepresidència en funcions. La persona secretària segueix exercint el càrrec fins que se’n nomena una de nova, d’acord amb el procediment establert en l’article 14.1 d’aquest reglament.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. L’article 7 del ROF del CEM estableix la composició del Consell Escolar de Mallorca.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. L’article 8 del ROF del CEM disposa que els membres són nomenats pel Ple del Consell Insular de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. L’article 8.8 del ROF del CEM, disposa que tots els consellers del CEM exerceixen el càrrec per un període de 4 anys sens perjudici dels canvis que es produeixin pel cessament anticipat d’algun dels membres.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Les diferents entitats i organismes han presentat les noves designacions dels seus representants. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per això, propòs que el Ple adopti els acords següents: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Cessar als membres actuals nomenats per acord del Ple del Consell Insular de Mallorca en les sessions de 10 de desembre de 2015, 14 de juliol de 2016, 9 de juny de 2016, 8 de setembre de 2016, 9 de febrer de 2017, 11 de maig de 2017, 11 d’octubre de 2017 i 14 de desembre de 2017, tot agraint-los la seva col·laboració.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Nomenar membres del CEM les persones que a continuació es relacionen:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) El recurs de reposició potestatiu davant el Ple, en el termini d’un mes, comptador a partir de l’endemà de rebre aquesta notificació. Contra la desestimació expressa d’aquest recurs de reposició, hi podeu interposar el recurs contenciós administratiu davant el &lt;em&gt;Jutjat Contenciós Administratiu de Palma que correspongui&lt;/em&gt; en el termini de dos mesos, comptadors a partir de l’endemà de rebre la notificació de la desestimació del dit recurs de reposició.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si ha transcorregut un mes des de la interposició del recurs de reposició potestatiu i no n’heu rebut la notificació de resolució expressa, s’entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat &lt;em&gt;Contenciós Administratiu de Palma que correspongui&lt;/em&gt; sense limitació de temps.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No obstant l’anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d’1 d’octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;
