CAIB 2019-01-16 300 CAIB text/html 1845 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Antecedents</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. El 18 d'octubre de 2018 la presidenta de l'Institut Mallorquí d'Afers Socials va dictar la resolució d'aprovació de la convocatòria dels <span style="color:#000000">Premis del Consell de Mallorca a la Innovació Social 2018.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Aquesta resolució va ser publicada al BOIB núm 135, de 30 d'octubre de 2018.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Una vegada finalitzat el termini de presentació de candidatures el jurat es va reunir el 5 de desembre del 2018 i va decidir proposar la concessió dels premis, en aplicació dels criteris establerts i després de les deliberacions, pertinents, a les candidatures que consten a l’acta de la sessió, com així consta en l'acta corresponent d'aquesta reunió.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Aquest organisme té com a objecte fonamental, d'acord amb l'article 2.1 dels seus Estatuts, l'exercici, en forma directa i descentralitzada, de les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i menors.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D'acord amb l'article 3 dels Estatuts de l'IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d'obrar necessària per complir els seus fins. Entre les seves facultats al punt b) d'aquest article 3 es troba la d’atorgar subvencions.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D’acord amb l’art. 8 de la Llei 38/2003, general de subvencions, amb caràcter previ a l’atorgament de les subvencions, s’han d’aprovar les normes que estableixin les bases reguladores de concessió en els termes que preveu la Llei.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Ple del Consell de Mallorca, en sessió de 16 de desembre de 2016 va aprovar definitivament l'Ordenança General de Subvencions (BOIB núm. 140, de 5 de novembre de 2016). Ordenança que d'acord amb al seu article 1 te per objecte regular el règim jurídic general de les subvencions i premis atorgades pel Consell Insular de Mallorca, els organismes autònoms que en depenen i les entitats de dret públic amb personalitat jurídica pròpia vinculades o dependents que atorguin subvencions dins l’exercici de potestats administratives.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D'acord amb l'Exposició de Motius de l’Ordenança general de subvencions del Consell Insular de Mallorca (BOIB núm. 21, de 18 de febrer de 2017) ja no és necessària l'aprovació d'unes bases reguladores de les subvencions que es tramiten per part del Consell de Mallorca sinó que la fórmula més idònia per a gestionar les subvencions que s’inclouen en el pressupost és aprovar una ordenança general, tant pel volum de subvencions que atorga com per la conveniència d’unificar criteris en els diferents serveis. Així doncs, aquesta Ordenança regula totes les subvencions que atorgui el Consell de Mallorca, sigui quin sigui l’objecte i la finalitat, amb unes excepcions que no són d'aplicació al cas que ens ocupa.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Per una altra banda la Disposició derogatòria deroga expressament diverses bases reguladores en matèria de serveis socials i, en el punt 2, totes les normes de rang igual o inferior que s’oposen al que s’estableix en aquesta Ordenança.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Consell Executiu del Consell de Mallorca, en sessió celebrada el 24 de gener de 2018 va aprovar el Pla estratègic de subvencions de l'Institut Mallorquí d'Afers Socials per a l'any 2018 (BOIB núm. 16 de 3 de febrer de 2018) incloent en la línia de subvencions corresponent a l'Àrea de Persones amb Discapacitat els «Premis Consell de Mallorca a la Innovació Social».</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Finalment, la Disposició addicional Primera regula el procediment a seguir per a convocar i concedir Premis per part dels subjectes inclosos dins l’àmbit d’aplicació d’aquesta Ordenança, que són tant el Consell Insular de Mallorca com els organismes autònoms que en depenen. A aquesta disposició addicional Primera s'estableix que en les convocatòries corresponents s’han d’indicar el nombre de premis convocats, els requisits dels participants, l’import i els criteris d’adjudicació, que s’han de determinar per la qualitat i per la idoneïtat, i l’adequació de l’activitat premiada a la finalitat específica pretesa. A més s'assenyala que en consideració a la naturalesa de la subvenció, per a optar al premi no s’ha d’exigir acreditar que es compleixen els requisits establerts en l’art. 8 d’aquesta Ordenança.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Als premis, i d'acord amb l'Ordenança general de Subvencions, a més de la publicitat pròpia de tota convocatòria de subvencions, se’ls ha de donar la màxima difusió possible entre les persones que hi poden estar interessades.</span></span></li> <li><span style="font-family:Times New Roman,Times,serif;
