&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Les persones i les entitats que figuren en l’annex 1 d’aquesta Resolució han presentat a la Conselleria de Cultura, Participació i Esports una sol·licitud de subvenció per facilitar-los els desplaçaments a la Península, les illes Canàries, Ceuta i&lt;strong&gt; &lt;/strong&gt;Melilla&lt;strong&gt; &lt;/strong&gt;per assistir a les competicions oficials dels diferents calendaris federatius dels anys 2016, 2017, 2018 i 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. El Servei d’Administració Esportiva de la Direcció General d’Esports i Joventut ha examinat les sol·licituds i no està conforme amb l’atorgament de la subvenció, pels motius que s’especifiquen en l’annex 1 d’aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. L’Ordre del conseller de Turisme i Esports de 18 de desembre de 2012 per la qual s’estableixen les bases reguladores per concedir subvencions en matèria d’esports (BOIB núm. 2 de 3 de gener de 2013). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3. L’apartat 6.3 de la Resolució de la consellera de Transparència, Cultura i Esports de 3 de gener de 2017 (BOIB núm. 15, del 04/02/2017) disposa, respecte al procediment, que el director general d’Esports i Joventut ha d’emetre les corresponents propostes de concessió o denegació dels ajuts.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4. La proposta de Resolució de denegació de la Direcció General d’Esports i Joventut de data 4 de desembre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot això dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1. Denegar la concessió d’una subvenció, per facilitar-los els desplaçaments a la Península, les illes Canàries, Ceuta i&lt;strong&gt; &lt;/strong&gt;Melilla&lt;strong&gt; &lt;/strong&gt;&amp;nbsp;per assistir a les competicions oficials dels diferents calendaris federatius, a les persones o entitats que figuren a l’annex 1 d’aquesta resolució (amb els núm. d’expedient P/2017-2019/1184, P/2017-2019/1185 i P/2017-2019/1189), pels motius que igualment figuren en l’annex 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2. Ordenar la publicació d’aquesta Resolució al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant la consellera de Cultura, Participació i Esports en el termini d’un mes comptador des de l’endemà d’haver-ne rebut la notificació, d’acord amb l’article 124 de la Llei 39/2015, d’1 d’octubre, de règim jurídic de les administracions públiques i del procediment administratiu comú i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos des de l’endemà d’haver-se publicat aquesta Resolució, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
