    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;LA JUNTA DE GOVERN LOCAL, EN SESSIÓ ORDINÀRIA CELEBRADA EL 15 DE NOVEMBRE DE 2018, VA APROBAR LA CONVOCATÒRIA D’AJUDES PER A LA PREVENCIÓ D’INCENDIS FORESTALS I LA PROTECCIÓ DEL PAISATGE RURAL, AL MUNICIPI DE SANT JOSEP DE SA TALAIA PER A L’ANY 2018&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;BDNS ( Identif: 429054)&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;1. OBJECTE, FINALITAT I ÀMBIT D’APLICACIÓ &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’objectiu d’aquesta convocatòria és donar suport econòmic a les actuacions, les iniciatives i els projectes de les societats i associacions que gestionen vedats de caça del municipi de Sant Josep de sa Talaia i les associacions de propietaris de terrenys forestals o rústics que tinguin com a objectiu la preservació de l’entorn, la conservació del paisatge i la prevenció dels incendis forestals dels terrenys que gestionen en el municipi de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Llei de Bases de Règim Local (Llei 7/85) estableix en el seu article 25 que és competència dels municipis la prevenció i extinció d’incendis. En aquest sentit, el Decret 125/2007 d’incendis forestals de les Illes Balears defineix com actuacions de prevenció d’incendis forestals totes aquelles activitats adreçades a evitar l’inici de l’incendi forestal i a crear les condicions per minimitzar la propagació i limitar al màxim els efectes perjudicials que puguin ocasionar a persones, bens, patrimoni rural i medi ambient en general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Així mateix, la Llei de Monts (Llei 43/2003) estableix en el seu article 43 que correspon a les administracions públiques competents la responsabilitat de l’organització de la defensa contra incendis forestals i que hauran d’adoptar, de forma coordinada, mesures que condueixin a la prevenció, detecció i extinció dels incendis, independentment de la titularitat dels monts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per altra banda, la Llei de Patrimoni Natural i Biodiversitat (Llei 42/2007) estableix, en el seu article 5, que les administracions públiques promouran la participació i les activitats que contribueixin a assolir els objectius de la llei, entre els quals s’inclou la gestió sostenible dels recursos naturals, la preservació de la varietat, singularitat i bellesa dels ecosistemes naturals i del paisatge. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En el mateix sentit, l’Estatut d’Autonomia de les Illes Balears estableix en el seu article 23 que els poders públics vetllaran per la defensa i la protecció de la naturalesa, del territori, del medi ambient i del paisatge i establiran polítiques de gestió, ordenació i millora de la seva qualitat harmonitzant-les amb les transformacions que es produeixen per l’evolució social, econòmica i ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Així doncs, el marc normatiu actual estableix de forma clara la responsabilitat de les administracions locals per dur a terme actuacions de prevenció dels incendis forestals i de forma més general la responsabilitat per prendre mesures de gestió sostenible dels recursos naturals i de protecció del paisatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El desenvolupament rural (mitjançant la conservació de cultius i neteja de masses forestals) és un element clau en el manteniment del paisatge i en la prevenció dels incendis forestals, i cal destacar que gran part dels terrenys forestals i rurals del municipi de Sant Josep de sa Talaia es troben inclosos en vedats de caça gestionats per societats de caçadors i associacions de veïns o estan inclosos en associacions de propietaris de terrenys forestals o rurals. Aquestes entitats duen a terme actuacions de manteniment de cultius, recuperació d'espais agrícoles degradats que d'altra banda seguirien en estat d'abandonament, neteja de boscos, així com actuacions de millora i protecció de l'entorn on realitzen la seva activitat, afavorint així la conservació del medi ambient, la recuperació d'usos tradicionals i col · laborant en la prevenció d'incendis forestals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La Regidoria de Medi Ambient de l’Ajuntament de Sant Josep de sa Talaia pretén impulsar les actuacions que permetin la preservació del paisatge i del patrimoni natural del municipi, a l’hora que es fomenten les actuacions orientades a la prevenció dels incendis forestals. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;2&lt;/strong&gt;. &lt;strong&gt;RÈGIM JURÍDIC&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.1. La present convocatòria se sotmet a la Llei 38/2003, de 17 de novembre, general de subvencions, al Reial decret 887/2006, de 21 de juliol, pel qual s’aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions, a l’Ordenança general de les bases reguladores de les subvencions que concedeix l’Ajuntament de Sant Josep de sa Talaia (BOIB núm. 66 de 30 de maig de 2017) i al Pla estratègic de subvencions de l’Ajuntament de Sant Josep de sa Talaia per a l’any 2018 (BOIB núm. 85, de 10 de juliol de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta convocatòria s’exposarà en el tauler d’anuncis de l’Ajuntament, a la pàgina web de l’Ajuntament de Sant Josep www.santjosep.org, i serà publicada al BOIB i a la BDNS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;3. CONSIGNACIÓ PRESSUPOSTÀRIA I QUANTIA.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta convocatòria está dotada amb un màxim de 15.000 € a càrrec del pressupost municipal de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;De conformitat amb l’article 56 (tramitació anticipada) del&amp;nbsp; Reglament de Subvencions, la concessió de la present subvenció queda condicionada a l’existència de crèdit adequat i suficient en el moment de la resolució de concessió. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La resolució de la concessió d’ajudes es realitzarà durant l’exercici pressupostari 2019, un cop comprobada l’existència de crèdit adequat i suficient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;4. REQUISITS GENERALS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Podran acollir-se a aquesta convocatòria aquelles societats de caçadors i associacions de veïns que gestionin vedats de caça al municipi de Sant Josep de sa Talaia i les associacions de propietaris de terrenys forestals o rústics, i que compleixin els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Gestionar terrenys del municipi de Sant Josep de sa Talaia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Tenir caràcter no lucratiu&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Trobar-se el beneficiari al corrent de les obligacions tributàries, amb la seguretat social i amb el mateix Ajuntament de sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) No trobar-se el beneficiari incurs en cap de les causes d’incompatibilitat i complir els requisits que fixa l’article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Acreditació del compliment d'obligacions per reintegrament de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Estar inscrit en el Registre d’Associacions de l’Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;5. ACTIVITATS SUBVENCIONABLES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Només es consideraran activitats subvencionables aquelles que es realitzin al municipi de Sant Josep de sa Talaia, que es puguin justificar amb factures i que hagin estat realitzades entre 1 de gener i el 31 d’octubre de l'any 2018. Les activitats objecte de la subvenció són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Sembra i recuperació de conreus: Sembres o recuperacions de conreus de parcel·les identificades cadastralment. Amb la sol·licitud s’ha de lliurar la relació de parcel·les identificades cadastralment i un plànol d’ubicació de les mateixes. S’inclouen en aquest apartat les despeses de personal, maquinària, tractament de residus, compra de llavors o altres productes complementaris i altres despeses relacionades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Millores d’hàbitats: Seran subvencionables les activitats de poda, neteja de camins, treballs forestals, repoblacions forestals, retirades de residus, i altres despeses relacionades, realitzades sempre d’acord amb les instruccions i permisos corresponents per part de les administracions públiques. Amb la sol·licitud s’haurà d’incloure un plànol que assenyali les parcel·les o camins on s’ha realitzat l’actuació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Prevenció d'incendis forestals: Seran subvencionables les actuacions de prevenció d'incendis forestals tals com faixes contra-incendis, dipòsits contra-incendis (per a mitjans d'extinció aeris i terrestres) i actuacions similars, realitzades sempre d’acord amb les instruccions i permisos corresponents per part de les administracions públiques. Amb la sol·licitud s’haurà d’incloure un plànol que assenyali les parcel·les o camins on s’ha realitzat l’actuació. S’inclouen en aquest apartat les despeses de personal, obres, maquinària i altres despeses relacionades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Totes les activitats per a les quals es sol·liciti la subvenció hauran de disposar dels corresponents permisos, autoritzacions i/o llicències necessaris per a la seva realització.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6&lt;/strong&gt;. &lt;strong&gt;RÈGIM DE LES AJUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.1. La concessió de la subvenció es durà a terme mitjançant el règim de concurrència competitiva Només podran obtenir subvenció aquells sol·licitants que reuneixin els requisits exigits en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.2. S’estableix com a únic mitjà de notificació de tots els actes de tràmit del present procediment, el tauler d’anuncis de l’Ajuntament i &amp;nbsp;la pàgina web de l’Ajuntament (www.santjosep.org).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.3. Finalitzat el termini de presentació de sol·licituds i un cop revisades aquestes per l’òrgan instructor, s’exposarà, segons s’estableix a la base 6.2, la llista provisional d’admesos per participar en el procediment així com les ressenyes de les sol·licituds que tenguin algun defecte&amp;nbsp; o hagin de ser esmenades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Si la sol·licitud i/o documentació presentada té cap defecte, manca alguna documentació o es volen fer al·legacions, la persona interessada disposarà d’un termini de 10 dies, comptats a partir del dia següent de la data de requeriment, per fer les esmenes que corresponguin. Transcorregut aquest termini sense haver efectuat les esmenes o haver-hi adjuntat la documentació requerida, es considerarà desestimada la seva petició, d’acord amb el que disposa l’article 68.1 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Un cop passat el termini per a l’esmena de documentació o presentació d’al·legacions i un cop resoltes aquestes per l’òrgan col·legiat, l’òrgan instructor publicarà la llista definitiva d’admesos i exclosos per participar en el procediment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.4. Només podran obtenir subvenció aquells sol·licitants que, reunint els requisits exigits, acompleixin les condicions assenyalades a la base 4.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.5. Les ajudes objecte d’aquesta convocatòria són compatibles amb altres ajuts per part de qualsevol altre organisme, administració o institució pública o privada. La suma total de les ajudes percebudes per a la mateixa activitat no podrà ser, en cap cas, superior al cost total de l’activitat subvencionada. El beneficiari està obligat a comunicar a l’Ajuntament l’obtenció d’altres subvencions o ajudes per a la mateixa finalitat, procedents de qualsevol administració o ens públic, nacional o internacional, així com de tota entitat o institució privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6.6. Les ajudes, no podran ser superiors a les despeses originades per l’activitat objecte d’aquesta convocatòria, sense perjudici de les limitacions pressupostàries. Si el total d’ajudes a concedir superés la consignació pressupostària d’aquesta línia de subvencions, aquestes es distribuiran de forma proporcional, garantint un mínim per a per a tots els sol·licitants amb actuacions subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquestes subvencions no generen cap dret a l’obtenció d’altres ajuts en exercicis posteriors i, per tant, tampoc no es poden al·legar com a precedent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;7. SOL·LICITUD, DOCUMENTACIÓ I TERMINI DE PRESENTACIÓ.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.1. Les sol·licituds de subvenció es formalitzaran mitjançant el model normalitzat que es pot trobar a l’Annex I. Les instàncies s’adreçaran a l’Alcaldia de l’Ajuntament de Sant Josep de sa Talaia i es presentaran en el Registre General de la corporació a Sant Josep o a les dependències municipals de Cala de Bou i de Sant Jordi, o, també, en la forma establerta a l’art. 16 de la Llei 39/2015, d’ 1 d’octubre, del Procediment Administratiu Comú de las Administracions Públiques. En aquest cas s’haurà de passar avís per correu electrònic a l’adreça: aneira@santjosep.org&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.2.&lt;strong&gt; &lt;/strong&gt;Els sol·licitants, juntament amb la sol·licitud de l’&lt;strong&gt;Annex I&lt;/strong&gt;, han de presentar la documentació següent (originals o fotocòpies compulsades):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Còpia del CIF/NIF de l’entitat sol·licitant i còpia del DNI/NIF del representant de l’entitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Estatuts de l’entitat (en cas de no haver estat presentats en convocatòries anteriors).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Compte justificatiu, el qual haurà de contenir una memòria d’actuació i una memòria econòmica amb el detall previst a l’article 72 del RLGS .&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Originals o fotocòpies compulsades de les factures o documents que justifiquin les despeses realitzades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Justificant de pagament de les factures (certificat de l’empresa proveïdora, extracte bancari) &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Model de sol·licitud de transferència bancària per a pagaments de l’Ajuntament de Sant Josep de sa Talaia, disponible a les oficines municipals. (en cas de no haver estat presentat amb anterioritat)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Declaració responsable, de no trobar-se incurs en cap de les causes d’incompatibilitat i de complir els requisits que fixa l’article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (vegeu &lt;strong&gt;annex II&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;h)Declaració responsable de trobar-se al corrent de les obligacions tributàries, amb la Seguretat Social i amb el mateix Ajuntament de Sant Josep i autorització a l’Ajuntament per sol·licitar a l’Agència Tributària i a la Seguretat Social les dades fiscals del sol·licitant, que siguin necessàries (vegeu &lt;strong&gt;annex IV&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;I)Declaració de les subvencions rebudes o sol·licitades per a la mateixa finalitat i compromís de comunicar a l’entitat local, les que s’obtinguin en el futur (&lt;strong&gt;annex III&lt;/strong&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;j) Declaració responsable del compliment d'obligacions per reintegrament de subvencions &amp;nbsp;(annex II)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;k) Declaració responsable sobre la situació relativa a l’IVA del sol·licitant (annex V)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Si els documents exigits en la sol·licitud ja s’haguessin presentat a l’Ajuntament en una altra ocasió, la persona sol·licitant podrà acollir-se a l’establert en l’article 53.&lt;em&gt;d&lt;/em&gt;) de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques, sempre que es faci constar la data i l’òrgan o dependència en què van ser presentats o emesos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La presentació de la sol·licitud suposa l’acceptació, per part de la persona interessada, de les prescripcions contingudes en la convocatòria corresponent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’Ajuntament de Sant Josep de sa Talaia, en qualsevol moment, pot sol·licitar als interessats la documentació i la informació complementària que consideri necessària per resoldre l’expedient. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.3. &amp;nbsp;Termini de presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El termini de presentació de sol·licituds serà de 10 dies comptats a partir del dia següent de la publicació del extracte de la convocatòria al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;8) QUANTIA DE LES AJUDES I CRITERIS DE VALORACIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8.1) Quantia de les ajudes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La quantia de les subvencions podrà ser del 100% del cost de l’activitat, sempre i quan l’import de l’ajuda, aïlladament o en concurrència amb altres subvencions o ajudes, no superi el cost de l’activitat per la qual es sol·licita la subvenció. En cap cas serà subvencionable el pagament d’impostos, taxes o tributs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En qualsevol cas, l’import màxim de la subvenció per a cada entitat serà de 9.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cas que les sol·licituds formulades que compleixin els requisits superin la quantitat disponible, es distribuirà el fons de manera proporcional a la puntuació obtinguda segons els criteris de valoració establerts en aquestes bases, garantint un mínim per a per a tots els sol·licitants amb actuacions subvencionables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;8.2) Criteris de valoració&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els criteris per a la valoració de les sol·licituds serà el següent (màxim de 60 punts):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Qualitat de les activitats realitzades: Puntuació màxima 20 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a.1) Sembres i recuperació de conreus: 10 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a.2) Millora d’hàbitats: 15 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a.3) Prevenció d'incendis forestals: 20 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Nombre de socis de l’entitat: Fins a 20 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Superfície de terreny: Fins a 20 punts&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’apartat c) es refereix a la superfície del vedat de caça o a la superfície dels terrenys que formen part de l’associació en el municipi de Sant Josep de sa Talaia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;9. ÒRGAN COL·LEGIAT&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’òrgan col·legiat realitzarà, a partir d’un informe del tècnic de l’Àrea de Medi Ambient, &amp;nbsp;la valoració tècnica de les sol·licituds i elaborarà la proposta de resolució de concessió, la qual, a través de l’òrgan instructor, &amp;nbsp;s’elevarà a l’òrgan resolutori per a la concessió de les subvencions. L’òrgan instructor té atribuïdes les següents funcions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Examinar les sol·licituds, la documentació presentada i l’informe tècnic i comprovar les dades en virtut de les quals s’haurà d’adoptar la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Analitzar i valorar les sol·licituds i l’informe tècnic d’acord amb els criteris establerts en aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c) Requerir als sol·licitants la correcció o millora de les seues sol·licituds, si s’escau.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d) Formular la proposta de concessió de subvencions corresponent i elevar-la a l’òrgan competent per a la seva resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e) Resoldre qualsevol dubte que es presenti en la interpretació i aplicació d’aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;10. INSTRUCCIÓ I RESOLUCIÓ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10.1. L’òrgan instructor del procediment serà personal administratiu del Departament de Medi Ambient, que té atribuïdes les funcions establertes a l’article 24 de la Llei general de subvencions i article 12 de l’Ordenança general de les bases reguladores de les subvencions que concedeix l’Ajuntament de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’òrgan instructor, a la vista de l’expedient i de l’informe de l’òrgan col·legiat, formularà la proposta de resolució provisional concedint un termini de 10 dies, comptats a partir del dia següent de la publicació de la proposta, perquè les persones interessades puguin presentar-hi al·legacions, si és el cas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Finalitzat aquest termini i examinades les al·legacions que, si és el cas, haguessin presentat els interessats, l’òrgan instructor, amb l’informe previ de l’òrgan col·legiat, formularà la proposta de resolució definitiva que dirigirà a l’òrgan competent per resoldre, que dictarà resolució definitiva amb la llista de sol·licitants que hagin obtingut ajudes i la quantia de les ajudes concedides, la qual es notificarà de conformitat amb l’exposat a la base 6.2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;10.2. L’òrgan competent per resoldre les convocatòries de subvencions és l’alcalde de Sant Josep de sa Talaia, sense perjudici que pugui ser assistit per la Junta de Govern Local, segons les atribucions que li confereix l’article 23.2&lt;em&gt;a) &lt;/em&gt;de la Llei 7/1985, de 2 d’abril, reguladora de les bases de règim local i en relació amb l’article 10.4 de la Llei 38/2003 general de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La resolució serà pública de conformitat amb el que preveu l’article 18.2 de la Llei 38/2003 general de subvencions i l’article 17 de l’Ordenança general de les bases reguladores de les subvencions que concedeix l’Ajuntament de Sant Josep.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El termini per a la resolució i notificació del procediment és d’un mes des de la data de finalització del termini per a presentació de les sol·licituds a què es refereix aquesta convocatòria&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La resolució ha d’especificar els següents aspectes: beneficiari; import de l’activitat que se subvenciona; quantia de l’ajuda; partida pressupostària a la qual s’aplica;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;11. PUBLICITAT DELS PROJECTES SUBVENCIONATS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Cada entitat beneficiària d’una subvenció reflectirà, en les activitats que realitzi, la col·laboració de la Corporació i s’expressarà que ha estat subvencionada per l’Ajuntament de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;La persona o entitat beneficiària haurà de donar adequada publicitat al caràcter públic del finançament del programa, activitat, inversió o actuació objecte de subvenció. Les mesures de difusió poden consistir en la inclusió de la imatge institucional de l'entitat concedent, així com en llegendes relatives al finançament públic en cartells, plaques commemoratives, materials impresos, mitjans electrònics o audiovisuals, o bé, en mencions realitzades en mitjans de comunicació o altres que resultin adequades a l'objecte subvencionat i d'eficàcia equivalent a les esmentades.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;12. FACTURA JUSTIFICATIVA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12.1. Les factures originals i altres documents de valor probatori equivalent han de ser estampillats per l’Ajuntament de Sant Josep de sa Talaia i s’ha d’indicar l’import de la factura que justifica la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;12.2. S’haurà d’acreditar el pagament de la factura justificativa amb anterioritat a la finalització del període de sol·licitud de la subvenció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El pagament de la factura s’acreditarà de la següent manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L’acreditació de l’abonament de la despesa del projecte s’ha de dur a terme a través de la documentació que tot seguit s’indica, depenent dels mitjans de pagament que s’hagin utilitzat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. &amp;nbsp;Pagament en efectiu: factura, signada i segellada pel proveïdor, en la qual s’ha d’especificar la despesa a què correspon el pagament, la data i l’expressió «rebut en metàl·lic», «pagat en metàl·lic», «pagat» o similar . Sota la signatura hi ha de figurar el&amp;nbsp; nom, els llinatges i el número de document d’identitat de la persona que signa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. &amp;nbsp;&amp;nbsp;Pagament mitjançant targeta de crèdit:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Tiquet de compra en què figuri el pagament amb targeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Tiquet de compra i resguard del pagament amb targeta en cas que no figuri en el tiquet de compra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Extracte del compte en què figuri el càrrec de pagament amb targeta. L’extracte del compte pot substituir-se per un certificat o&amp;nbsp; títol similar de l’entitat bancària en què, com a mínim, consti el titular i el número de compte corrent en què es carrega el pagament de la targeta, la persona beneficiària, el concepte pel qual es fa la transferència i l’import i la data de l’operació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c. Pagament mitjançant transferència bancària o ingressos en un compte bancari:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Còpia del justificant de l’ordre de transferència bancària o del document bancari acreditatiu del pagament en el qual figurin el concepte de la transferència o l’ingrés, la data del document, l’import, la identificació del concepte, a fi que quedi identificat el pagament de la factura, i les dades de l’ordenant i del destinatari, que han de coincidir amb la persona beneficiària i amb l’emissor de la factura, respectivament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Extracte del compte bancari de la persona beneficiària de l’ajuda en el qual figuri el càrrec d’aquesta transferència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d. Pagament mitjançant xec nominatiu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Còpia del xec nominatiu o pagaré nominatiu emès a nom del proveïdor que expedeix la factura o document equivalent, sempre que estigui vençut.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Extracte del compte corrent de la persona beneficiària de l’ajuda en el qual figuri el càrrec d’aquest xec o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e. Pagament mitjançant pagarés, lletres de canvi o similars:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Document acreditatiu del càrrec en compte de l’efecte mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Extracte del compte en què figuri el càrrec de l’efecte mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta documentació es pot substituir per un certificat o document similar emès per l’entitat bancària que contengui el titular i el número de compte en què s’ha carregat l’efecte mercantil, el lliurador i el lliurat de la lletra de canvi, la persona beneficiària, el concepte pel qual es fa l’efecte mercantil, l’import de la lletra de canvi i la data d’emissió de la lletra i de l’abonament per part del lliurat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f. Pagament mitjançant domiciliació bancària:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Notificació bancària del càrrec.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Extracte bancari en què figuri el càrrec de la domiciliació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta documentació es pot substituir per un certificat o títol similar de l’entitat bancària en què consti el titular i el número del compte corrent en què s’ha fet el càrrec i l’ordenant del càrrec, la persona beneficiària, el concepte pel qual es fa el càrrec i l’import i la data de l’operació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;13) PAGAMENT DE L’AJUDA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El pagament de la subvenció aprovada només es podrà fer efectiu una vegada dictada la resolució corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;14) RÈGIM DE RECURSOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra la resolució que recaigui en aquest procediment, la qual posarà fi a la via administrativa, es podran interposar els recursos previstos en la legislació vigent. Aquests són els següents, alternativament:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El recurs de reposició potestatiu davant l’òrgan que va dictar la resolució, en el termini d’un mes, a comptar a partir del dia següent al de la notificació d’aquesta. Contra la desestimació expressa del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de dos mesos, a comptar a partir del dia següent al de la notificació de la desestimació del recurs de reposició. Contra la desestimació per silenci del recurs de reposició, es podrà interposar el recurs contenciós administratiu, en el termini de sis mesos, a comptar a partir del dia següent al de la desestimació presumpta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El recurs contenciós administratiu davant la jurisdicció contenciosa administrativa, en el termini de dos mesos, a comptar a partir del dia següent al de la notificació de la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;15) GRADUCACIÓ DELS INCOMPLIMENTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;L'incompliment de qualsevol de les condicions imposades amb motiu de la concessió de les subvencions en els termes que estableix l'article 37 de la LGS o el seu compliment extemporani, quan el compliment total de les condicions o el del termini fos determinant per a la consecució de la fi públic perseguit, serà causa de pèrdua total del dret i de reintegrament, si és el cas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;Fora dels casos expressats en el paràgraf precedent, el compliment parcial de les condicions o la realització en termini de només una part de l'activitat, sempre que s'acrediti una actuació de la persona o entitat beneficiària inequívocament tendent a la satisfacció dels compromisos o es degués a força major, donarà lloc al pagament parcial de la subvenció o, si escau, al reintegrament parcial aplicant la proporció en què es trobi l'activitat realitzada respecte de la total. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;16) DIFERÈNCIES ENTRE VERSIONS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;En cas de diferències entre les versions en català i castellà d’aquesta convocatòria, es prendrà com a vàlida la versió en català.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Que es vol acollir a la convocatòria de subvencions per a la conservació i protecció del medi rural al municipi de Sant Josep de sa Talaia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. &lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;f) Model de sol·licitud de transferència bancària per a pagaments de l’Ajuntament de Sant Josep de sa Talaia, disponible a les oficines municipals. (en cas de no haver estat presentat amb anterioritat)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;g) Declaració responsable, de no trobar-se incurs en cap de les causes d’incompatibilitat i de complir els requisits que fixa l’article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions (vegeu annex II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
