&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:0.35cm"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;Resolució de l'expedient d&lt;/span&gt;&lt;span style="color:#000000"&gt;’a&lt;/span&gt;&lt;span style="color:#000000"&gt;torgament&lt;/span&gt;&lt;span style="color:#000000"&gt; de les d'ajudes econòmiques adreçades &lt;/span&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;span style="color:#000000"&gt;entitats que desenvolupen activitats de suport a la funció tutelar de persones amb discapacitat intel·lectual per a l’any 2018&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;El&lt;/span&gt;&lt;span style="color:#000000"&gt; 12 de novembre de 2018&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; la presidenta de &lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;’&lt;/span&gt;&lt;span style="color:#000000"&gt;Institut&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Mallorquí&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;’&lt;/span&gt;&lt;span style="color:#000000"&gt;Afers&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Socials&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;(IMAS)&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;va resoldre&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;aprovar&lt;/span&gt;&lt;span style="color:#000000"&gt; la &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatòria&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;pública &lt;/span&gt;&lt;span style="color:#000000"&gt;d'ajudes econòmiques adreçades &lt;/span&gt;&lt;span style="color:#000000"&gt;a &lt;/span&gt;&lt;span style="color:#000000"&gt;entitats que desenvolupen activitats de suport a la funció tutelar de persones amb discapacitat intel·lectual per a l’any 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Aquesta convocatòria es va publicar al BOIB núm 146 de 22 de novembre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. El 3 de desembre de 2018 va finalitzar el termini per a presentar sol·licituds per a l'esmentada convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5. A aquesta resolució de la convocatòria es va a&lt;/span&gt;&lt;span style="color:#000000"&gt;utoritzar la despesa dimanant per &lt;/span&gt;&lt;span style="color:#000000"&gt;un import total de TRES-CENTS CINQUANTA MIL EUROS (350.000,00 €) amb càrrec a la partida 40.23128.48003 del vigent pressupost de despeses de l’IMAS (referència comptable A 22018018195).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El 17 de desembre de 2018 va entrar als servei Jurídicoadministratiu l'informe proposta de la Cap del servei de la Direcció Insular de persones amb discapacitat amb el vist-i-plau del Vicepresident primer de l'IMAS, per tramitar l'atorgament de les ajudes econòmiques esmentades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fonaments de dret: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vist el Text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 140, de 5 de novembre de 2016) aprovat per acord del Ple del Consell de Mallorca de data 13 d'octubre de 2016, en especial l'establert al seu article 2, d'acord amb el qual aquest&lt;span style="color:#000000"&gt; organisme té com a objecte fonamental l'exercici, en forma directa i descentralitzada, de les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i menors&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'IMAS en el marc de les seves competències i de l'activitat de foment pròpia de les administracions públiques, vol promoure accions dirigides a donar suport a entitats que desenvolupen activitats de suport &lt;span style="color:#000000"&gt;a la funció tutelar de persones amb discapacitat intel·lectual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vista la Llei 12/1993, de 20 de desembre, d’atribució de competències als consells insulars en matèria de serveis socials i assistència social, les atribuïdes per la Llei 14/2001, de 23 d’octubre, d’atribució de competències als consells insulars en matèria de serveis socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Atesa la Llei 4/2009, d’11 de juny, de serveis socials de les Illes Balears que estableix com a principis rectors del sistema de serveis socials balear la descentralització i la desconcentració.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D’acord amb la Llei 38/2003, General de Subvencions, amb caràcter previ a l’atorgament de les subvencions, s’han d’aprovar les normes que estableixin les bases reguladores de concessió en els termes que preveu la Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Vista l'Ordenança General de Subvencions (BOIB núm. 21 de 18 de febrer de 2017) aprovada mitjançant acord del Ple del Consell de Mallorca de 23 de desembre de 2016, així com les seves modificacions aprovades per l'acord del Ple del Consell de Mallorca de 14 de juny de 2018 i publicades al BOIB núm 96 de 4-08-2018, en especial referència a l'establert al seu article 1 que determina que té per objecte regular el règim jurídic general de les subvencions atorgades pel Consell Insular de Mallorca, els organismes autònoms que en depenen i les entitats de dret públic amb personalitat jurídica pròpia vinculades o dependents que atorguin subvencions dins l’exercici de potestats administratives. Així com, vist que aquesta Ordenança dóna compliment al previst al Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions adequant, d'acord amb la Disposició addicional segona d'aquest Decret legislatiu, l'activitat de concessió de subvencions del Consell a l'establert a la mateixa Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb la &lt;span style="color:#000000"&gt;convocatòria&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;pública d'&lt;/span&gt;&lt;span style="color:#000000"&gt;ajudes econòmiques adreçades &lt;/span&gt;&lt;span style="color:#000000"&gt;a entitats &lt;/span&gt;&lt;span style="color:#000000"&gt;que duen a terme activitats de suport a l'habitatge per a persones amb discapacitat intel·lectual per a l'any 2018, publicada al BOIB núm 151 d'1 de setembre de 2018, i rectificada per la resolució de la presidenta de 3 de desembre de 2018 i publicada al BOIB núm 156 de 13 de desembre de 2018, en especial els punts 10 i 11 referents a la instrucció i resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'acord amb l'article 3 dels Estatuts de l'IMAS, aquest organisme té personalitat jurídica pròpia i la capacitat d'obrar necessària per complir els seus fins.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L’article 7.2 g) dels Estatuts de l'IMAS que estableixen que correspon a la Presidència aprovar i resoldre els procediments d'ajudes i subvencions relatives a les competències atribuïdes a l'IMAS. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Els Servei Jurídicoadministratiu de l'IMAS i la Intervenció Delegada han emès els corresponents informes favorables per a la seva tramitació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Per&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;tot&lt;span style="color:#000000"&gt; &lt;/span&gt;això,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;RESOLC&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Primer.&lt;/span&gt;&lt;span style="color:#000000"&gt; ATORGAR les ajudes econòmiques a les següents entitats &lt;/span&gt;&lt;span style="color:#000000"&gt;que duen a terme activitats de suport a la funció tutelar de persones amb discapacitat intel·lectual per a l’any 2018.,&lt;/span&gt;&lt;span style="color:#000000"&gt; pels conceptes i pels imports que seguidament es ressenyen, així com DISPOSAR en el seu favor una despesa per un import total de TRES-CENTS VUIT MIL SIS-CENTS TRETZE EUROS AMB SETANTA-CINC CÈNTIMS&lt;/span&gt;&lt;span style="color:#000000"&gt; (308.613,75€) &lt;/span&gt;&lt;span style="color:#000000"&gt;del vigent pressupost de despeses de l’IMAS i cancel·lar l'autorització de la despesa per la diferència (núm. relació Q/2018/1878):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 27.1 del Text consolidat dels Estatuts de l'IMAS aprovat pel Ple del Consell de Mallorca de data &lt;/span&gt;&lt;span style="color:#000000"&gt;13 d'octubre de 2016 (BOIB núm. 140, de 5 de novembre de 2016)&lt;/span&gt;&lt;span style="color:#000000"&gt;, recurs d’alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d’un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació expressa del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l’esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació per silenci del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, &lt;/span&gt;&lt;span style="color:#000000"&gt;en qualsevol moment&lt;/span&gt;&lt;span style="color:#000000"&gt; a partir del dia següent a la desestimació presumpta (tres mesos des de la&lt;/span&gt;&lt;span style="color:#000000"&gt; interposició del recurs sense que s’hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;No obstant l’anterior, es pot exercitar, si n’és el cas, qualsevol altre recurs que s’estimi pertinent. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la Jurisdicció Contenciosa Administrativa, i de la Llei &lt;/span&gt;&lt;span style="color:#000000"&gt;39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques&lt;/span&gt;&lt;span style="color:#000000"&gt;.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
