Aquesta convocatòria es va publicar al BOIB núm 118 de 25 de setembre de 2018</span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3. A aquesta resolució es va a</span><span style="color:#000000">utoritzar la despesa dimanant d'aquest expedient per l’import total de quatre-cents mil euros (300.000,00 €), amb càrrec a la </span><span style="color:#000000">partida 40.23142.48905 del vigent pressupost de despeses de l’IMAS (referència comptable 222017012609).</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. El 17 d'octubre de 2018 va finalitzar el termini per a presentar sol·licituds per a l'esmentada convocatòria.</span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">5.</span><span style="color:#000000"> </span><span style="color:#000000">Una</span><span style="color:#000000"> </span><span style="color:#000000">vegada</span><span style="color:#000000"> </span><span style="color:#000000">revisades</span><span style="color:#000000"> </span><span style="color:#000000">les</span><span style="color:#000000"> </span><span style="color:#000000">sol·licituds</span><span style="color:#000000"> </span><span style="color:#000000">admeses</span><span style="color:#000000"> </span><span style="color:#000000">i</span><span style="color:#000000"> </span><span style="color:#000000">esmenades,</span><span style="color:#000000"> </span><span style="color:#000000">si</span><span style="color:#000000"> </span><span style="color:#000000">era</span><span style="color:#000000"> </span><span style="color:#000000">possible,</span><span style="color:#000000"> </span><span style="color:#000000">les</span><span style="color:#000000"> </span><span style="color:#000000">deficiències</span><span style="color:#000000"> </span><span style="color:#000000">que</span><span style="color:#000000"> </span><span style="color:#000000">presentaven,</span><span style="color:#000000"> </span><span style="color:#000000">la</span><span style="color:#000000"> </span><span style="color:#000000">Comissió</span><span style="color:#000000"> </span><span style="color:#000000">Avaluadora</span><span style="color:#000000"> </span><span style="color:#000000">es</span><span style="color:#000000"> </span><span style="color:#000000">va</span><span style="color:#000000"> </span><span style="color:#000000">reunir</span><span style="color:#000000"> </span><span style="color:#000000">el</span><span style="color:#000000"> 16 de novembre de 2018. </span><span style="color:#000000">Aplicats</span><span style="color:#000000"> </span><span style="color:#000000">els</span><span style="color:#000000"> </span><span style="color:#000000">criteris</span><span style="color:#000000"> </span><span style="color:#000000">de</span><span style="color:#000000"> </span><span style="color:#000000">valoració</span><span style="color:#000000"> </span><span style="color:#000000">establerts</span><span style="color:#000000"> </span><span style="color:#000000">a</span><span style="color:#000000"> </span><span style="color:#000000">les</span><span style="color:#000000"> </span><span style="color:#000000">bases</span><span style="color:#000000"> </span><span style="color:#000000">i</span><span style="color:#000000"> </span><span style="color:#000000">a</span><span style="color:#000000"> </span><span style="color:#000000">la</span><span style="color:#000000"> </span><span style="color:#000000">convocatòria,</span><span style="color:#000000"> </span><span style="color:#000000">va</span><span style="color:#000000"> </span><span style="color:#000000">formular</span><span style="color:#000000"> </span><span style="color:#000000">la</span><span style="color:#000000"> </span><span style="color:#000000">corresponent</span><span style="color:#000000"> </span><span style="color:#000000">proposta</span><span style="color:#000000"> </span><span style="color:#000000">de</span><span style="color:#000000"> </span><span style="color:#000000">resolució, proposant atorgar les ajudes a 25 de les entitats n sol·licitants i denegant una de les sol·licituds presentades.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. El 27 de novembre de 2018 va entrar als servei Juridicoadministratiu l'informe proposta de la Cap del servei de la Direcció Insular de persones amb discapacitat, perquè es facin les gestions oportunes per tal d'atorgar les ajudes econòmiques d'aquesta convocatòria.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. El Servei Jurídicoadministratiu i la Intervenció Delegada de l'IMAS han emès els informes favorables corresponents. </span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Fonaments de dret: </span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Vist el Text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 140, de 5 de novembre de 2016) aprovat per acord del Ple del Consell de Mallorca de data 13 d'octubre de 2016, en especial l'establert al seu article 2, d'acord amb el qual aquest<span style="color:#000000"> organisme té com a objecte fonamental l'exercici, en forma directa i descentralitzada, de les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i menors</span>.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">L'IMAS en el marc de les seves competències i de l'activitat de foment pròpia de les administracions públiques, vol promoure accions dirigides a donar suport a entitats que sense ànim de lucre desenvolupen activitats de serveis socials dirigides a diferents perfils socials, mitjançant activitats de caràcter preventiu, d'informació, atenció i suport social, psicològic i emocional a persones afectades per situacions que generen vulnerabilitat, dependència, risc d’aïllament, discriminació, marginació i exclusió social, així com, activitats d’inserció, rehabilitació i integració sociolaboral de persones i/o col·lectius amb dificultats socials, més desfavorits i/o exclosos socialment; així com actuacions que complementin programes d’assistència, inserció i reinserció social de l’Institut Mallorquí d’Afers Socials i/o dels serveis socials d’atenció primària que es gestionin des de l’àmbit municipal.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Vista la Llei 12/1993, de 20 de desembre, d’atribució de competències als consells insulars en matèria de serveis socials i assistència social, les atribuïdes per la Llei 14/2001, de 23 d’octubre, d’atribució de competències als consells insulars en matèria de serveis socials.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Atesa la Llei 4/2009, d’11 de juny, de serveis socials de les Illes Balears que estableix com a principis rectors dels sistema de serveis socials balear la descentralització i la desconcentració.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><span style="color:#000000">Vist el Text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 140, de 5 de novembre de 2016) aprovat per acord del Ple del Consell de Mallorca de data 13 d'octubre de 2016, i d'acord amb l'article 2.c) i d), l'IMAS té d'entre les seves funcions </span><span style="color:#000000">desenvolupar polítiques de protecció i atenció a persones deprenents.</span></span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">D’acord amb la Llei 38/2003, General de Subvencions, amb caràcter previ a l’atorgament de les subvencions, s’han d’aprovar les normes que estableixin les bases reguladores de concessió en els termes que preveu la Llei.</span></span></span></p> <p style="margin-bottom:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Vista l'Ordenança General de Subvencions (BOIB núm. 21 de 18 de febrer de 2017) aprovada mitjançant acord del Ple del Consell de Mallorca de 23 de desembre de 2016, així com les seves modificacions aprovades per l'acord del Ple del Consell de Mallorca de 14 de juny de 2018 i publicades al BOIB núm 96 de 4-08-2018, en especial referència a l'establert al seu article 1 que determina que té per objecte regular el règim jurídic general de les subvencions atorgades pel Consell Insular de Mallorca, els organismes autònoms que en depenen i les entitats de dret públic amb personalitat jurídica pròpia vinculades o dependents que atorguin subvencions dins l’exercici de potestats administratives.
