    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0.21cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De conformitat amb l'acord plenari d'aquest Ajuntament sobre les modificacions puntuals de les ordenances fiscals, i en compliment de l'article 17.4 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret Legislatiu 2/2004, de 5 de març, es publica el text íntegre de la següent ordenança fiscal (incloent-hi les modificacions aprovades):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&amp;nbsp;«&lt;strong&gt;ORDENANÇA FISCAL REGULADORA DE LA TAXA PELS SERVEIS DE RETIRADA DE VEHICLES O OBJECTES PESANTS O VOLUMINOSOS DE LA VIA PÚBLICA I DE CUSTÒDIA D’AQUESTS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 1.- Naturalesa, objecte i fonament&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Fent ús de les facultats concedides pels articles 133.2 i 142 de la Constitució, i per l’article 106 de la Llei 7/1985, de 2 d’abril, reguladora de les bases de règim local, i de conformitat amb el que disposen els articles 15 a 19, del Text refós de la Llei reguladora de les hisendes locals (RDL 2/2004, de 5 de març), aquest ajuntament estableix la taxa pels serveis de retirada de vehicles o objectes pesants o voluminosos de la via pública i de custòdia d’aquests, que es regeix per aquesta ordenança fiscal, les normes de la qual s’atenen a allò que s’ha previst en l’article 57 en relació amb l’article 20.4 lletra z) d’aquest text refós.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Constitueix l’objecte d’aquesta exacció:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) L’activitat de la grua provocada per qui ha estacionat un vehicle indegudament o per qui ha deixat a la via pública qualsevol objecte pesant o voluminós que pertorba la fluïdesa de la circulació rodada o de vianants que fa necessària aquella acció, o per qualsevol activitat singular de la Policia Local que requereixi la grua. Aquesta activitat té com a finalitat retirar el vehicle o objecte de què es tracti i traslladar-lo al dipòsit municipal o al lloc que es determini.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) L’estada o la custòdia del vehicle o objecte retirat per la grua al dipòsit o al lloc on hagin estat traslladats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 2.- Obligació de contribuir&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Fet imposable: Està determinat per l’activitat municipal desenvolupada amb motiu dels fets que constitueixen l’objecte d’aquesta exacció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Obligació de contribuir: L’obligació de contribuir neix des del moment en què s’inicia la retirada del vehicle o de l’objecte de què es tracti de la via pública i subsisteixi encara que aquesta retirada no arribi a dur-se a terme perquè el conductor o una altra persona autoritzada compareixen i adopten les mesures convenients.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Subjecte passiu: Estan obligats a pagar les persones físiques i jurídiques i les entitats a què es refereix l’article 35.4 de la Llei 58/2003, de 17 de desembre, general tributària, que hagin donat lloc a la prestació del servei i, amb caràcter subsidiari, les que siguin propietàries del vehicle o l’objecte retirat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 3.- Base del gravamen&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Es prenen com a bases d’aquesta exacció:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) La unitat del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Per dia d’estada al dipòsit municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 4- Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Responen solidàriament de les obligacions tributàries del subjecte passiu les persones físiques i jurídiques a què es refereixen els articles 41 i 42 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Són responsables subsidiaris els administradors de les societats i els síndics, interventors o liquidadors de fallides, concursos, societats i entitats en general, en els supòsits i amb l’abast que assenyala l’article 43 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Normes de gestió&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Compatibilitat: Aquesta exacció és independent i compatible amb les multes establertes en el Codi de circulació, ordenances de circulació, ordenances d’aquest ajuntament o qualsevol altra disposició vigent en cometre la infracció, en estacionar el vehicle indegudament al lloc d’on l’ha retirat la grua municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Casos de no-subjecció: No estan subjectes a pagar la taxa:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Els casos d’utilització il·legítima del vehicle per qui l’ha estacionat al lloc d’on ha estat retirat per la grua, sempre que la desaparició del vehicle hagi estat denunciada pel seu propietari o quedi prou provada la il·legitimitat d’haver-lo utilitzat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Quan el vehicle hagi estat estacionat en lloc permès i hagi sobrevingut una causa que hagi fet necessària la intervenció de la grua municipal per traslladar-lo (urgent obertura de rases, desfilades, processons, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Terminis i forma de pagament: Les quotes establertes s’han d’abonar en el moment de recuperar el vehicle o objecte retirat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Article 8&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Pel que fa a tot el que es refereix a la qualificació d’infraccions tributàries, així com a les sancions que corresponguin en cada cas, cal aplicar-hi el règim regulat en la Llei general tributària i en les altres disposicions que la complementin i la desenvolupin. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm; margin-right:-0.04cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓ FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.18cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquesta ordenança fiscal entra en vigor l’1 de gener de 2010 o el següent dia hàbil d’haver-se’n publicat l’aprovació definitiva en el BOIB, si aquesta és posterior a aquell dia, i serà vigent fins que es modifiqui o es derogui expressament.» &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
