    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aprovada provisionalment pel Ple de l’Ajuntament, en sessió de 4 d’octubre de 2018, l’ordenança reguladora del servei de recollida de fems, ha estat exposada al públic durant trenta dies hàbils sense que s’hagin presentat reclamacions. D’acord amb l'establert a l’article 17 del Real Decret Legislatiu 2/2004 pel que s’aprova el Text refòs de la Llei Reguladora de les Hisendes Locals, l’acord s’enten definitivament adoptat i s’en publica el seu text íntegre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ORDENANÇA FISCAL REGULADORA DE LA TAXA PER RECOLLIDA DE FEMS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonament i naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 1&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l’article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, i conformement al que disposen els articles 15 a 19 de RDL 2/2004 de 5 de març, Text Refós de la Llei reguladora de les hisendes locals, aquest Ajuntament estableix la taxa per la prestació del servei de recollida de fems, que es regirà per la present Ordenança fiscal, les normes de la qual atenen el que estableix l'article 58 del l’esmentat R.D. 2/2004.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fet imposable&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Constitueix el fet imposable de la taxa la prestació de serveis i recepció obligatòria de recollida, acumulació, conducció i eliminació de fems domiciliaris i residus sòlid urbans de vivendes, allotjaments i locals o establiments on s’exerceixin activitats industrials, comercials, professionals, artístiques i de serveis.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A aquest efecte, es consideraran fems domiciliaris i residus sòlids urbans les restes i les deixalles d’alimentació o detritus procedents de la neteja normal de locals i vivendes i se n’exclouen els residus de tipus industrial, enderrocs d’obres, detritus humans, matèries o materials contaminats, corrosius, perillosos, la recollida o abocament dels quals exigeixi l’adopció de mesures higièniques especials, profilàctiques o de seguretat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. No es troba subjecte a la taxa la prestació, de caràcter voluntari i a instància de part, dels serveis següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Recollida de fems i residus no qualificats de domiciliaris i urbans d’indústries, hospitals i laboratoris.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Recollida d’escòries i cendres de calefaccions centrals.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Recollida d’enderrocs d’obres.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Subjecte passiu&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Són subjectes passius com a contribuents, les persones físiques o jurídiques i les entitats referides a l’art. 35.4 de la Llei general tributària que ocupin o utilitzin les vivendes i locals situats als llocs, places, carrers o vies públiques on es presti el servei, ja sigui a títol de propietari o d’usufructuari, allotjat, arrendatari o, fins i tot, precari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Tendrà la consideració de subjecte passiu substitut del contribuent el propietari de les vivendes o locals que podrà repercutir, si s’escau, les quotes satisfetes sobre els usuaris de les vivendes o locals, beneficiaris del servei.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 4&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Respondran solidàriament de les obligacions tributàries del subjecte passiu les persones físiques i jurídiques referides als articles 41 i 42 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Seran responsables subsidiaris els administradors de les societats o síndics, interventors o liquidadors de fallides, concursos, societats i entitats en general, en els supòsits i amb l’abast que assenyala l’art. 43 de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quota tributària&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 5&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La quota tributària consistirà en una quantitat fixa, per unitat de local, que es determinarà en funció de la naturalesa i destinació dels immobles, d’acord amb les tarifes contingudes en l’annexa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Les quotes assenyalades tenen caràcter irreductible i anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Meritació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 6&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. S’acredita la taxa i neix l’obligació de contribuir des del moment en que s’inicia la prestació del servei, i s’entén com iniciada, donada la seva naturalesa de recepció obligatòria, quan estigui establert i en funcionament el servei municipal de recollida domiciliària de fems als carrers i llocs on figurin les vivendes o locals utilitzats pels contribuents subjectes a la taxa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. D’acord amb l’establert a l’article 26.2 del R.D. 2/2004 , la taxa de fems té una meritació periòdica ,aquesta es produeix l´1 de gener de cada any, el període impositiu compren l’any natural, excepte en els casos d'inici o finalització de l'ús del servei, el període impositiu s’ajustarà a aquesta circumstància amb el prorrateig corresponent d'acord amb l’establert a les normes següents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Quan s'iniciï l’ús en el primer semestre de l'any s'abonarà en concepte de taxa corresponent a aquell exercici la quota íntegra. Si l'inici es produeix en el segon semestre es liquidarà la meitat de la quota anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Si es produeix la finalització de l'ús durant el primer semestre de l'exercici serà procedent la devolució de la meitat de la quota. Si la finalització de l'ús es produeix dins el segon semestre no procedirà devolució de cap quantitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. S'entendrà que una vivenda inicia l'ús del servei quan adquireixi les condicions necessàries per ésser habitable . S'entendrà que una vivenda finalitza l'ús del servei quan es declari en runes o perdi les condicions per ésser habitable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Declaració i ingrés&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 7&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Dins els trenta dies hàbils següents a la data que es pagui per primera vegada la taxa, els subjectes passius formalitzaran la seva inscripció en matrícula, presentant, per a això, la corresponent declaració d’alta i ingressant simultàniament la quota que els correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Quan es conegui, ja d’ofici o per comunicació dels interessats, qualsevol variació de les dades que figuren en la matrícula, es portaran a cap les modificacions corresponents, que produiran efectes a partir del període de cobrament següent al de la data en què s’hagi efectuat la declaració.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Infraccions i sancions&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;ARTICLE 8&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En tot allò que es relacioni amb la qualificació d’infraccions tributàries, així com les sancions que els corresponguin en cada cas, s’estarà al que disposen els articles 77 i següents de la Llei general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els subjectes passius que participin en els programes de recollida selectiva de la fracció orgànica de l’Ajuntament de Capdepera tindran dret a tarifa reduïda de 15 €/T de residus orgànics, amb un màxim del 14% del rebut corresponent sempre i quan es realitzi correctament dins bosses compostables la separació dels residus orgànics. Aquesta tarifa reduïda es podrà sol·licitar a partir de l’1 de gener de l’exercici següent al de la realització del fet imposable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
