&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;1. Per Acord del Consell de Govern de 22 de maig de 2009 es va aprovar el Decret 30/2009, de 22 de maig, pel qual s’aprova el procediment de selecció de personal funcionari interí al servei de l’Administració especial&lt;strong&gt; &lt;/strong&gt;de la Comunitat Autònoma de les Illes Balears (BOIB núm. 78, de 30 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;2. L’article 3.10 d’aquest Decret estableix que, si s’exhaureix una borsa de personal funcionari interí i no hi ha borses anteriors, abans d’aplicar el procediment extraordinari i només fins a la constitució definitiva de la borsa de feina que es farà quan acabi el procés selectiu de personal funcionari d’un determinat cos, escala o especialitat, es podrà utilitzar la relació de les persones aspirants que hagin aprovat alguna de les proves o exercicis realitzats fins aquell moment, d’acord amb l’ordre de prelació que recull l’article 3.4 del Decret esmentat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;3. Actualment, l'Administració de la Comunitat Autònoma de les Illes Balears, a l'illa de Mallorca, no disposa de cap borsa&amp;nbsp; extraordinària del cos facultatiu superior, escala de tecnologies de la informació i telecomunicació, especialitat informàtica per poder proveir llocs de feina adscrits a aquesta especialitat, atès que es troba exhaurida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;Aquesta borsa fou aprovada per la &lt;/span&gt;&lt;span style="color:#231f20"&gt;Resolució de 12 de juliol&amp;nbsp; de 2017&amp;nbsp; (BOIB núm. 92, de 29 de juliol de 2017), en l'esmentada borsa no hi ha cap persona, en la situació de disponible.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;4. Tot això fa que, d'acord amb l'article 3.10 del Decret 30/2009, sigui necessari constituir una borsa temporal a l'efecte de poder proveir llocs de feina.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;Aquesta és una mesura excepcional i provisional, que té com a finalitat fonamental satisfer l'interès públic, la qual no s'estendrà més enllà de la data en què finalitzi el procediment per a l'accés al cos facultatiu superior, escala de tecnologies de la informació i la telecomunicació, especialitat informàtica, de l’Administració especial&lt;strong&gt; &lt;/strong&gt;de la Comunitat Autònoma de les Illes Balears a l'illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;5. En el cas que l'Administració hagi d'acudir a la borsa temporal que s'aprova amb aquesta Resolució, les persones que la integren poden acceptar o refusar l'oferiment; en aquest darrer cas, la renúncia de l'oferiment no suposa l'exclusió de la borsa definitiva, que s'ha de constituir una vegada finalitzat el procediment selectiu d'ingrés, i que tindrà la naturalesa de borsa ordinària d'acord amb el que disposa el Decret 30/2009.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#00000a"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;1. L’article 16 &lt;/span&gt;&lt;em&gt;&lt;span style="color:#00000a"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#00000a"&gt; de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;2. L’article 6.3&lt;/span&gt;&lt;em&gt;&lt;span style="color:#00000a"&gt; c)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#00000a"&gt; de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;3. La Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;4. La Llei 7/2007, de 12 d’abril, de l’Estatut bàsic de l’empleat públic.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;5. El Decret 30/2009, de 22 de maig, pel qual s’aprova el procediment de selecció de personal funcionari interí al servei de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;6. La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;7. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#00000a"&gt;Proposta de resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:#00000a"&gt;Propòs a la consellera d’Hisenda i Administracions Públiques que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;1. Acordar la constitució d'una borsa de personal funcionari interí a partir de la relació de les persones aspirants que han aprovat el primer exercici per a l'accés, pel torn lliure&lt;span style="background-color:white"&gt;,&lt;/span&gt; al cos facultatiu superior, escala de tecnologies de la informació i la telecomunicació, especialitat informàtica de l’Administració especial de la Comunitat Autònoma de les Illes Balears a l'illa de Mallorca, dut a terme el 20 d'octubre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;2. Establir que la vigència d'aquesta borsa és des de l’endemà de la publicació d’aquesta resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#00000a"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#00000a"&gt; fins &lt;span style="background-color:white"&gt;a&lt;/span&gt; la data en què es constitueixi la borsa mitjançant el procediment ordinari, una vegada &lt;span style="background-color:white"&gt;que&lt;/span&gt; hagi conclòs el procés selectiu d'accés al cos facultatiu superior, escala de tecnologies de la informació i la telecomunicació, especialitat informàtica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;3. Determinar que l'Administració de la Comunitat Autònoma de les Illes Balears només pot nomenar interinament a les persones integrants d'aquesta borsa temporal en el supòsit que, atesos els requisits establerts per la relació de llocs de feina, el lloc de feina en qüestió no pugui ser ocupat per alguna persona integrant de la borsa extraordinària del cos facultatiu superior, escala de tecnologies de la informació i la telecomunicació, especialitat informàtica, aprovada per la Resolució d&lt;/span&gt;&lt;span style="color:#231f20"&gt;e 12 de juliol de 2017 (BOIB núm. 92, de 29 de juliol de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#231f20"&gt;4. A&lt;/span&gt;&lt;span style="color:#00000a"&gt;djuntar la composició de la borsa de personal funcionari interí, &lt;span style="background-color:white"&gt;amb indicació de totes les persones integrants, l’ordre de prelació i la puntuació obtinguda, que figura en l’annex d’aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;5. Publicar aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="color:#00000a"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#00000a"&gt;, a la pàgina web del Govern de les Illes Balears i al tauler d’anuncis de l’Escola Balear d'administració Pública (EBAP).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#00000a"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant el mateix òrgan que la dicta en el termini d’un mes comptador des de l’endemà d’haver-ne rebut la notificació, d’acord amb els articles 123 i 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques, i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració especial de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#00000a"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma en el termini de dos mesos comptadors des de l’endemà d’haver rebut la notificació de la resolució, d’acord amb els articles 8.2 i 46.1 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
