&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;« Resolució de la Presidenta de l'Institut Mallorquí d'Afers Socials per la qual es convoca el primer &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;concert social del servei d'atenció integral i promoció de l'autonomia per a persones amb discapacitat física&lt;span style="background-color:#ffffff"&gt;, inclòs a la xarxa pública de serveis per a persones amb discapacitat de Mallorca&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;1.&lt;/strong&gt; En data 5 de març de 2018, la Presidenta de l'Institut Mallorquí d'Afers Socials ha resolt: «&lt;em&gt;Resolució de la Presidenta de l'IMAS per la qual estableix els serveis socials per a persones amb discapacitat i per a persones majors, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social»&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;strong&gt; &lt;/strong&gt;En data 24 de setembre de 2018 va entrar en el Servei Jurídic-administratiu una sol·licitud del responsable de servei de la direcció insular de Persones amb Discapacitat, pel qual es sol·licita la tramitació del primer concert social del Servei d'Atenció Integral i Promoció de l'Autonomia per a persones amb discapacitat física a l'àmbit territorial de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Que el servei objecte de&lt;/span&gt;&lt;span style="color:#000000"&gt;l present concert é&lt;/span&gt;&lt;span style="color:#000000"&gt;s el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;"S&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ervei &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d'atenció integral i promoció de l'autonomia per a persones amb discapacitat &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;física&lt;/em&gt;".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;4.&lt;/strong&gt; &lt;span style="color:#000000"&gt;El Servei Jurídicoadministratiu i la Intervenció Delegada han emès els informes corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Fonaments de dret.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; Vist el Text consolidat dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 140, de 5 de novembre de 2016) aprovat per acord del Ple del Consell de Mallorca de data 13 d'octubre de 2016, en especial l'establert al seu article 2, punt 3, d'acord amb el qual aquest organisme té com a objecte exercir qualsevol altra competència que li encomani el Consell directament, mitjançant delegació o comanda, o, indirectament, a través de conveni amb altres ens territorials o institucionals amb finalitats coincidents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;La Directiva 2014/24/UE del Parlament Europeu i del Consell, de 26 de febrer de 2014, sobre contractació pública, estableix, en els considerants tercer, quart, cinquè i sisè, que a l’hora d’aplicar aquesta norma s’han de tenir especialment en compte els drets de les persones amb discapacitat, i que els Estats membres gaudeixen de llibertat per organitzar la prestació dels serveis socials al marge de la contractació pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Per altra banda, en el seu considerant 114 estableix que els Estats membres i els poder públics segueixen tenint llibertat per prestar per si mateixos aquest serveis i organitzar els serveis socials de manera que no sigui necessari celebrar contractes públics, per exemple, mitjançant el finançament d'aquests serveis o la concessió de llicències o autoritzacions a tots els operadors econòmics que compleixin les condicions prèviament fixades pel poder adjudicador, sense límits ni quotes, sempre que aquest sistema garanteixin una publicitat suficient i s'ajusti als principis de transparència i no discriminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;En aquest sentit, l'article 11, apartat 6, de la Llei 9/2017, 8 de novembre, de Contractes del Sector Públic, estableix que: &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;«6. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;Queda exclosa de la present Llei la prestació de serveis socials per entitats privades, sempre que aquesta es realitzi sense necessitat de celebrar contractes públics, a través, entre altres mitjans, del simple finançament d'aquests serveis o la concessió de llicències o autoritzacions a totes les entitats que compleixin les condicions prèviament fixades pel poder adjudicador, sense límits ni quotes, i que aquest sistema garanteixi una publicitat suficient i s'ajusti als principis de transparència i no discriminació&lt;/em&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La disposició addicional segona del Decret 48/2017 de 27 d'octubre, disposa que el «&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El règim de concert regulat en aquest Decret s’estableix com a diferenciat de la modalitat contractual de concert que regula el Text refós de la Llei de contractes del sector públic, aprovat pel Reial decret legislatiu 3/2011, de 14 de novembre, i, per tant, està exclòs de l’àmbit d’aplicació d’aquest Text refós&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; L’article 89.1 de la Llei 4/2009, d’11 de juny, de serveis socials de les Illes Balears, estableix que &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;“les administracions públiques de les Illes Balears, en l’àmbit de les seves competències, poden organitzar la prestació dels serveis del Catàleg de Prestacions i Serveis Socials de les Illes Balears a través de les fórmules següents: gestió directa, règim de concert previst en aquesta Llei, gestió indirecta en el marc de la normativa de contractació de les administracions públiques i convenis amb entitats sense ànim de lucre&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L’article 89 &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;bis &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;d’aquesta norma disposa que les entitats d’iniciativa privada que ofereixen serveis socials prevists en la cartera de serveis i/o en la planificació autonòmica o insular es poden acollir al règim de concerts en els termes que estableix aquesta Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Segons l’article 2 del Decret 48/2017 de 27 d'octubre, pel qual s’estableixen els principis generals als quals s’han de sotmetre els concerts socials, els poders públics, a fi de garantir la prestació dels serveis socials prevists en la cartera de serveis o en la planificació autonòmica o insular, poden subscriure concerts socials amb les entitats d'iniciativa privada que siguin titulars dels serveis, sempre que aquests serveis compleixin els requisits establerts en la Llei 4/2009. &lt;/span&gt;&lt;span style="color:#000000"&gt;Es considera oportú aplicar el procediment previst al Títol III del Decret 48/2017, de 27 de octubre, relatiu als «&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Procediments de concertació&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;», que comprèn dels articles 12 al 27, atesa la necessitat urgent d'assegurar la continuïtat del tractament de les persones amb discapacitat referides.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; L’article 14 de la Llei 14/2001, de 29 d’octubre, d’atribució de competències als consells insulars en matèria de serveis socials i seguretat social, estableix la potestat reglamentària normativa atribuïda als consells insulars en matèria de serveis socials, dins el marc de la regulació bàsica establerta pel Govern de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;L’Institut Mallorquí d’Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Benestar i Drets Socials del Consell de Mallorca, és l’organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; Com s'estableix a l'article 27 i a la Disposició final quarta de la Llei 4/2009, cada Consell Insular, en el marc de les seves competències, ha de definir les prestacions pròpies de serveis socials, complementant la cartera bàsica de serveis socials que aprova el Govern de les Illes Balears, la qual va ser aprovada mitjançant el Decret 66/2016, de 18 de novembre, pel qual s'estableixen principis generals per a les carteres insulars i locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.&lt;/strong&gt; En Ple del Consell de Mallorca del 13 de juliol de 2017 es dona aprovació definitiva al reglament pel qual s'aprova la Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca (BOIB núm. 97, de 18 de juliol de 2017 i correcció d'errades materials publicada BOIB núm. 161, de 30 de desembre de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; El 8 de febrer de 2018 s’aprova al Ple &lt;/span&gt;&lt;span style="color:#000000"&gt;del Consell de Mallorca el reglament pel qual es regula el funcionament dels serveis socials per a persones amb discapacitat inclosos a la Cartera Insular de serveis socials, i s’estableixen els requisits d’autorització i acreditació.&lt;/span&gt;&lt;span style="color:#000000"&gt; Aquesta normativa estableix, entre d’altres, les condicions tècniques i materials i els requisits de qualitat dels serveis de serveis socials per poder optar al règim de concert social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Resolució de la presidenta de l'Institut Mallorquí d'Afers Socials per la qual estableix els serveis socials per a persones amb discapacitat i per a persones majors, inclosos a la cartera insular de serveis socials, que poden ser objecte de concertació social (BOIB Núm. 36, de 22 de març de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;L’òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d’acord amb l’article 7.3 del Text Refós dels Estatuts de l’IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;RESOLUCIÓ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;P&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;RIMER&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; CONVOCAR el primer concert social i ESTABLIR el procediment de la convocatòria per al &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Servei d’atenció integral i promoció de l’autonomia per a persones amb discapacitat &lt;/span&gt;&lt;span style="color:#000000"&gt;física&lt;/span&gt;&lt;span style="color:#000000"&gt;, d'acord amb el següent text:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;«Convocatòria de concert social del servei d'atenció integral i promoció de l'autonomia per a persones amb discapacitat física, inclòs a la xarxa pública de serveis per a persones amb discapacitat de Mallorca&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'objecte de la present convocatòria és fixar el procediment, els criteris de preferència, els requisits i les condicions del primer concert social del servei d’atenció integral i promoció de l’autonomia per a persones amb discapacitat física de la xarxa pública de serveis per a persones amb discapacitat de Mallorca &lt;/span&gt;&lt;span style="color:#000000"&gt;d'acord amb els plecs de prescripcions tècniques &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;que figuren en la seu electrònica del Consell&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, i que es dicta a l’empara del Decret 48/2017 de 27 d’octubre, pel qual s’estableixen els principis generals als quals s’han de sotmetre els concerts socials &lt;/span&gt;&lt;span style="color:#000000"&gt;(BOIB Núm. 132, de 28 d’octubre de 201&lt;/span&gt;&lt;span style="color:#000000"&gt;7&lt;/span&gt;&lt;span style="color:#000000"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;2. Àmbit territorial&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;L’àmbit territorial d’aquest concert social és l’Illa de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;3. Places a concertar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;La previsió del nombre total màxim de places a concertar, en el marc de la present convocatòria, del servei de servei d’atenció integral i promoció de l’autonomia per a persones amb discapacitat física és de 50 places.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Vigència del concert&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La vigència d’aquest concert serà de dos anys des de la formalització del present concert social del servei &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;d'atenció integral i promoció de l'autonomia per a persones amb discapacitat física&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; entre l'Institut Mallorquí d'Afers Socials i l'entitat, podent renovar-se pel mateix període.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Pressupost i preu màxim del servei&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L’import màxim estimat per assignar al concert és de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;500.808,00 euros&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; (IVA exempt), que es preveu distribuir entre les següents anualitats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-left:0.8cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El preu per plaça de la prestació del servei d’atenció integral i promoció de l’autonomia per a persones amb discapacitat física en aquest concert és de&lt;span style="color:#000000"&gt; &lt;/span&gt;417,34 € plaça/mes (IVA exempt) per 12 mesos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. Requisits de les entitats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Les entitats i serveis que vulguin optar a aquest primer concert social hauran de complir els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol style="list-style-type:lower-alpha"&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Complir els requisits mínims que s’estableixen en el títol VII de la Llei 4/2009, d'11 de juny, de Serveis Socials de les Illes Balears (BOIB núm. 89, de 18 de juny de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tenir el servei autoritzat per l’Institut Mallorquí d’Afers Socials (en endavant, l'IMAS), i estar inscrit el servei en el Registre Unificat de Serveis Socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tenir el servei acreditat o haver obtingut el reconeixement de l’acreditació de forma automàtica a la presentació d’una declaració responsable de compliment dels requisits d’acreditació, segons l’establert a&lt;/span&gt;&lt;span style="color:#000000"&gt; l&lt;/span&gt;&lt;span style="color:#000000"&gt;a disposició transitòria única&lt;/span&gt;&lt;span style="color:#000000"&gt; del Reglament del Consell de Mallorca pel qual es regula el funcionament dels serveis socials per a persones amb discapacitat inclosos en la cartera insular de serveis socials i s’estableixen els requisits d’autorització i acreditació. D'acord amb l'esmentat reglament, el reconeixement de l'acreditació s'estableix per un període màxim de 24 mesos mentre es resol la tramitació de l'acreditació, si bé en el cas que es detectés l'incompliment dels requisits d'acreditació l'IMAS podrà iniciar d'ofici el procediment de revocació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Tenir, com a mínim, un any d’experiència en la prestació del servei i perfil de persones usuàries objecte d’aquest concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Tenir solvència financera i tècnica per prestar el servei objecte del concert, que s'ha d'acreditar d'acord amb el punt 7.2 d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Estar al corrent en el compliment de les obligacions econòmiques amb el Consell de Mallorca i amb l’IMAS i de les altres obligacions tributàries i amb la Seguretat Social que venguin imposades per la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Que el servei a concertar no hagi rebut una resolució d’expedient sancionador en matèria de serveis socials de les que consten als articles 128 i 129 de la Llei 4/2009 de serveis socials de les Illes Balears durant els darrers 12 mesos anteriors al concert, i sempre i quan s’hagi satisfet el pagament de la sanció i s’acrediti davant l’orgue sancionador que s’han corregit les causes que motivaren la sanció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;No estar afectades per cap prohibició de contractar amb l'Administració, d'acord amb l'article 71 de la Llei 9/2017, de 8 de novembre, de Contractes del Sector Públic, ni a cap dels supòsits prevists a l'article 13 de la Llei 38/2003, de 17 de novembre, general de subvencions, o a la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;No incórrer en la prohibició que estableix l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;No haver estat sancionades en els darrers quatre anys mitjançant resolució ferma per la comissió d’infraccions greus o molt greus en matèria de relacions laborals, ocupació, empreses usuàries d’empreses de treball temporal, seguretat social, emigració, moviments migratoris i treball d’estrangers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Quan l’objecte del concert consisteixi en serveis que, d’acord amb la normativa vigent, s’hagin de prestar en un espai físic determinat, acreditar la titularitat del centre, o la disponibilitat per qualsevol títol jurídic vàlid per un període no inferior al de la vigència del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Acreditar el compliment de la normativa que, amb caràcter general o específic, els sigui aplicable, tant per la naturalesa jurídica de l’entitat com pel tipus de servei objecte de concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Presentació de sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;7.1. Lloc i termini de presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El termini per presentar les sol·licituds és de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;10&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; dies h&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;àbils comptadors des de l’endemà que s’hagi publicat aquesta convocatòria en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les entitats que compleixin els requisits generals i els específics d'aquesta convocatòria, o estiguin en condicions de complir-los en el termini de presentació de sol·licituds, poden presentar les sol·licituds d’acord amb els models normalitzats que figuren a la seu electrònica del Consell o que seran facilitats per l’IMAS a les oficines que s'indiquen o a la web &lt;/span&gt;www.imasmallorca.net&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les instàncies s’han de dirigir a la Presidència de l’IMAS i es poden presentar al Registre General de l’IMAS (C/ General Riera, 67 07010 - Palma) i a les delegacions d’Inca (C/ General Luque, 223. 1&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;r&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; pavelló esquerra, 1&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;er&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; pis 07300) i de Manacor C/ del Bon Jesús, 2 07500), així com a les oficines de Registre del Consell de Mallorca, o a qualsevol dels llocs que preveu la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Si la sol·licitud s’envia per correu, la documentació corresponent s’ha de presentar a l’oficina de correus en un sobre obert per tal que l’exemplar destinat a l’IMAS es dati i segelli per part del personal de correus abans que se certifiqui, d’acord amb el que disposa l’article 31 del Reial Decret 1829/1999, de 3 de desembre, pel qual s’aprova el Reglament que regula la prestació dels serveis postals (BOE núm. 313, de 31 de desembre). En el cas que l’oficina de correus corresponent no dati i segelli la sol·licitud, s’entendrà com a data vàlida de presentació la d’entrada al registre de l’IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cas que la sol·licitud s’enviï per correu certificat, s’haurà de trametre el full de la sol·licitud escanejat amb el segell de correus en què consti la tramesa dins termini, durant les 24 h següents a l’acabament d’aquest, a l’adreça electrònica que figura a continuació. Documentació que s'ha de presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Les entitats interessades que compleixin els requisits que estableix el punt 6 d’aquesta convocatòria han de formular una sol·licitud, d’acord amb el model disponible a la seu electrònica del Consell (MOD-1), que ha de signar la persona representant legal de l’entitat indicant expressament el nombre de places que sol·liciten concertar amb l'IMAS en el marc de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Aquesta sol·licitud s'ha d'acompanyar dels documents que es detallen a continuació. En aquest sentit, tots els models normalitzats que s'indiquen estan disponibles a la seu electrònica del Consell&lt;/span&gt;&lt;span style="color:#000000"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Declaració de solvència tècnica i experiència en la prestació del servei d’acord amb el model disponible a la seu electrònica del Consell (MOD-2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Declaració responsable de solvència financera, d’acord amb el model facilitat a la seu electrònica del Consell (MOD-3).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Declaració responsable emesa d'acord amb el model facilitat a la seu electrònica del Consell (MOD-4), on l'entitat ha de manifestar que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;/ul&gt;

	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Autorització per consultar les dades d’estar al corrent en les obligacions tributàries i de la Seguretat So&lt;span style="background-color:#ffffff"&gt;cial, d’acord amb el model facilitat a la seu electrònica del Consell (MOD-5).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Quan l’objecte del concert consisteixi en serveis que, d’acord amb la normativa vigent, s’hagin de prestar en un espai físic determinat: Acreditació de la titularitat del servei o de disponibilitat pel qualsevol títol jurídic vàlid a l'inici del concert. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Declaració de places ocupades i persones ateses pel servei mitjançant subvenció, concert o contracte amb l’IMAS al moment de la convocatòria o durant els 30 dies anteriors, d’acord amb el model facilitat a la seu electrònica del Consell (MOD-6).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La presentació de la sol·licitud suposa que l’entitat autoritza a l'equip tècnic de l'IMAS perquè puguin demanar a altres administracions qualsevol documentació, les dades i els informes que considerin necessaris per tramitar l’expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;7.3 Esmena de deficiències&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Si la sol·licitud no reuneix els requisits legals i els que es deriven de la present convocatòria del primer concert social d'aquest servei, s’ha de requerir l'entitat sol·licitant, d'acord amb el que estableix l'article 68 de la Llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques perquè, en un termini no superior a deu dies hàbils, esmeni la falta o acompanyi els documents preceptius, amb la indicació que, si no ho fa, es tindrà per desistida de la seva petició, prèvia resolució expressa en els termes que estableix l’article 21 d’aquesta Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;strong&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;8. Instrucció del procediment&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.1 Procediment dels concerts socials&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La convocatòria, la concessió i el seguiment dels concerts socials es regeixen per criteris de transparència i publicitat, de conformitat amb l'article 17 del Decret &lt;/span&gt;&lt;span style="color:#000000"&gt;48/2017 de 27 d’octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;8.2 &lt;/strong&gt;&lt;strong&gt;Òrgan competent per a la instrucció&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L'òrgan competent per instruir el procediment és el Director Insular de Persones amb Discapacitat de l'Institut Mallorquí d'Afers Socials, el&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; qual tindrà la prerrogativa d’interpretar-lo i resoldre’n els dubtes que sorgeixin durant el compliment&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.3 De la Comissió Avaluadora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La present Comissió Avaluadora actuarà de conformitat amb l'article 15 relatiu al «Comitè tècnic d'assessorament» del &lt;/span&gt;&lt;span style="color:#000000"&gt;Decret 48/2017 de 27 d’octubre, i conseqüentment tindrà els mateixos efectes que l'esmentat &lt;/span&gt;&lt;span style="color:#000000"&gt;Comitè Tècnic d'Assessorament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i. Composició&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;La comissió avaluadora estarà integrada pels membres següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ii. Funcions&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;La comissió avaluadora té les següents funcions:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Dur a terme l’adequada tramitació del procediment i resoldre les incidències que puguin sorgir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Emetre l’informe que ha de servir a l’òrgan instructor per elaborar la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Definir les equivalències entre la nomenclatura dels serveis la cartera insular de serveis i la denominació que consta al registre unificat per als serveis que s’hagin autoritzat prèviament a aquesta normativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;iii. Règim de funcionament&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Aquesta comissió analitzarà e interpretarà les incidències detectades i emetrà un informe que ha de servir de base a l'òrgan instructor per elaborar la proposta de resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;La Comissió Avaluadora queda vàlidament constituïda amb l’assistència, com a mínim, dels membres següents: la presidenta o el president suplent, el secretari o secretari suplent i dos vocals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;8.4 &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Criteris de preferència&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Els criteris de preferència per resoldre el concert social objecte de la present convocatòria, són:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En&lt;/span&gt; primer lloc, d'acord amb l'establert a l'article 19 del Decret 48/2017, tindran preferència les places ocupades en serveis subvencionats, concertats o contractats en el moment de la convocatòria, o dintre dels 30 dies anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En segon lloc, una vegada aplicat l'anterior criteri i fins a esgotar el crèdit pressupostari disponible per atendre les sol·licituds presentades, se seguirà&lt;/span&gt; l’ordre de prelació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El principi d’arrelament, s’han de finançar les places ocupades per persones designades per l’IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Posteriorment, sempre que hi hagi romanent pressupostari, i d'acord amb el principi de lliure elecció de la persona, s’han de finançar les places dels serveis en funció de la llista d’espera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Una vegada aplicats aquests criteris, la comissió avaluadora emetrà l'informe proposta d’adjudicació de les places a concertar que elevarà a l’òrgan instructor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cas que es pugui produir la renúncia a sol·licitar el concert o bé quedin places per cobrir degut a un possible incompliment dels requisits senyalats a l’apartat 4, la comissió avaluadora establirà la fórmula per a garantir els drets i l’adequada atenció a les persones usuàries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. Resolució i notificació&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.1 Òrgan competent per a la resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;L’òrgan competent per resoldre és la Presidència de l’IMAS, d’acord amb els seus Estatuts, concretament a l'article 7 (BOIB Núm. 140, de 5 de novembre de 2016), mitjançant una resolució relativa a la concertació de les places del servei d’atenció integral per a persones amb discapacitat física.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.2 Termini&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El termini màxim per dictar i notificar la resolució de la present concertació és de tres mesos comptadors de l’endemà que acabi el termini de presentació de sol·licituds. S'han de considerar desestimades les sol·licituds no resoltes en el termini indicat anteriorment. Qualsevol alteració de les condicions exigides per concedir la concertació, pot donar lloc a la modificació de la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.3 De la notificació&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La resolució de concessió o denegació del concert social objecte de la present convocatòria, s'ha de notificar individualment a les entitats interessades, d'acord amb el previst a l'article 42 de la Llei 39/2015, han de ser expresses, motivades i han de fixar la quantia individual del concert. A més, aquesta resolució es publicarà en el &lt;/span&gt;&lt;span style="color:#000000"&gt;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-right:0.82cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.4 Modificació resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Qualsevol alteració de les condicions exigides per concedir el concert, pot donar lloc a la modificació de la resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.5 &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;Dels Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Contra les resolucions que adopta la Presidència es pot interposar recurs d'alçada davant el Consell Executiu del Consell de Mallorca en el termini i amb els efectes de l'article 112 de la Llei 39/2015, de l'1 d'octubre, de procediment comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. Formalització dels concerts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;El concert que s’estableix a l’empara d’aquesta convocatòria s’ha de formalitzar necessàriament mitjançant un document administratiu en el qual es facin constar els drets i les obligacions recíprocs, així com les característiques concretes del servei i altres circumstàncies derivades de la Llei 4/2009, d’11 de juny, de serveis socials de les Illes Balears, dels decrets de desplegament i aplicació d’aquesta Llei, i del Plec general de condicions tècniques del concert. Tot això segons l’establert a l'article 7 del Decret 48/2017 de 27 d’octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;En el moment de formalitzar el concert, s’ha de presentar una declaració responsable que es continuen complint els requisits exigits per poder concertar el servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Obligacions de les entitats concertades.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;L’entitat titular del servei concertat contrau les obligacions establertes en els plecs de prescripcions tècniques des del moment de subscriure el concert objecte de la present convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Condicions tècniques d'execució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Les condicions tècniques d’execució s’han d’ajustar al Reglament pel qual es regula el funcionament del serveis socials per a persones amb discapacitat de Mallorca inclosos a la cartera insular de serveis socials, i s’estableixen els requisits d’autorització i acreditació, aprovat al Ple del Consell de Mallorca el 8 de febrer de 2018 (BOIB núm. 21, del 15 de febrer de 2018), així com al Decret 48/2017, de 27 d'octubre i al Decret 66/2016, de 18 de novembre, pel qual s'aprova la Cartera bàsica dels serveis socials de les Illes Balears 2017-2020 i s'estableixen principis generals per a les carteres insulars i locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Així mateix, l'execució del concert social objecte de la present convocatòria s'ha regir pel contingut del plec de prescripcions tècniques aplicable en aquesta tipologia de serveis i que s'aprova conjuntament amb aquesta convocatòria. Concretament, aquest plec, de conformitat amb el previst a l'article 8 del Decret 48/2017, de 27 d'octubre, detalla: l'objecte, la definició del servei, el calendari i horari, els serveis que s'han de prestar, els requisits dels serveis a concertar, el model d'atenció, els criteris d'intervenció amb les persones usuàries, el règim d'utilització de places i el règim econòmic, les assegurances, el nombre de places, els mitjans materials i humans que ha d'aportar l'entitat concertada, les obligacions de l'entitat concertada, el finançament del concert, la justificació, la coordinació, control i supervisió, la protecció de dades de caràcter personal i la regulació dels incompliments per part de les entitats i les penalitzacions, així com la durada del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Al respecte, l'article 9.2 del Decret 48/2017, de 27 d'octubre estableix les obligacions de les entitats i determina que mitjançant el concert social, l'entitat d'iniciativa privada titular del servei s'obliga a complir els plecs tècnics, així com les normes establertes en el títol VII de la Llei 4/2009 i en els corresponents decrets de desplegament i d'aplicació d'aquesta Llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Seguiment&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Des de la direcció insular de Persones amb Discapacitat es farà el seguiment tècnic dels serveis concertats objecte de la present convocatòria, de conformitat amb l'esmentat a l'article 27 del Decret 48/2017 de 27 d’octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Aquest seguiment es dirigirà a revisar la situació i intervencions amb cada persona usuària, així com el funcionament del servei, l’aplicació del model d’atenció detallat als plecs tècnics. Per fer aquest seguiment, es podrà sol·licitar la documentació i les d’evidències que es considerin necessàries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;L’entitat concertada ha de facilitar les actuacions de seguiment i comprovació que dugui a terme la direcció insular de Persones amb Discapacitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Criteris d'accés dels usuaris i llista d'espera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Els criteris d’accés i la forma d’accedir als serveis, així com la gestió de la llista d’espera, es regulen pels articles 9 (forma d’accés) i 54 al 69 (perfil de persones destinatàries) del reglament pel qual es regula el funcionament dels serveis socials per a persones amb discapacitat de Mallorca inclosos a la cartera insular de serveis socials i s’estableixen els requisits d’autorització i acreditació, així com a l'article 11 del Decret 48/2017 de 27 d’octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;D’acord amb l’esmentada normativa, l’IMAS disposa d’un procediment d’accés i gestió de la llista d’espera. Aquest procediment, així com la llista d’espera, el catàleg de serveis i els models de sol·licitud, comunicació, valoració i resolució estan a disposició, tant de la persona usuària com de l’entitat concertada, a les oficines de la Secció de Recursos Sociolaborals, així com a la Web de l’IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. &lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Les entitats acollides al concert social, juntament amb la seva denominació, han de fer constar en la documentació, en totes les comunicacions (informes, fulls, documents, tríptics de difusió, missatges electrònics, webs, insercions en premsa, articles a diaris i a revistes especialitzades), així com en la publicitat, la condició d’entitat pertanyent a la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Xarxa Pública de Serveis Socials per a persones amb discapacitat de Mallorca &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;segons les indicacions que es facilitaran des de l’IMAS per a respectar les condicions que s’estableixin a nivell d’identitat i imatge institucional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Les entitats acollides al règim de concert social han de col·locar en un lloc visible de les seves instal·lacions la indicació de S&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ervei Concertat &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; amb el logotip corresponent. Així mateix, s’ha de fer referència a aquesta circumstància en les comunicacions i en les relacions que estableixin per escrit amb les persones usuàries del servei concertat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Causes de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Són causes de resolució del concert social les que estableix l'article 28 del Decret 48/2017 de 27 d’octubre, pel qual s’estableixen els principis generals als quals s’han de sotmetre els concerts socials (BOIB Núm. 132, de 28 d’octubre de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;El venciment del termini de durada del concert, llevat que es renovi d’acord amb les normes d’aquest Decret.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;L’acord mutu de les parts, manifestat amb l’antelació de dos mesos per garantir la continuïtat del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;L’incompliment greu de les obligacions derivades del concert per part de l’IMAS o de l’entitat titular del servei, amb el requeriment previ per exigir el seu compliment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La mort de la persona física titular del servei o l’extinció de la persona jurídica a la qual correspon la titularitat, excepte el que preveu l’article 29 relatiu a l&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;’&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#231f20"&gt;extinció de la personalitat jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La declaració de concurs de creditors de l’entitat titular del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La revocació de l’autorització i/o l’acreditació del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;El cessament voluntari, degudament autoritzat, de l’activitat del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La modificació de les condicions tècniques o de les condicions econòmiques per part de l’Administració, sempre que l’entitat d’iniciativa privada no hi hagi donat la conformitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La negació a atendre les persones usuàries derivades per l’IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;L’incompliment de les condicions establertes en el document de formalització del concert o de les condicions establertes en els plecs de prescripcions tècniques. Aquests incompliments s’han d’haver constatat en el seguiment i el control per part de l'IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;La no disponibilitat sobrevinguda del títol jurídic que acredita la titularitat del servei durant la vigència del concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#231f20"&gt;Així com també les clàusules de revocació previstes en els plecs tècnics objecte del present servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. Modificació i/o ampliació del concert.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;El procediment d'ampliació de places concertades del servei objecte de la present convocatòria, així com de modificació de l'esmentat concert, es duran a terme de conformitat el Títol III relatiu als «Procediments de concertació», capítol II «Definició dels tipus de procediments de concertació social i característiques específiques, renovació i modificació», concretament als articles 18 i següents del Decret 48/2017 de 27 d’octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.21cm; margin-top:0.21cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. Jurisdicció competent&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;La jurisdicció contenciosa administrativa és la competent per resoldre les qüestions litigioses relatives a la formalització d’aquest concert i també les sorgides entre les parts sobre la interpretació, la modificació, el compliment, els efectes i l’extinció».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;SEGON.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt; APROVAR els Plecs de condicions tècniques per a la concertació de l'esmentat servei, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;l'&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Annex 1, relatiu a la guia d'aplicació al model d'atenció als serveis socials per a persones amb discapacitat de Mallorca, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el m&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;odel Sol·licitud de concert social (MOD-1), &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el m&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;odel declaració responsable de solvència tècnica i experiència (MOD-2), &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el m&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;odel declaració responsable de solvència financera per a concertar (MOD-3), &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el m&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;odel declaració responsable de no incórrer en prohibicions per a concertar (MOD-4), &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;el model de consentiment informat (MOD-5), el model de declaració de places ocupades amb anterioritat al primer concert (MOD-6).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.35cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;TERCER&lt;/strong&gt;. &lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#00000a"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;L'execució de la despesa corresponent dels exercicis &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;2018,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; 2019 i 2020 està condicionada a l'existència de crèdit adequat i suficient en el pressupost de despeses d'aquests exercicis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;QUART&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;. PUBLICAR aquesta Resolució en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;QUINT&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;. NOTIFICAR aquesta resolució a la Direcció Insular de Persones amb Discapacitat, al servei de Gestió Econòmica i a la Intervenció Delegada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 27.1 del Text consolidat dels Estatuts de l'IMAS aprovat pel Ple del Consell de Mallorca de data 13 d'octubre de 2016 (BOIB núm. 140, de 5 de novembre de 2016), recurs d’alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d’un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació expressa del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l’esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimació per silenci del recurs d’alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s’hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
