    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En el procedimiento de referencia se ha dictado la resolución que contiene el encabezamiento y el fallo del tenor literal siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;SENTENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:150%"&gt;En Ibiza, a seis de junio de dos mil dieciocho.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:150%"&gt;Vistos por mí, SERGIO GONZÁLEZ MALABIA, Magistrado Juez del Juzgado de Primera Instan­cia número Tres de Ibiza, los precedentes autos de reclamación de cantidad, substanciados por los trámites del &lt;strong&gt;&lt;em&gt;JUICIO ORDINARIO&lt;/em&gt;&lt;/strong&gt;, registrados con el número &lt;strong&gt;&lt;em&gt;1146 &lt;/em&gt;&lt;/strong&gt;del año &lt;strong&gt;&lt;em&gt;2.016&lt;/em&gt;&lt;/strong&gt;, segui­dos a instancia de GASEOSAS LA IBICENCA, SA, representada por el Procurador de los Tribunales Sr. Vall Cava de Llano y asistida del Letrado Sr. Ramón Baradat Fontanet, contra JUAN LUIS CONTRERAS MARTÍNEZ, declarado en situación procesal de rebeldía; ….&lt;/span&gt;&lt;strong&gt;&lt;span style="line-height:150%"&gt;FALLO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="line-height:150%"&gt;ESTIMO &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:150%"&gt;la demanda interpuesta por el Procurador de los Tribunales Sr. Vall Cava de Llano en nombre y representación de GASEOSAS LA IBICENCA, SA, contra JUAN LUIS CONTRERAS MARTINEZ y, en consecuencia, &lt;strong&gt;CONDENO&lt;/strong&gt; al demandado a abonar a la actora la cantidad de &lt;strong&gt;DIEZ MIL DOSCIENTOS SESENTA Y SIETE CON OCHENTA Y OCHO EUROS (10.267’88 euros)&lt;/strong&gt;, más los intereses legales correspondientes, con condena en costas a la parte demandada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:150%"&gt;Notifíquese la presente sentencia a las partes&lt;/span&gt;&lt;span style="line-height:150%"&gt;, contra la que cabe formular recurso de apelación conforme a lo previsto por el artículo 455 LEC, a interponer con arreglo a lo dispuesto en los artículos 458 y ss. LEC, previa consignación del depósito preceptivo para recurrir en la cuenta de consignaciones de este Juzgado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:150%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:150%"&gt;Así por esta mi Sentencia lo pronuncio, mando y firmo”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;Y como consecuencia del ignorado paradero de JUAN LUIS CONTRERAS MARTÍNEZ, se extiende la presente para que sirva de cédula de notificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:#000000"&gt;En IBIZA/EIVISSA, a catorce de septiembre de dos mil dieciocho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
