    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En sesión del Consejo de Administración de la Autoridad Portuaria de Baleares celebrada el 18 de julio de 2018, en virtud de lo establecido en el artículo 30.5 del Texto Refundido de la Ley de Puertos del Estado y de la Marina Mercante, aprobado por Real Decreto Legislativo 2/2011, de 5 de septiembre, se ha adoptado el siguiente acuerdo&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;a)&amp;nbsp;“Aprobar&lt;/strong&gt; las tarifas máximas que han de regir en la autorización de ocupación temporal de una parcela de dominio público portuario del Puerto de La Savina para la explotación de puestos de amarre y locales comerciales en la dársena de embarcaciones menores, &lt;strong&gt;&amp;nbsp;&lt;/strong&gt;en los siguientes términos: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;1.- GESTIÓN DE AMARRE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a) Embarcaciones de base:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;-Embarcaciones de&amp;nbsp; eslora menor o igual a 10.-mts: 0,50.-€/m²/día o fracción&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;-Embarcaciones de eslora mayor de 10.-mts: 0,55.-€/m²/día o fracción&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b) Embarcaciones transeúntes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;- Temporada baja (0101 a 31/05 y 01/10 a31/12)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &amp;nbsp;&amp;nbsp;&amp;nbsp;0,65.-€/m²/día o fracción&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;- Temporada alta ( 01/06 a 30/09 )&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Embarcaciones de eslora menor o igual de&amp;nbsp; 10.-mts: 3,50.-€/m²/día o fracción&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;Embarcaciones de más de 10.-mts de eslora: 3,75.-€/m²/día o fracción&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La base de aplicación de la tarifa para la gestión de amarre, será la superficie resultante del producto de la eslora máxima por la manga máxima de la embarcación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El importe de esta tarifa incluye, tanto para embarcaciones de base como transeúntes, la recogida de basuras, la retirada de residuos sólidos y líquidos y de productos oleaginosos, de elementos flotantes, guardería y custodia de las embarcaciones. El servicio de guardería que se ofrezca garantizará la seguridad de los usuarios y de los bienes y embarcaciones existentes en el espacio de la superficie de tierra y del espejo de agua objeto de autorización, en relación con las operaciones propias de la explotación y de la utilización de las superficies autorizadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Asimismo están incluidos los impuestos, arbitrios, tasas, y en general cuantos impuestos estatales, autonómicos o locales sean de aplicación, en particular el Impuesto sobre Bienes Inmuebles ( IBI ).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Estas tarifas no incluyen la tasa de embarcaciones deportivas y de recreo, de obligado abono por parte de las embarcaciones de recreo surtas en las instalaciones de la autorización de conformidad con el Texto Refundido de la Ley de Puertos del Estado y de la Marina Mercante, aprobado por Real Decreto Legislativo 2/2011, de 5 de septiembre,&amp;nbsp; donde el titular de la embarcación es sujeto pasivo contribuyente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;2.- LOCALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Tarifa: 8.-€/m²/mes&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Incluye la superficie asociada a los soportales, es decir, hasta la fachada del denominado edificio A.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Esta cuantía se entenderá como cuantía media mensual, promedia en el conjunto del año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;3.-SUMINISTRO DE AGUA Y ENERGÍA ELÉCTRICA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Sobre las tarifas de la Autoridad Portuaria de Baleares vigentes aplicable en el Puerto de La Savina, incrementadas en un 10%.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;4.- TELEFONÍA Y DATOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;Sobre las tarifas de la compañía suministradora con un incremento del 10%.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;5.- SERVICIO ADICIONALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;5.1 Suministro de gas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&amp;nbsp;&lt;em&gt;Sobre las tarifas de la compañía suministradora con un incremento del 10%.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;5.2 Servicios de ACS en duchas y aseos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;0,63.-€/minuto&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;En dichos importes no está incluido el IVA ( Impuesto sobre el Valor&amp;nbsp; Añadido )&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Los gastos de conservación de las instalaciones, cuya ejecución deberá ser asumida por el titular de la autorización, no podrán ser repercutidos a los usuarios de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;b) Otorgar&lt;/strong&gt; un plazo de un mes para presentar el reglamento de explotación de las instalaciones tal y como se exige en la Prescripción particular 31ª de las del Pliego que rige la autorización.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La empresa FORMENTERA MAR S.A., &amp;nbsp;procederá a la inserción en el B.O.I.B. de las tarifas aprobadas, así como el Clausulado de aplicación de tarifas, a los efectos de su publicidad, que serán remitidas a la APB una vez publicadas. Asimismo,&amp;nbsp; tendrá expuesto al público el cuadro de tarifas y condiciones de aplicación debidamente selladas por la Autoridad Portuaria, y en la página web de su empresa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra esta resolución, que pone fin a la vía administrativa, cabe interponer, con carácter potestativo, Recurso de Reposición ante el mismo órgano que lo ha dictado, de acuerdo con el artículo 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas. El plazo para interponerlo es de un (1) mes a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer Recurso Contencioso-administrativo hasta que se haya resuelto el de Reposición.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De no utilizar el Recurso potestativo de Reposición, cabe interponer directamente Recurso Contencioso-administrativo, conforme a lo establecido en el artículo anteriormente citado, y en los artículos 45 y siguientes de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa, ante el Juzgado de lo Contencioso-administrativo, en el plazo de dos (2) meses, a contar desde el día siguiente al de la recepción de la presente notificación. Ello sin perjuicio de cualquier otro recurso o acción que se estime pertinente”.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp; &amp;nbsp;&lt;/span&gt;&lt;/p&gt;
