    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Mitjançant acord de la Junta de Govern Local de data 14 de setembre de 2018, es va aprovar el conveni de col·laboració entre l'Ajuntament de Sant Joan de Labritja i l'Empresa Privada PROVIASOL PLUS SL per a la realització conjunta de obres de BT subterrània al C/ Aigua Blanca de Portinatx. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.5.- ACORD QUE PROCEDEIXI EN L'EXPEDIENT 1104/2018 SOBRE APROVACIÓ DE CONVENI ENTRE L'AJUNTAMENT I LA MERCANTIL PROVIASOL PLUS SL SOBRE REALITZACIÓ CONJUNTA DE LES OBRES DE BT SUBTERRÀNIES DEL CARRER AIGUA BLANCA A PORTINATX.- &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El secretari formula la següent proposta de acord a la Junta de Govern Local: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist l'esborrany de conveni, expedient 1104/2018, entre l'Ajuntament de Sant Joan de Labritja i la mercantil Proviasol Plus SL per a la realització conjunta de les obres de BT subterrània al Carrer Aigua Blanca de Portinatx. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'any 2004 l'Ajuntament va realitzar una dotació d'infraestructures que incloïa una canalització destinada al soterrament de línies aèries de baixa tensió. L'obra estava prevista en el projecte de Dotació d'Infraestructures de Carrer s'Aigua Blanca (llicència municipal d'obra 12/2004 i expedient d'Endesa EI 04003. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El promotor ha presentat al 2016 (NRFE 3940 de 2016.09.29, projecte de realització de Xarxa de Baixa Tensió al carrer Aigua Blanca de Portinatx. Aquest projecte ha previst una canalització paral·lela a la ja executada per l'Ajuntament. la nova canalització prevista pel promotor implica el trencament del paviment del carrer de formigó imprès de difícil reparació, a més d'existir afectació a altres serveis que existeixen en dit carrer (aigua, telèfon, línia de MT). &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist l'anterior i amb la finalitat de coordinar infraestructures i minimitzar el trencament del paviment del carrer (formigó imprès), el projecte presentat pel promotor hauria de modificar i aprofitar la canalització executada en el seu dia per l'Ajuntament. per a això cal establir Conveni entre el promotor i l'Ajuntament.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist el Conveni entre l'Ajuntament de Sant Joan de Labritja i el promotor de les obres Proviasol Plus, SL, per a la realització conjunta de Xarxa de BT subterrània a la carrer Aigua Blanca. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;La finalitat d'aquest Conveni per part dels promotors, és l'electrificació de la parcel·la situada al Carrer de Aigua Blanca nº 10 fent servir la canalització existent executada per l'Ajuntament i condicionada a la previsió de l'elecció dels conductors que puguin suportar la connexió de la resta d'usuaris quan passin a connectar des de la línia soterrada. &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Vist l'informe de l'arquitecte de 6 de juny de 2018, en el qual diu: &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;"Examinat el conveni que subscriu l'Ajuntament, juntament amb el promotor del projecte, Proviasol Plus SL. El tècnic municipal; &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;INFORMA: &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El conveni recull diverses actuacions: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;L'Ajuntament:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Aportarà les canalitzacions elèctriques executades en el marc del projecte de soterrament de línies aèries del Carrer Aigua Blanca, a Portinatx. (Canalització per soterrament de LBT, des punt A a punt D1 i armari d'obra en punt d). &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;El promotor:&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Aportarà el projecte de Baixa Tensió Carrer S 'Aigua Blanca, que inclou la parcel·la del promotor i els subministraments actuals en aquest carrer. (Canalització per soterración de LBT, des de CT al punt A, resta d'armaris i caixes de distribució , conductors elèctrics i treballs d'Endesa.) &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;En data 20 d'abril de 2.017 es va realitzar per part del tècnic municipal el següent informe que transcric literalment: &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;"se sol·licita llicència municipal per al Projecte d'Ampliació Subterrània de Xarxa de Baixa Tensió des del CT" Portinatx-4 "NÚM 30.446, a fi de donar subministrament elèctric a un edifici d'habitatges situat al C / S'Aigua Blanca Núm 10, Portinatx, TM de Sant Joan de Labritja. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per a l'ampliació de la Xarxa de Baixa Tensió, es tracta d'una línia nova, partirà del CT i seguirà el seu traçat fins arribar a una caixa de seccionament i CGP des de la qual partirà la Línia General d'Alimentació de l'edifici a electrificar. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La línia anirà allotjada en tot el seu recorregut a l'interior de tub de polietilè corrugat d'alta densitat, de 160mm de diàmetre com a mínim. S'instal·larà un tub addicional de reserva, que s'ha de deixar convenientment taponat parell la seva utilització quan sigui precisa. S'han previst les següents potències per a les parcel·les a electrificar: Potència Reial LBT &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La línia projectada és subterrani per a baixa tensió instal·lats en rasa que corre al llarg de la carretera, és un carrer on tot el paviment és igual, i en el qual poden circular vehicles. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El pressupost d'execució material és de &lt;strong&gt;7.881.67 €&lt;/strong&gt;. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La finca d'acord amb el règim establert per la Territorial Insular pla d'Eivissa i Formentera (PTI), aprovat definitivament el 21 de març de 2005, per acord del Plenari del Consell Insular (BOIB núm. 50 31-03-2005) i les normes subsidiàries de planejament de Sant Joan, aprovat definitivament per la CIOTUPHA 29 abril 2011 (07/07/2011 BOIB núm. 104), es troba dins la categoria de sòl urbà. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El promotor s'aplica per a la realització de la xarxa de baixa tensió amb canonada paral·lela a una altra canonada que és executat per l'Ajuntament el 2003-2004 en disposició de projecte d'infraestructures. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La nova canalització implica la ruptura de la vorera de la planteges carrer (formigó imprès) pel que el tècnic sotasignant informa: &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per tal de coordinar la infraestructura i minimitzar el paviment del carrer (formigó imprès), el projecte redactat hauria de ser modificat i coordinar amb dotació d'infraestructures projecte executat per l'Ajuntament de salt. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Cal que es modifiqui el projecte per aprofitar la canalització existent i permetre el futur soterrament d'existir en la mateixa xarxa de vial aire, així que inclourà els poders de les edificacions existents i se li assignarà els gabinets corresponent. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;L'Ajuntament cediria la canalització per a baixa tensió i promotor instal·larà la línia i armaris de tal manera que permetran el futur soterrament. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per tal de garantir la correcta gestió dels residus generats en el treball, exigeix el dipòsit d'un vincle i altre equivalent seguretat financera, que la resposta per a la correcta gestió de la construcció i demolició residus que es produeixen en l'obra en la termes previstos en la legislació regional i municipal, (50% de la valoració del cost de residus incorporada a l'estudi de gestió dels RCD promotor lliurat juntament amb el projecte segons l'article 6.1.7.) &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Paràlisi en zona turística durant la temporada Estival. &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Posant-se les obres en sòl urbà serà la conformitat amb l'article 62 de les ordenances municipals de Sant Joan, prohibeix l'execució de les obres d'estructura, neteja o qualsevol altra que pot provocar molèsties al barri o a la via pública, en zones Turístics durant el període comprès entre el 1 de maig i 31 d'octubre, coincidint amb la temporada turística. Durant aquest període, se suspenen llicències cedides en aquestes àrees, estès per la mateixa època. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;És què informo segons la meva millor coneixement i creença enviant els presents criteris millors de l'autoritat superior." &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Junta de Govern Local de data 13 d'abril 2018 va informar favorable per a la implantació de la urbanització del carrer de s'Aigua Blanca Portinatx. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Basat en l'anterior prèviament informa FAVORABLEMENT a l'acord, condicionat que per a la concessió de les obres municipals llicència ha de presentar projecte d'urbanització amb les modificacions que s'indica en l'informe ha de ser aprovat per la Junta de Govern Local en aquest ajuntament. &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;I.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Els Ajuntaments podran establir convenis amb Empreses privades per gestionar aspectes del seu interès. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;II.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Legislació: articles 55 i 57 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local; article 4.1.c) del Text Refós de la Llei de Contractes del Sector Públic, aprovat per Reial decret Legislatiu 3/2011, de 14 de novembre; articles 82, 83 i 84 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;III.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Durant tot el procés d'haurà de complir-se amb les exigències de publicitat activa en virtut del que es disposa en l'article 21.4 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques i en la normativa vigent en matèria de transparència. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;IV.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; De conformitat amb l'establert en l'article 4.1.d del Text Refós de la Llei de Contractes del Sector Públic, aprovat pel Reial decret Legislatiu 3/2011, de 14 de novembre, estan exclosos de l'àmbit d'aplicació d'aquesta llei els convenis que, conformement a les normes específiques que els regulen, celebri l'Administració amb persones físiques o jurídiques subjectes al dret privat, sempre que el seu objecte no estigui comprès en el dels contractes regulats en aquesta llei o en les seves normes administratives especials. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;V.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; La celebració d'un conveni de col·laboració no suposarà, en cap cas, alteració del règim de contractació, ni alterarà l'obtenció de permisos, llicències, etc. Ni donarà lloc a prerrogatives en l'activitat reglada municipal, ni modificarà el règim de competències atribuït als òrgans administratius. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;VI.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; De conformitat amb el previst en l'article 53 de Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic en relació amb la instrucció relativa a la remissió telemàtica al Tribunal de Comptes de convenis i de relacions anuals dels celebrats per les entitats del sector públic local, aprovada per Resolució de 2 de desembre de 2016, de la Presidència del Tribunal de Comptes, dins del termini dels tres mesos següents a la subscripció de qualsevol conveni els compromisos econòmics del qual superin els 600.000 euros, s'haurà de remetre al Tribunal de Comptes o òrgan extern de fiscalització de la Comuniqueu Autònoma, còpia del document de formalització del conveni, acompanyada de la corresponent memòria justificativa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;S'entén per compromisos econòmics assumits, l'import total de les aportacions financeres que es comprometin a realitzar el conjunt dels subjectes que subscriuen el conveni, independentment de l'aportació que correspongui a l'entitat local remitent de la documentació. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Així mateix, les entitats locals hauran de remetre anualment una relació certificada comprensiva dels convenis formalitzats, amb independència de la seva quantia, en aplicació de l'article 53.3 de la Llei 40/2015, d'1 d'octubre, de Règim Jurídic del Sector Públic i la instrucció relativa a la remissió telemàtica al Tribunal de Comptes de convenis i de relacions anuals dels celebrats per les entitats del sector públic local, aprovada per Resolució de 2 de desembre de 2016, de la Presidència del Tribunal de Comptes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;VII.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt;Procediment: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Aprovació del Conveni per la Junta de Govern Local, autoritzant al Sr. Alcalde per a la seva signatura. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Notificació de l'acord als interessats, d'acord amb l'establert en l'article 40 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques, en el termini de deu dies a partir de la data en què l'acte hagi estat dictat, i haurà de contenir el text íntegre de la resolució, amb indicació de si és o no definitiu en la via administrativa, l'expressió dels recursos que procedeixin, òrgan davant el qual haguessin de prestar-se i termini per interposar-los, sense perjudici que els interessats puguin exercitar, si escau, qualsevol un altre que estimin procedent. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Publicar en el BOIB i en l'adreça electrònica de l'Ajuntament el text íntegre del conveni. Dins del mes següent a la seva aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Per tot això, de conformitat amb l'establert en l'article 175 del Reglament d'Organització, Funcionament i Règim Jurídic de les Entitats Locals, aprovat per Reial decret 2568/1986, de 28 de novembre, INFORMO FAVORABLEMENT l'expedient de referència i elevo la següent &lt;/span&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;PROPOSTA d'acord a la&lt;/span&gt;&lt;/strong&gt; &lt;strong&gt;&lt;span style="color:#333333"&gt;JUNTA DE GOVERN LOCAL&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;Primer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Aprovar el text del Conveni administratiu de col·laboració entre aquest Ajuntament de Sant Joan de Labritja i la mercantil Proviasol Plus SL, per a la realització conjunta de les obres de BT subterrània al Carrer Aigua Blanca de Portinatx, el text del qual és el següent: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Participants&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Don Antonio Marí Marí, amb NIF 41437091S, alcalde i en representació de l'Ajuntament de Sant Joan de Labritja, amb CIF P0705000H, &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Don Miguel Hevia González NIF 10823473H en representació de PROVIASOLPLUS SL CIF B33582446, promotora i propietària de la parcel·la, situada al Carrer de Aigua Blanca nº10, Portinatx. (d'ara endavant Promotor). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Antecedents &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;1. L'any 2004 l'Ajuntament va realitzar una dotació d'infraestructures que incloïa una canalització destinada a la soterració de línies aèries de baixa tensió. L'obra estava contemplada en el Projecte de Dotació d'Infraestructures de Calli S’Aigua Blanca (llicència municipal d'obres nº12 2004 i expedient Endesa EI04003). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;2. El Promotor ha presentat en el 2016 (NRE 3940 de 29.09.2016) projecte de realització de xarxa de baixa tensió al Carrer Aigua Blanca de Portinatx. Aquest projecte ha previst una canalització paral·lela a la ja executada per l'Ajuntament. La nova canalització prevista pel Promotor implica el trencament del paviment del carrer de formigó imprès de difícil reparació, a més d'existir afectació a altres serveis que existeixen en aquest carrer (aigua, telèfon, línia de MT). &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Vist l'anterior i amb la finalitat de coordinar infraestructures i minimitzar el trencament del paviment del carrer (formigó imprès), el projecte presentat pel Promotor hauria de modificar-se i aprofitar la canalització executada en el seu moment per l'Ajuntament. Per a això és necessari establir un CONVENI entre el Promotor i l'Ajuntament. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Objectius de les parts. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;• Ajuntament &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;- Realitzar la infraestructura que permeti el futur soterrament de línies aèries de baixa tensió existents en el seu projecte de Dotació i Infraestructures. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;- Reducció de costos, ja que els conductors elèctrics i els armaris i caixes de distribució pendents d'executar els instal·la el Promotor. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;• Promotor &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;- Dotar de subministrament elèctric a la parcel·la de la seva propietat. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;- Reducció de costos, ja que es redueix l'obra civil, en aprofitar la canalització i un armari realitzats per l'Ajuntament. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;- Minimitzar el trencament del vial de paviment imprès. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Objecte del CONVENI &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;El projecte hauria d'aprofitar la canalització existent executada per l'Ajuntament i dotar de conductors elèctrics suficients que permetin el futur soterrament de xarxa aèria existent en el mateix vial. Per a això es contemplaran les potències de les edificacions existents i s'assignaran aquestes als armaris corresponents. L'Ajuntament cediria a Proviasol Plus SL la canalització executada per a baixa tensió; Proviasol Plus SL finalitzaria tècnicament aquesta canalització realitzant els tastos de comprovació requerides per Gesa Endesa i la construcció dels armaris elèctrics assenyalats; se certificaria el Final d'Obra de tota la canalització executada fins al moment i es lliuraria a Endesa Explotació. Rebuda per Endesa Explotació i donada per vàlida aquesta canalització, Proviasol Plus SL procediria a la instal·lació de les caixes elèctriques i dels conductors que faltin de manera que es permeti el futur soterrament. En definitiva, realitzar l'obra de forma conjunta en col·laboració entre l'Ajuntament i el PROMOTOR, amb la fi reduir els costos de l'obra, i aprofitar els treballs realitzats prèviament per l'Ajuntament. No forma part del conveni la realització d'escomeses, instal·lacions d'enllaç, reubicació de comptadors, derivacions individuals i desmuntatge de la xarxa aèria actual.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;El present conveni entrarà en vigor una vegada el mateix compti amb l'aprovació de Gesa Endesa com a empresa subministradora d'energia i es resoldrà si Endesa, per circumstàncies no previsibles en aquest moment, no rep la canalització ja executada per l'Ajuntament.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Situació de partida&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Les parts han realitzat diverses actuacions, prèvies a aquest CONVENI, que es consideren aportacions al mateix i que es llisten a continuació:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;a) L'ajuntament:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;1. Aportació de les canalitzacions elèctriques executades en el marc del projecte de soterrament de línies aèries del carrer Aigua Blanca, Portinatx.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;b) El promotor:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;1. Projecte de baixa tensió calli S’Aigua Banca, que inclou la parcel·la del promotor i els subministraments actuals en aquest carrer. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;CONVENI de projecte executiu de soterrament de línia aèria i utilització de les canalitzacions per a l'electrificació d'una parcel·la.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Amb la signatura d'aquest CONVENI, les parts mostren la seva conformitat amb el traçat i configuració del projecte executiu per procedir a la seva tramitació davant la companyia subministradora i les administracions competents.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;La finalitat d'aquest CONVENI per part dels promotors, és l'electrificació de la parcel·la situada al Carrer de *igua Blanca nº10 usant la canalització existent executada per l'ajuntament i condicionada a la previsió de l'elecció dels conductors que puguin suportar la connexió de la resta d'usuaris quan passin a connectar-se des de la línia soterrada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;CONVENI d'assignació de partides i costos.&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#333333"&gt;Les parts de l'obra es repartiran de la següent forma:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;Tercer.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Publicar en el BOIB i a la seu electrònica o pàgina web d'aquest Ajuntament el text definitiu complet del Conveni dins del mes següent a la seva aprovació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;Quart.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#333333"&gt; Facultar a l'Alcalde, com a President d'aquesta Corporació i en representació d'aquest Ajuntament, de conformitat amb l'establert en l'article 21.1.b) de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local, per subscriure el citat Conveni de Col·laboració i quants documents siguin necessaris en la seva execució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:#333333"&gt;LA JUNTA DE GOVERN LOCAL PER UNANIMITAT ACORDA APROVAR LA PRECEDENT PROPOSTA EN ELS TERMES EN QUE S'HA TRANSCRIT.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;Contra la present Resolució, que posa fi a la via administrativa, pot interposar alternativament recurs de reposició potestatiu davant la Junta de Govern Local d'aquest Ajuntament de Sant Joan de Labritja, en el termini d'un mes a explicar des de l'endemà al de la recepció de la present notificació, de conformitat amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques; o bé interposar directament recurs contenciós administratiu, davant el Jutjat del Contenciós Administratiu de Palma de Mallorca, en el termini de dos mesos, a explicar des de l'endemà al de la recepció de la present notificació, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciós Administrativa. Si s'optés per interposar el recurs de reposició potestatiu no podrà interposar recurs contenciós administratiu fins que aquell sigui resolt expressament o s'hagi produït la seva desestimació per silenci. Tot això sense perjudici que pugui interposar qualsevol altre recurs que pogués estimar més convenient al seu dret.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
