&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, subvencions per a inversions no productives vinculades a la realització de compromisos d’agroambient i clima, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El vicepresident del FOGAIBA, en data 1&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;1&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;d&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;’octubre&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de 2018, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;1. En data de 17 de novembre de 2015 es va publicar, en el BOIB núm. 169, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions no productives vinculades a la realització de compromisos d’agroambient i clima.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 31/12/2017, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:'Times New Roman'"&gt;702&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;sol·licituds d'ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;3. Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;4. Els interessats relacionats a l’Annex I adjunt han sol·licitat el desistiment de l’ajuda que els hi hagués pogut correspondre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:LegacySanITCBoo"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;13.Ordre del conseller d’Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:LegacySanITCBoo"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;14.Llei 12/2014, de 16 de desembre, agrària de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:LegacySanITCBoo"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;15.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;span style="color:null"&gt;BOIB núm. 082 de 2007&lt;/span&gt;; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:LegacySanITCBoo"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;16. Llei 39/2015, d’1 d’octubre, del Procediment Administratiu Comú de les Administracions Públiques al seu art. 94 estableix el desistiment de la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:LegacySanITCBoo"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Proposta de resolució de desistiment&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Per tot això, s’informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;1. Considerar desistides les sol·licituds presentades pels interessats, relacionats a l’Annex I, que són un total de 3&amp;nbsp;expedients i que comença amb VICENTE ESCANDELL TORRES&amp;nbsp;i acaba amb &amp;nbsp;ANTONIO SERRA MARI&amp;nbsp;, els quals &amp;nbsp;han demanat el desistiment de l’esmentada ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
