&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 13 de novembre de 2015 per la qual es convoquen, subvencions per a inversions no productives vinculades a la realització de compromisos d’agroambient i clima, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;/span&gt;&lt;em&gt;&lt;span&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;span&gt;d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;span&gt;El vicepresident del FOGAIBA, en data &lt;/span&gt;&lt;span&gt;25&lt;/span&gt;&lt;span&gt;&amp;nbsp;de &lt;/span&gt;&lt;span&gt;juliol&lt;/span&gt;&lt;span&gt;&amp;nbsp;de 2018, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l’ajuda a favor dels interessats &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;que figuren en l’annex d'aquesta Resolució amb les dates i els imports corresponents&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;Posteriorment, a l’&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;i&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;lla de Menorca s’ha produït una tendència d’algunes SRM a canviar la lletra del NIF per motius exclusivament fiscals i que d’acord amb la comunicació del Cap d’Àrea jurídic&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;o &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;administrativa del FOGAIBA de 10 de gener de 2017, el canvi de lletra no afecta a la seva consideració com a titular d’explotació o perceptor de les subvencions que correspongui i té &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;només &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;efectes fiscals. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;S’ha comprovat que el canvi de lletra no ha afectat a la realitat de l’explotació agrària que continua sent la mateixa explotació.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;Correspon per tant modificar les resolucions de concessió a aquelles SRM que han modificat la lletra del NIF d’acord amb l’actual realitat fiscal per tal qu&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;e&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;&amp;nbsp;els pagaments siguin coherents amb les concessions.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Llei 12/2014, de &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;16&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;de desembre, agrària de les Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;BOIB núm. 082 de 2007&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Llei 39/2015,&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span&gt;d'1 d'octubre, del &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;procediment&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;
&lt;p align="justify"&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Proposta de resolució de modificació&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;1. Modificar la resolució d’ajuda concedida al beneficiari pe&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;r &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;l&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;’&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;import i amb els term&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;es&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;detallats en l'annex, que és un total d'&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;1 e&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;xpedients i que comença amb &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;SON BOU VELL SRM&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&amp;nbsp;i acaba amb &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;SON B&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;OU VELL&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;&lt;span style="color: rgb(0, 0, 0);"&gt;&amp;nbsp;SRM&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;, relativa a la línia d’ajuda “Inversions no productives”, pel que fa al canvi de lletra del NIF.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;2. Notificar aquesta resolució mitjançant la publicació al B&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;utlletí &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;O&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;ficial de les &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;I&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;lles &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;B&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;alears&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Interposició de recursos&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;&lt;span&gt;Contra aquesta resolució –que no exhaureix la via administrativa– es pot interposar recurs d’alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d’un mes, comptador des de l’endemà de la notificació de la resolució, d’acord amb l’article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;C&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;omunitat &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;A&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;utònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;, d’1 d’octubre, &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;del &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;p&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;rocediment administratiu &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;c&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;omú de les &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;a&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;dministracions &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;p&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span&gt;úbliques.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
