	&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Notificació de Resolució d’acceptació de desistiment, modificació de cofinançament&amp;nbsp;i revocació de la resolució de concessió als beneficiaris de les ajudes, R20&amp;nbsp;&amp;nbsp;(exp. 122) de data 17&amp;nbsp;d’abril&amp;nbsp;de 2018, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries, per als anys 2015 a 2019&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Butlletí Oficial de les Illes Balears &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;El vicepresident del FOGAIBA, en data &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;17&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;&amp;nbsp;d&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;’abril&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;&amp;nbsp;de 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;8&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;, va signar la següent resoluci&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;ó&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;

		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2016 i 22 de juny de 2016.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
	&lt;li align="justify"&gt;
		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 30 de setembre de 2015.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
	&lt;li align="justify" value="3"&gt;
		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;En data 24 de novembre de 2016 es va dictar la resolució de concessió (R20), que es va publicar al BOIB número 154 de dia 8 de desembre de 2016. Aquesta remesa inclou l’expedient núm.122 a nom de &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;gabriel angel gost bauza&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;, amb &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;nif &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;41517305M, amb un import d’ajuda concedit de 18.808,80€, corresponent el 41% al FEADER per un import de 7.711,61€, el 10,91% l’AGE per un import de 2.052,04€ i el 48,09% a la CAIB per un import de 9.045,15&amp;nbsp;€.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
	&lt;li align="justify" value="4"&gt;
		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Per Resolució del president del Fons de Garantía Agrària i Pesquera de les Illes Balears (FOGAIBA), de &amp;nbsp;de 12 de febrer de 2018, publicada al BOIB Núm.21 de 15 de febrer de 2018, es vàren modificar els crèdits i el cofinançament de la convocatòria de inversions en les explotacions agràries&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;
	&lt;li align="justify" value="5"&gt;
		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Atesa la Resolució anterior s’ha de dur a terme la modificació del cofinançament de l’ajuda concedida i no pagada pel que fa a la persona beneficiària &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;gabriel angel gost bauza&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;, amb &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;nif &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;41517305M, núm. d’expedient INEA2015_1/122. Els nous percentatges són els següents: FEADER el 53%, per un import de 9.968,66€; AGE el 14,10%, per un import de 2.652,04€, i CAIB el 32,90€, per un import de 6.188,10€, amb un import total d’ajuda concedit de 18.808,80€. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;

		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;En data 11 de setembre de 2017, amb registre d’entrada núm. 20171/2017, la persona beneficiària va sol·licitar el desistiment de l’ajuda, encara que com és posterior a la concessió es tracta d’una renúncia,la qual cosa suposa dur a terme la revocació total de l’ajuda concedida.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;

		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la Comunitat Autònoma de les Illes Balears, publicat en el &amp;nbsp;BOIB núm. 82 extraordinari de 31 de maig ; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix en l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;

		&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;&amp;nbsp;Llei 39/2015&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="color:rgb(0,0,0);"&gt;&lt;span style="font-family:times new roman;"&gt;d'1 d'octubre del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/li&gt;

&lt;p style="text-align: center;"&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Proposta de resolució &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Per tot això, s'informa que s’ha d’acceptar la renúncia, s’ha de canviar el cofinançament i s’ha de revocar la resolució de concessió de l’expedient núm.&amp;nbsp;122 a nom de &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;, dins la R20 de data 24 de novembre de 2016 i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:35,7000pt;"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Acceptar la renúncia de la resolució de concessió (R20) de data 24 de novembre de 2016, respecte al senyor &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;, amb &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:35,7000pt;"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Modificar els percentatges de cofinançament prevists en la Resolució del President del FOGAIBA, de 10 de juliol de 2015, per la qual es convoquen per als anys 2015-2019, subvencions per a inversions en les explotacions agràries, conforme els percentatges de cofinançament establerts per la Resolució del president del FOGAIBA, de 12 de febrer de 2018 per la qual es modifica el crèdit i el cofinançament previst a la Resolució del president del FOGAIBA, de 10 de juliol&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;&amp;nbsp;Els percentatges de cofinançament conforme el PDR 2014-2020 seran els següents: 53,00% pel FEADER, en un 14,10%, per l’AGE i en un 32,90% per la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:35,7000pt;"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Revocar &amp;nbsp;la resolució de concessió (R20) de data 24 de novembre de 2016, respecte al senyor &lt;span class='lopd'&gt;(dades personals ocultes)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:35,7000pt;"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Finalitzar el procediment i arxivar l’expedient INEA 2015_1/122.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify" style="margin-left:35,7000pt;"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Notificar aquesta resolució a la persona beneficiària mitjançant la publicació en el &amp;nbsp;Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;strong&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="font-family:times new roman;"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p align="justify"&gt;
	&lt;em&gt;&lt;span style="font-size:12,0000pt;"&gt;&lt;span style="color:rgb(0,0,0);"&gt;&lt;span style="font-family:times new roman;"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d’alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d’un mes, comptador des de l’endemà de la notificació de la resolució, d’acord amb l’article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears, i els articles 121 i 122 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
