ajudes, R 24 &nbsp;de data&nbsp; 05 d’abril de 2018, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries, per als anys 2015-2019</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident del FOGAIBA, en data 05 d’abril de 2018, va signar la següent resolució,</span></p> <p align="center"> <span style="font-family:times new publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2016 i 22 de juny de 2016.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 31 de desembre de 2015.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els interessats assenyalats a l'Annex I adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i s’ha comprovat que compleixen amb els requisits exigits per a poder ser beneficiaris d'aquesta ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Les actuacions sol·licitades pels interessats compleixen amb els requisits establerts a la convocatòria per tal de poder ser subvencionables.</em></span></li> roman,times,serif;font-size:12px;"><em>Ordre del conseller d’Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Llei 12/2014, de 16 de desembre, agrària de les Illes Balears.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007 ; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006. </em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.</em></span></li> </ol> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Proposta de resolució de denegació</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per tot això, s'informa favorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:</em></span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Concedir l’ajuda sol·licitada als beneficiaris pels imports i amb els terminis detallats a l'Annex I, que són un total de 9 expedients i que comença amb </em></span><em><span style="font-family:times new roman,serif;"><span style="font-size:12.0pt;"><span class='lopd'>(dades personals ocultes)</span><span style="font-family:times new roman,times,serif;font-size:12px;">i acaba amb </span><span class='lopd'>(dades personals ocultes)</span></span></span></em><span style="font-family:times new roman,times,serif;font-size:12px;"><em>, que suma un import total de 441.602,68 euros, relativa a la línia d’ajuda “Inversions a les explotacions agràries”.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l'Annex I.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Determinar que, d’acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l'Annex II .</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Publicar la resolució al les inversions o activitats auxiliades en el termini establert.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en els termes i terminis determinats a la present Resolució.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Exercir l’activitat agrària en qualsevol explotació i mantenir les inversions realitzades durant almenys cinc anys, comptats des de la data de pagament de l’ajuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Complir les normes comunitàries aplicables a la inversió de la qual es tracti i les específiques que puguin assenyalar-se en funció del tipus d’explotació.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Adoptar les mesures que siguin necessàries per proporcionar informació al públic i donar-ne publicitat.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>-Sotmetre’s als controls que dugui a terme l’administració, necessaris per comprovar la correcta concessió de l’ajuda i el posterior manteniment dels compromisos.</em></span></p> <p> <span style="font-family:times new
