Mitjançant la Resolució del conseller de Treball, Comerç i Indústria i president del Servei d’Ocupació de les Illes Balears, de 5 de desembre de 2017, (<em>BOIB núm.153, de 16 de desembre</em>), s’obre la convocatòria per a la presentació de sol·licituds de beques i ajuts de la convocatòria informativa dirigida als alumnes de les especialitats formatives corresponents a les competències clau impartides pels centres educatius per a persones adultes, per al període 2018-2019.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. D’acord amb el punt primer de l’annex 1 de la Resolució de la convocatòria&nbsp; esmentada, aquestes beques i ajuts estan adreçades als treballadors desocupats, alumnes de les especialitats formatives corresponents a les competències clau impartides pels centres educatius per a persones adultes durant el període 2018-2019, perquè puguin presentar les sol·licituds a les beques per assistència previstes en l’article 25 de l’Ordre TAS/718/2008, de 7 de març, per la qual es desenvolupa el Reial decret 395/2007, de 23 de març, pel qual es regula el subsistema de formació professional per a l’ocupació en matèria de formació de l’oferta i s’estableixen les bases reguladores per concedir subvencions públiques destinades al seu finançament (Aquesta Ordre TAS/718/2008,&nbsp;s’ha d’entendre en vigor mentre no entri en vigor la normativa que desenvolupa el Reial decret 694/2017, d’acord amb el primer apartat de la seva Disposició Transitòria primera), així com els ajuts de transport&nbsp; prevists en l’article 26.1 de la mateixa Ordre i les beques per a dones víctimes de violència de gènere regulades en l’article 7.<em>b</em> del Reial decret 1917/2008, de 21 de novembre, pel qual s’aprova el programa d’inserció sociolaboral per a dones víctimes de violència de gènere.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. <span style="color: black;">D’acord amb l’apartat 10 de l’Annex I de la Resolució de convocatòria esmentada, pel que fa a les beques d’assistència, el SOIB ha de tramitar la proposta de pagament una vegada finalitzada cada competència clau i s’ha de presentar el certificat d’aprofitament i pel que fa als ajuts de transport i de la beca per a dones víctimes de violència de gènere s’ha de tramitar en acabar les accions formatives, una vegada computats els dies efectius d’assistència dels alumnes.</span></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. S’ha comprovat que els alumnes relacionats a l’annex d’aquesta resolució estan al corrent en el compliment de les seves obligacions tributàries amb l’Estat, amb la Seguretat Social i amb la Hisenda de la Comunitat Autònoma de les Illes Balears. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. Les obligacions que han de complir els beneficiaris consten en el punt 5 de la Resolució de convocatòria i en la resta de normativa aplicable.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">6. Hi ha crèdit adequat i suficient a la partida pressupostària 76101 322D06 48015 00 18020 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’any 2018. </span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fonaments de dret</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Resolució del conseller de Treball, Comerç i Indústria i president del Servei d’Ocupació de les Illes Balears, de 5 de desembre de 2017, (<em>BOIB núm.153, de 16 de desembre</em>), s’obre la convocatòria per a la presentació de sol·licituds de beques i ajuts de la convocatòria informativa dirigida als alumnes de les especialitats formatives corresponents a les competències clau impartides pels centres educatius per a persones adultes, per al període 2018-2019.&nbsp; </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. L’article 2.2 del Decret 37/2015, de 22 de maig, d’aprovació dels Estatuts del Servei d’Ocupació de les Illes Balears ‎(<em>BOIB núm. 77, de 23 de maig</em>) estableix&nbsp; que el SOIB, per a l’acompliment dels seus fins, pot dur a terme, entre altres, les funcions necessàries per gestionar les polítiques actives d’ocupació; gestionar el conjunt de programes i mesures d’orientació, ocupació, formació i formació amb alternança amb l’ocupació, que tenen per objecte millorar les possibilitats d’accés a la col·locació de les persones desocupades en el mercat de treball, per compte propi o d’altri; l’adaptació de la formació i requalificació per a l’ocupació dels treballadors, així com les altres accions destinades a fomentar l’esperit empresarial, l’economia social i a millorar les condicions dels treballadors. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. D’acord amb els apartats <em>g</em> i <em>i</em> de l’article 9.4 del Decret 37/2015, de 22 de maig, d’aprovació dels Estatuts del Servei d’Ocupació de les Illes Balears, és funció del president del SOIB autoritzar despeses, contreure obligacions i proposar pagaments del servei, així com concedir ajuts i subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. La Llei 38/2003, de 17 de novembre, general de subvencions, té per objecte la regulació del règim jurídic general de les subvencions atorgades per les administracions públiques (<em>BOE 276, de 18 de novembre</em>).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s’aprova el text refós de la Llei de subvencions (<em>BOIB núm. 196, de 31 de desembre</em>); té per objecte determinar el règim jurídic de les subvencions, la gestió de les quals correspon a l’Administració de la comunitat autònoma de les Illes Balears o a les entitats públiques que en depenen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">6. La concessió d’aquestes beques i ajuts s’ha de fer de manera directa segons el procediment que estableix el Reial decret 357/2006, de 24 de març, pel qual es regula la concessió directa de determinades subvencions en els àmbits de l’ocupació i de la formació professional ocupacional, prèvia sol.licitud e l’alumne/a, atès el que disposa l’article 28 de l’Ordre TAS/718/2008, de 7 de març, en concordança amb l’article 22.2 en relació amb l’article 28 de la Llei 38/2003, de 17 de novembre, general de subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">7. D’acord amb l’article 39.7 del Decret legislatiu 2/2005, de 28 de desembre, les subvencions que es concedeixen en consideració a la concurrència d’una determinada situació en el perceptor, no requereixen cap altra justificació que l’acreditació per qualsevol mitjà admissible en dret de la situació esmentada prèviament a la concessió, sense perjudici dels controls que es puguin establir per verificar-ne l’existència.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">8. Ordre TAS 718/2008, de 7 de març, per la qual es desenvolupa el Reial Decret 395/2007, de 23 de març per el qual es regula el subsistema de formació professional per a l’ocupació, en matèria de formació d’oferta i s’estableixen les bases reguladores per a la concessió de subvencions públiques destinades a la seva financiació. Aquesta Ordre TAS/718/2008,&nbsp;s’ha d’entendre en vigor mentre no entri en vigor la normativa que desenvolupa el Reial decret 694/2017, d’acord amb el primer apartat de la seva Disposició Transitòria primera.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">9. La Llei 13/2014, de 29 de desembre, de pressuposts generals de la Comunitat Autònoma de les Illes Balears per l’any 2015, en la disposició final setena modifica l’article 1 de la Llei 7/2000, de 15 de juny, de creació del Servei d’Ocupació de les Illes Balears, i el defineix com un organisme autònom dotat de personalitat jurídica pròpia i plena capacitat d’obrar, adscrit a la conselleria competent en matèria de treball. D’acord amb el Decret 24/2015, de 7 d’agost, de la presidenta de les Illes Balears, les competències en matèria de treball estan atribuïdes a l’actual conselleria de Treball, Comerç i Industria.</span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Conclusió </strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Inform favorablement sobre la concessió de subvencions en concepte de beques adreçades als treballadors desocupats, alumnes de les especialitats formatives corresponents a les competències clau impartides pels centres educatius per a persones adultes (CEPAS) durant el període 2018-2019 que han presentat les sol·licituds corresponents de beques per assistència així com ajudes de transport, amb càrrec a la partida pressupostària 76101 322D06 48015 00 18020 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’exercici 2018, així com autoritzar i disposar la despesa, reconèixer l’obligació i proposar-ne el pagament dels alumnes relacionats a l’annex.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Palma, 6 de març de 2018</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El cap del Servei de Gestió de Programes d’Ocupació 5</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Gabriel Oliver Crespí</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès l’informe favorable del Servei de Gestió de Programes d’Ocupació 5, s’eleva a la consideració del conseller de Treball, Comerç i Industria, president del Servei d’Ocupació de les Illes Balears, la següent:</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Proposta de resolució</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Concedir una subvenció en concepte de beca als beneficiaris que figuren en l’annex d’aquesta Resolució en els termes següents:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a. Beques per assistència:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’import total de la beca per assistència que correspon a cada alumne s’ha de calcular d’acord amb l’establert a l’apartat 7 a) de l’annex 1 de la Resolució de la convocatòria: 13 € per dia d’assistència, amb un màxim de 328,00 € per competència clau amb qualificació d’aprofitament.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">b. Ajuts per transport:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’import total de la beca per assistència que correspon a cada alumne s’ha de calcular d’acord amb l’establert a l’apartat 7 b) de l’annex 1 de la Resolució de la convocatòria: 1,50 € per dia d’assistència, en concepte de transport públic urbà; 4,50€ per dia d’assistència, en concepte de transport públic interurbà.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Autoritzar i disposar la despesa per un import total de 6.009,50 € a favor dels beneficiaris que figuren en l’annex d’aquesta Resolució, amb càrrec a la partida pressupostària 76101 322D06 48015 00 18020 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’exercici 2018. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Reconèixer l’obligació i proposar per un import total de 6.009,50 €&nbsp; a favor dels beneficiaris que figuren en l’annex d’aquesta Resolució, amb càrrec a la partida pressupostària 76101 322D06 48015 00 18020 dels pressuposts de la Comunitat Autònoma de les Illes Balears per a l’exercici 2018. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4.
