CAIB 600874 150 CAIB text/html 11551 33685 2017-10-21 33686 ![CDATA[Resolució de la consellera executiva de Modernització i Funció Pública per la que s’aprova la llista definitiva d’aspirants seleccionats per constituir dues borses, pel procediments extraordinari i específic de selecció, de la subescala, classe o categoria de mestre –a marger -a, referent a la convocatòria publicada al BOIB núm. 63, de dia 23 de maig de 2017, per cobrir, amb caràcter d’interinitat, places vacants del Consell de Mallorca]] ca CAIB 2017-10-21 2017-10-19 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Us comunic que la consellera executiva del Departament de Modernització i Funció Pública del Consell Insular de Mallorca en el dia d’avui, ha resolt:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>“Fets</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. L’article 15 de la Llei 3/2007, de 27 de març, de la Funció Pública de la Comunitat autònoma de les Illes Balears, en matèria de&nbsp; nomenament de funcionari interí i d’acord amb el que s’estableix a l’article 4 del Decret 30/2009 de 22 de maig, pel qual s’aprova el procediment de selecció de funcionaris interins al servei de l’Administració de la comunitat autònoma de les Illes Balears, quan s’exhaureixi una borsa, no n’hi hagi cap d’anterior que disposi d’aspirants i es prevegi la necessitat de cobertura de vacants per a diferents escales, classes o categories, s’haurà de fer una convocatòria pública de concurs per constituir una nova borsa amb els aspirants que superin el nivell mínim exigit a aquest efecte, ordenats d’acord amb el barem establert a cada cas.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. En data 29 de setembre de 2017 s’emet&nbsp; la proposta de la Junta Qualificadora d’aprovació del llistat provisional de mèrits dels aspirants seleccionats per constituir dues borses d’aquesta categoria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. En data 16 d’octubre de 2017 es reuneix la Junta Qualificadora per tal de revisar presencialment amb els aspirants que així ho han demanat, la valoració realitzada dels mèrits i revisar d’ofici la resta de reclamacions, i acorda el següent:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">a. Desestimar les reclamacions interposades atès que la Junta Qualificadora les revisa i considera com a correcta la valoració realitzada</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per tot això, dict la següent</span></p> <h6 style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Resolució</span></h6> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprovar, de conformitat amb la proposta efectuada per la Junta Qualificadora, la llista definitiva d’aspirants seleccionats per constituir dues borses de la subescala, classe o categoria de mestre –a marger -a amb indicació de la puntuació obtinguda i del número d’ordre de prelació, que s’adjunta a l’annex I.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Aquesta Resolució es publicarà en el <em>Butlletí Oficial de les Illes Balears</em> i s’exposarà al públic en el tauler d’edictes de l’edifici de la Llar de la Infància i a la Seu electrònica del Consell de Mallorca.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta resolució, que no posa fi a la via administrativa, podeu interposar el recurs d’alçada davant la Presidència del Consell Insular de Mallorca, en el termini d’un mes, comptador a partir de l’endemà de rebre aquesta notificació.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra la desestimació expressa d’aquest recurs d’alçada podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui en el termini de dos mesos, comptadors a partir de l’endemà de rebre la notificació de la desestimació del dit recurs d’alçada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si han transcorregut tres mesos des de la interposició del recurs d’alçada i no n’heu rebut la notificació de resolució expressa, s’entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat contenciós Administratiu de Palma que correspongui, sense limitació de temps.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant l’anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, i la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les
