text/html ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Notificació de Resolució de denegació als beneficiaris de les ajudes, PD1 de data 14 d’agost&nbsp; de 2017, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 19 de febrer de 2015, per la qual s’aprova la convocatòria de les ajudes per al foment de les pastures per a l’aprofitament de la Ramaderia Ecològica, per l’any 2015</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 19 de febrer de 2015 per la qual s’aprova la convocatòria de les ajudes, per al foment de les pastures per a l’aprofitament de la Ramaderia Ecològica, per l’any 2015 especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident del FOGAIBA, en data 14 &nbsp;d’agost de 2017, va signar la següent resolució, </span></p> <p> <span style="font-family:times new black;">Convocatòria 2015_PD1</span></em></strong></span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Antecedents</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1.En data 26 de febrer de 2015, es va publicar el BOIB núm. 29 l’Ordre del conseller d’Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>2.En data de 28 de febrer de 2015 es va publicar, en el BOIB núm. 30, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s’aprova la convocatòria per a l’any 2015 de les ajudes destinades al Foment de les pastures per a l’aprofitament de la Ramaderia Ecològica.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>3.En les dates 11 de juny i 7 de juliol de 2015 es varen publicar, en el BOIB núm. 87, unes modificacions de la Resolució citada anteriorment.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>4.De conformitat amb l'apartat sisè de l'esmentada Resolució de i l’ordre AAA/872/2015 de 2 de maig, publicat al BOE núm.114 del 13/05/2015 , el termini de presentació de sol·licituds va acabar el dia 15 de juny de 2015 i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 273 sol·licituds d'ajuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>5.Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>6.Els interessats assenyalats a l’Annex I adjunt han presentat, dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria, i s’ha comprovat que no compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>7.En data 1 de maig de 2017 es va publicar en la pagina WEB del FOGAIBA una proposta organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Llei 30/1992, de 26 de novembre de règim jurídic de les Administracions Públiques i del Procediment Administratiu Comú.</em></span></li> </ol> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Resolució de denegació</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per tot això, dicto una resolució en els termes següents:</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1.Denegar total o parcialment&nbsp; l’ajuda sol·licitada als beneficiaris detallats a l'Annex I.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>2.Publicar la resolució en el BOIB.</em></span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Interposició de recursos</em><em>.</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d’alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d’un mes, comptador des de l’endemà de la notificació de la resolució, d’acord amb l’article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la comunitat autònoma de les Illes Balears, i els articles 114 i 115 de la Llei 30/92, de 26 de novembre, de règim jurídic de les
