	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Notificació de Resolució de denegació als beneficiaris de les ajudes, RD5 de data 29 de setembre&amp;nbsp; de 2017, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 4 de febrer de 2016, per la qual es convoquen les ajudes destinades al pagament compensatori per a zones amb limitacions específiques, per l’any 2016&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;L’apartat 8.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 4 de febrer de 2016 per la qual es convoquen les ajudes destinades al pagament compensatori per a zones amb limitacions específiques, corresponents a l’any 2016, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, procediment administratiu comú de règim jurídic de les administracions públiques. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;El vicepresident del FOGAIBA, en data 29 de setembre de 2017, va signar la següent resolució, &lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;“RESOLUCIÓ DE DENEGACIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p align="center"&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Programa de Desenvolupament Rural de les Illes Balears 2014-2020&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;strong&gt;&lt;em&gt;Convocatòria: PCES 2016/ RD5&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. En data de 6 de febrer de 2016 es va publicar, en el BOIB núm. 18, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s’aprova la convocatòria per a l’any 2016 de les ajudes destinades al pagament compensatori per a zones &amp;nbsp;amb limitacions específiques.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. En data 1 de març de 2016 es va publicar, en el BOIB núm. 28, una modificació de la Resolució citada anteriorment, i el 7 de juliol de 2016 es va tornar a modificar al BOIB núm. 86.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. De conformitat amb l'apartat sisè de l'esmentada Resolució i l’ordre AAA/872/2015 de 2 de maig, publicat al BOE núm.114 del 13/05/2015, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/06/2015, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 491 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;4. Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;5. Una vegada avaluades les sol·licituds d’ajuda pels òrgans gestors, i d'acord amb els criteris d’elegibilitat establerts, els interessats assenyalats a l’Annex I adjunt no compleixen amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. En data 31 d’agost&amp;nbsp; de 2017 el Servei d’Ajudes al Desenvolupament Rural ha emès informe desfavorable i proposta provisional de denegació de l'ajuda als interessats.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. En data 4 de setembre de 2017 es notifica, mitjançant publicació a la pàgina web &lt;span style="color: windowtext;"&gt;http://www.caib.es&lt;/span&gt;, l’esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;8. A data d’avui i un cop finalitzat el termini establert, no consta a aquest servei que hagi tingut entrada al Registre del FOGAIBA cap escrit d’al·legacions per part dels interessats relacionats a l'Annex I adjunt.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 4 de febrer de 2016 per la qual s’aprova la convocatòria per a l’any 2016 de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques, la Resolució publicada l’1 de març de 2016 i la Resolució publicada el 7 de juliol de 2016 (modificació de la primera) del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 4 de febrer de 2016, per la qual s’aprova la convocatòria, per a l’any 2016, de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 22 de juliol BOIB núm. 95, de 28 de juliol de 2016, per la qual es modifiquen els crèdits i els cofinançaments de diverses convocatòries de subvencions del FOGAIBA, corresponents a les mesures contemplades en el Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;6. Reglament d’execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s’estableixen disposicions d’aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l’ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;7. Reglament d’execució (UE) núm. 809/2014 de la Comissió, de 17 de juliol de 2014, pel qual s’estableixen disposicions d’aplicació del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control, les mesures de desenvolupament rural i la condicionalitat.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;8. Reial decret 1075/2014, de 19 de desembre, sobre l’aplicació a partir del 2015 dels pagaments directes a l’agricultura i a la ramaderia i altres règims d’ajuda, així com sobre la gestió i control dels pagaments directes i dels pagaments al desenvolupament rural.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Reial decret 1078/2014, de 19 de desembre, pel qual s’estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Ordre del conseller d’Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;15. Llei 12/2014, de 16 de desembre, agrària de les Illes Balears. &lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;16. Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;span style="color: windowtext;"&gt;BOIB núm. 082 de 2007&lt;/span&gt;; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;17. Llei 30/1992, de 26 de novembre de règim jurídic de les administracions públiques i del procediment administratiu comú.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Proposta de resolució de denegació &lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Per tot això, s’informa desfavorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;1. Denegar les sol·licituds presentades pels interessats relacionats a l'Annex I, per incompliment de requisits que s'indiquen a l'esmentat annex.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;2. Declarar conclòs el procediment i procedir a l’arxiu dels expedients detallats a l’Annex I.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;3. Notificar la resolució a cada un dels interessats de l'Annex I .&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;strong&gt;&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;
	&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d’alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d’un mes, comptador des de l’endemà de la notificació de la resolució, d’acord amb els articles 121 i 122 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

		&lt;span style="font-family:times new roman,times,serif;font-size:12px;"&gt;&lt;em&gt;Incompliment del punt 2.a) de l’apartat Tercer de la resolució del president del FOGAIBA per la qual s’aprova la convocatòria, per a l’any 2016, de les ajudes destinades al pagament compensatori per a zones amb limitacions específiques, referent al requisit de les explotacions de tenir superfície elegible inclosa a l’àmbit territorial d’aplicació de la resolució.&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
