El dia 28 de setembre de 2017, la Comissió Negociadora del Conveni col·lectiu del sector de la hostaleria de les Illes Balears va subscriure l’Acta de la sessió extraordinària sobre l’ampliació de la vigència temporal del conveni, sobre les retribucions salarials del nou àmbit temporal, la modificació dels articles 14 i 15, i la incorporació d’una nova disposició transitòria sobre salut laboral.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El dia 2 d’octubre, el senyor José Carlos Sedano Almiñana, en representació de la Comissió Negociadora del Conveni col·lectiu, va sol·licitar el registre, el dipòsit i la publicació de l’Acta esmentada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fonaments de dret</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. L’article 90.3 del Text refós de la Llei de l’Estatut dels treballadors, aprovat pel Reial decret legislatiu 2/2015, de 23 d’octubre.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El Reial decret 713/2010, de 28 de maig, sobre registre i depòsit de convenis i acords col·lectius de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Sandra RODRÍGUEZ LLOMPART</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A Palma (Illes Balears), a les 12 hores del dia 28 de setembre de 2017, a la seu de la <em>Conselleria de Treball, Comerç i Indústria</em>, <em>del Govern de les Illes Balears</em>, <em>plaça de Son Castelló núm. 1 (polígon de Son Castelló</em>), d'aquesta capital, es reuneixen les persones enumerades en el marge esquerre de l'acta, que compareixen en representació de les organitzacions empresarials i sindicals que així mateix se citen, amb la finalitat de constituir-se en Comissió negociadora del Conveni col·lectiu ressenyat més amunt, de conformitat amb els articles 86, 87, 88 i concordants de la Llei de l'Estatut dels treballadors (d'ara endavant ET), en concret amb el que es disposa en el segon paràgraf de l'apartat 1 de l'article 86 del dit text estatutari, i així, celebrar una sessió extraordinària de l'esmentada Comissió, a fi de negociar i acordar la revisió del Conveni.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les parts han estat convocades tant telefònicament com per correu electrònic i per burofax amb justificant de recepció dirigit per la FEHM. No consta el justificant de recepció del burofax de la Federació de Serveis CCOO-Illes, ni de l'Associació Mallorquina de Cafeteries, Bars i Restaurants. El dirigit a la Federació PIME Restauració de Balears, a via Alemanya, núm. 4 d'aquesta ciutat, no es va poder lliurar, segons <em>CORREUS</em> per ‘desconegut’. L'Associació Menorquina de Cafeteries, Bars i Restaurants (integrats a PIME Menorca) s’excusa d’assistir-hi per l'escàs marge amb què ha estat convocada. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La Comissió Negociadora està formada per les mateixes parts legitimades que la constitueixen, en data 31 de gener de 2014, amb el repartiment previst en l'apartat 1 de l'article 88 ET i en les mateixes proporcions de representació, que majoritàriament van subscriure el Conveni col·lectiu vigent, que es va publicar en el <em>Butlletí Oficial de la Comunitat Autònoma de les Illes Balears</em> (BOIB) núm. 103, de 31 de juliol de 2014, amb l'única circumstància que l'Associació Empresarial de Restauració de Mallorca (AERM) va sol·licitar la seva baixa en data 16 de febrer de 2015 del Registre <em>d'Associacions de la Conselleria d'Economia i Competitivitat</em> i que va acordar el dia 18 de desembre de 2014 la unió amb <em>l'Associació Mallorquina de Cafeteries, Bars i Restaurants</em>.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D’aquesta circumstància ja es va deixar constància en l'Acta també extraordinària de la mateixa Comissió negociadora de data 25 de febrer de 2015, publicada en el BOIB núm. 37, de 17 de març de 2015, on es va negociar la revisió de l'article 31 del Conveni col·lectiu.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">També cal dir que aquesta mateixa Comissió Negociadora es va reunir en sessió extraordinària el dia 1 d'agost de 2016, i va negociar la revisió de nou del text convencional acordant afegir una nova disposició transitòria, la sisena, que es va publicar en el BOIB número 118, de 17 de setembre de 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Les tres publicacions anteriors en el Butlletí Oficial constitueixen el patrimoni del text convencional vigent en el dia de la data, al qual s'uniran els acords que s'assoleixin en la reunió del dia de la data.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Es convé que aixequi l'acta de la reunió, com a secretari de la Comissió, el senyor Carlos Sedano Almiñana, assessor de la FEHM, qui a més moderarà la sessió.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'organització empresarial ASHOME ha dirigit a la FEHM l'escrit que a continuació es transcriu sobre la seva posició davant un possible acord en el Conveni col·lectiu, signat per la gerent, senyora Azucena Jiménez, i pel president de l'associació, senyor Luis Pablo Casals. El text del comunicat és el següent:</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>“A Menorca (Illes Balears,) a 26 de setembre de 2017</em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Ref.: convocatòria extraordinària de la Comissió Negociadora del XV Conveni col·lectiu sectorial d'hostaleria de la comunitat autònoma de les Illes Balears.</em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>L'Associació Hotelera de Menorca, reunida en junta de govern amb caràcter d'urgència, comunica a la Comissió Negociadora: </em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>1.En relació amb l'oferta d'acord en la negociació col·lectiva, per tancar-la en la convocatòria extraordinària de la Comissió Negociadora del dijous 28 de setembre de 2017, els comunicam: </em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Que l'Associació Hotelera de Menorca es compromet a estudiar la proposta presentada.</em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>A causa de la importància que tindrà per als nostres associats, la junta de govern decideix traslladar-los a tots l'acord, per la qual cosa es convocarà assemblea per debatre’l i votar-lo.</em></span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>2. Així mateix, la Junta de Govern d'Ashome valora com una proposta més realista la de la Federació Hotelera d'Eivissa i Formentera (FEHIF).</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Pren la paraula la representació de l'Associació Mallorquina de Cafeteries, Bars i Restaurants (CAEB) i manifesta la seva disconformitat amb la proposta del text que s’ha de signar, perquè és inassumible per a les empreses associades a la seva organització. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El representant d'ABONE també manifesta la seva disconformitat, igualment, perquè no és assumible per als seus interessos, i entén que, a més, els és d'aplicació, a les empreses i treballadors del seu subsector, el Conveni estatal de sales de festa. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L'objecte de la convocatòria és acordar i pactar la revisió de determinades matèries del Conveni col·lectiu, segons l'ordre que s’assenyala a continuació:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">A. Article 2. ÀMBIT TEMPORAL I DENÚNCIA. S'acorda ampliar la vigència temporal del Conveni col·lectiu continguda en el primer paràgraf d'aquest article fins al dia 31 de març de l'any 2022, i deixar sense efecte la data prevista que recull; això és, fins al dia 31 de març de 2018. La resta de l'article es manté en els seus propis termes.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">B. Article 14. CONTRACTACIÓ O SUBCONTRACTACIÓ DE SERVEIS. Modificar l'article, amb el següent nou tenor literal: </span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. EXTERNALITZACIÓ DE SERVEIS. Sense perjudici de la informació sobre previsions en matèria de subcontractació a què es refereix l'article 64 ET, quan l'empresari concerti un contracte de prestació de serveis amb una empresa contractista o sotscontractista, haurà d'informar la representació legal dels seus treballadors sobre els aspectes següents: </span></p> <p style="margin: 0px 0px 0px 80px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a. Nom o raó social, domicili i número d'identificació fiscal de l'empresa contractista o sotscontractista.</span></p> <p style="margin: 0px 0px 0px 80px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b. Objecte i durada de la contracta. </span></p> <p style="margin: 0px 0px 0px 80px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">c. Lloc d'execució de la contracta.</span></p> <p style="margin: 0px 0px 0px 80px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">d. Si s’escau, nombre de treballadors que seran ocupats per la contracta o subcontracta al centre de treball de l'empresa principal.</span></p> <p style="margin: 0px 0px 0px 80px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">e. Mesures previstes per a la coordinació d'activitats des del punt de vista de la prevenció de riscos laborals.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">L'empresa haurà d'informar la representació legal dels treballadors de la celebració de contracta o subcontracta amb suficient antelació de l'inici de l'execució de la contracta i sempre amb un termini, almenys, de set dies naturals.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. SUBCONTRACTA DE SERVEIS DE CAMBRERA DE PISOS I CAMBRER DE PISOS. Les empreses que contractin o subcontractin amb altres la realització de serveis corresponents a l'activitat pròpia del lloc de treball de cambrera de pisos i cambrer de pisos, hauran de garantir als treballadors afectats que seran retribuïdes en les condicions recollides en aquest Conveni col·lectiu en el nivell salarial corresponent.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">En el període de desembre a febrer, en el qual l'activitat és intermitent o extraordinària (de durada inferior a dotze dies naturals, per a grups, esdeveniments, etc.), l'empresa podrà contractar o subcontractar els serveis corresponents a l'activitat de cambrer de pisos i cambrera de pisos, així com les activitats corresponents a l'activitat principal de l'empresa. En aquest cas s'aplicaran les condicions retributives del Conveni col·lectiu, sense que sigui exigible que l'empresa truqui als treballadors fixos discontinus i sense que això afecti la garantia mínima i continuada d'ocupació anual en les dates habituals d'incorporació dels dits empleats, ni afecti el volum d'ocupació fixa discontínua ordinari o fix de l'empresa.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. ALTRES OBLIGACIONS DE LES EMPRESES. Els empresaris afectats per aquest Conveni que contractin o subcontractin amb d'altres la realització de serveis corresponents a l'activitat principal d'aquells hauran de comprovar que els contractistes estan al corrent en el pagament de les quotes de la Seguretat Social, així com disposa l'apartat 1 de l'article 42 ET. A aquest efecte, demanaran per escrit, amb la identificació de l'empresa afectada, una certificació negativa per descoberts en la Tresoreria General de la Seguretat Social, que haurà de lliurar inexcusablement la dita certificació en el termini de trenta dies improrrogables i en els termes que reglamentàriament s'estableixin. Transcorregut aquest termini, l'empresari sol·licitador quedarà exonerat de responsabilitat.</span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Així mateix, aquests empresaris hauran de comprovar, a l’efecte de garantia de la seva percepció, que els treballadors prestataris d’aquests serveis són retribuïts, almenys, en les condicions que recull aquest Conveni col·lectiu. A l’efecte, les empreses sotscontractistes facilitaran a la principal les jornades de treball i els descansos realitzats pel treballador al centre de treball, a fi de comprovar que les condicions s'ajusten a aquest Conveni col·lectiu. </span></p> <p style="margin-left: 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">Quan l'externalització de serveis afecti treballadors amb contracte al centre de treball de l'empresa principal, l'empresa contractista se subrogarà en tots els drets i obligacions que aquests tinguin reconeguts, incloent-hi els de permanència dels treballadors al mateix centre de treball.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">C. Art. 15. JORNADA LABORAL. El cinquè paràgraf d'aquest article, relatiu al descans entre jornades, se substitueix pel següent: <em>“Per acord entre l'empresa i els representants legals dels treballadors, es podrà pactar la reducció del descans entre jornades, previst en l'apartat 3 de l'article 34 ET, a deu hores, de conformitat amb l'apartat 2 de l'article 7, del Reial decret 1561/1995, de 21 de setembre, sobre jornades especials de treball, únicament per al personal de les àrees funcionals segona (cuina i economat) i tercera (restauració, sala, bar i de similars) de l'ALEH V.”</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">D. RÈGIM RETRIBUTIU. En els 5 annexos a aquesta acta es fixen les retribucions per al període d'ampliació de la vigència establerta en la lletra A) d'aquest Acord. Els increments són els següents:</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">1. Per al període de l’1 de gener de 2018 a 31 de març de 2018, les retribucions tindran un increment del 3,875 %, calculat sobre les retribucions vigents al desembre de 2017. Aquest percentatge s'obté de deduir del 5 % acordat, l'1,125 % pactat al Conveni col·lectiu per al període de l’1 de març de 2017 al 31 de març de 2018.</span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Per al període de l’1 d'abril de 2018 a 31 de març de 2019, l'increment serà del 5 %, calculat sobre les retribucions vigents al desembre de 2017. Aquest percentatge és el sumatori del 3,875 % i l'1,125 %. </span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">3. Per al període de l’1 d'abril de 2019 al 31 de març de 2020, l'increment serà del 5 per 100, calculat sobre les retribucions vigents al desembre de 2017, que s'afegirà al resultat del 5 per 100 revisat segons el número precedent. </span></p> <p style="margin: 0px 0px 0px 40px;"> <span style="font-family:times new roman,times,serif;font-size:12px;">4. V ACORD LABORAL D'ÀMBIT ESTATAL PER AL SECTOR D'HOSTALERIA (ALEH V). Totes les ressenyes que es fan en el text del Conveni col·lectiu al IV ACORD LABORAL D'ÀMBIT ESTATAL PER AL SECTOR D'HOSTALERIA (ALEH IV), s'han de tenir referides al V ACORD LABORAL D'ÀMBIT ESTATAL PER AL SECTOR D'HOSTALERIA (ALEH V), publicat en el BOE número 21, de 21 de maig de 2015.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">G. Es deroga i deixa sense efecte la disposició addicional desena del Conveni col·lectiu (INCREMENTS RETRIBUTIUS EN CAS DE PRÒRROGA DEL CONVENI).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">H. Disposició transitòria tercera (nova). Incloure-la en aquesta disposició, ja que la mateixa, amb el mateix ordinal, ha quedat derogada en virtut de la lletra F) d'aquest Acord, el títol de la qual serà “SALUT LABORAL”, amb el text següent: <em>“Disposició transitòria tercera. SALUT LABORAL. Les parts signants d’aquest Conveni col·lectiu pacten proposar al Govern de les Illes Balears la subscripció d'un Acord tripartit que tingui per objecte reduir la sinistralitat laboral i la millora en la qualitat de les condicions de treball de les treballadores i els treballadors del sector.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>L’Acord inclourà, com a objectiu específic, l'estudi de les càrregues físiques de treball en les empreses del sector, en particular les condicions d'ergonomia i la dels sobreesforços, i habilitarà els instruments necessaris per avaluar-les i establir mesures preventives que permetin assolir un entorn de treball saludable, comptant en tot cas amb la participació dels comitès de seguretat i salut de les empreses i, si s’escau, dels delegats de prevenció, i tot això es durà a terme al si de la Fundació per a la Prevenció de Riscos Laborals al Sector d'hostaleria de les Illes Balears.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els estudis, els treballs i l’elaboració dels diferents instruments d'actuació, s'hauran d'iniciar una vegada publicat aquest Acord de revisió del Conveni col·lectiu en el BOIB, i s’hauran de culminar abans que se n’acabi la vigència.”</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">De la forma exposada s'assoleix aquest Acord com a expressió de la voluntat de les parts legitimades i majoritàries de revisar el text articulat del Conveni col·lectiu en els vuit punts exposats, amb eficàcia erga omnes per a totes les empreses i treballadors del sector d'hostaleria en les Illes Balears.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Com que no cal tractar més assumptes, els presents acorden designar el senyor Carlos Sedano Almiñana, assessor de la FEHM, perquè inscrigui en el Registre de Convenis Col·lectius (REGCON) de l'autoritat laboral d'aquesta Comunitat Autònoma l'Acord recollit en aquesta acta, i en sol·liciti la publicació en el BOIB. </span></p> <p> <span
