26375 CAIB text/html 598453 ca 2017-08-15 CAIB ca CAIB 9007 ![CDATA[Concessió de subvencions de la convocatòria de subvencions pel desenvolupament de l’activitat esportiva dels clubs esportius de Mallorca 2017 (BDNS 335881)]] 2017-08-15 140 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports, en data d’avui, ha dictat la següent resolució, que transcric, literalment, a continuació: </em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong style="font-family: &quot;times new roman&quot;, times, serif;">Resolució relativa a la concessió de subvencions de la convocatòria de subvencions pel desenvolupament de l’activitat esportiva dels clubs esportius de Mallorca 2017</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong style="font-family: &quot;times new roman&quot;, times, serif;">Antecedents</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El 16 de març de 2017 el vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports va aprovar la convocatòria de subvencions pel desenvolupament de l’activitat esportiva dels clubs esportius de Mallorca 2017. Aquesta resolució es va publicar al BOIB núm. 35 de 23 de març de 2017.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El dia 25 de juliol de 2017 la comissió avaluadora va emetre l’informe relatiu a la resolució d’aquesta convocatòria de subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’òrgan instructor, ha emès l’informe sobre el compliment dels requisits de la bases de la convocatòria esmentada per part de les entitats beneficiàries recollides en els informes de la comissió Avaluadora.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’existència de crèdit pressupostari adequat i suficient a la partida pressupostària 20.34101.48901 per atendre a la concessió de les subvencions proposades resta acreditada en virtut de la Reserva de Crèdit amb el núm. de referència 220170000057, per un import de 150.000,00 €. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Consta en l’expedient que les entitats que es proposa com a beneficiàries es troben al corrent de les seves obligacions tributàries (AEAT), amb el Consell de Mallorca i amb la Seguretat Social.&nbsp;&nbsp; </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès el&nbsp; previst a l’apartat g) de l’article 1 del Decret de 9 de juny de 2017 (BOIB núm. 73 de 15 de juny de 2017),&nbsp; pel qual es determina l’organització del Consell de Mallorca, i a la base 23.5 de les d’execució del pressupost 2017, correspon al&nbsp; vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports la resolució d’aquesta convocatòria de subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès l’informe de fiscalització prèvia de 7 d’agost de 2017&nbsp; (ref. FS-001/17)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per tot l’anterior, dict la següent </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Resolució</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Primer.-</strong> Aprovar i concedir les subvencions per un import total de cent quaranta-nou mil nou-cents noranta-nou euros i noranta-set cèntims &nbsp;(149.999,97 €)&nbsp; a favor dels clubs esportius beneficiaris relacionats i en la quantia que s’indica a la taula de l’annex 1 d’aquesta resolució.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Segon.-</strong> Disposar d’una despesa de cent quaranta-nou mil nou-cents noranta-nou euros i noranta-set cèntims (149.999,97 €) a càrrec de l’aplicació pressupostària 20.34101.48901, a favor dels clubs esportius beneficiaris que es relacionen a la taula de l’annex 1 i pels imports que hi consten.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Tercer.-</strong> Barrar la diferència entre l’import autoritzat per aquesta convocatòria (150.000,00 €) i l’import disposat (149.999,97 €) alliberant el crèdit sobrant (0,03 €)&nbsp; de l’aplicació pressupostària 20.34101.48901.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Quart.-</strong> Denegar la sol·licitud presentada per l’entitat Vall d’or Golf Club S.A. (CE2017/128) atès que no és un club esportiu als efectes del previst a l’article 44 de la Llei 14/2006, de 17 d’octubre de l’Esport de les Illes Balears, amb relació amb el punt 2.1 de la convocatòria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Cinquè.-</strong> Acceptar la renuncia a les sol·licituds presentades pel C. F. El recurs es pot interposar formalment davant aquest conseller executiu o davant la presidència del Consell Insular de Mallorca, que és l’òrgan competent per resoldre’l.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra la desestimació expressa d’aquest recurs d’alçada, hi podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, en el termini de dos mesos, comptadors a partir de l’endemà de rebre la notificació de la desestimació del dit recurs d’alçada. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si han transcorregut tres mesos des de la interposició del recurs d’alçada i no n’heu rebut la notificació de resolució expressa, s’entén desestimat per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, en el termini de sis mesos, comptadors a partir de l’endemà de la desestimació presumpta. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant l’anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú. Tot això de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa i la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p> <span style="font-family:times new
