2017-08-17 ca 2017-08-14 9008 CAIB 110 26503 ca CAIB ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports, en data d’avui, ha dictat la següent resolució, que transcric, literalment, a continuació: </em></span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong style="font-family: &quot;times new roman&quot;, times, serif;">Resolució de concessió de subvencions de la convocatòria de subvencions </strong><strong style="font-family: &quot;times new roman&quot;, times, serif;">pel desenvolupament de l’activitat esportiva de les entitats esportives inscrites en els Jocs Esportius Escolars en la temporada 2016-17</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Antecedents</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El dia 18 de febrer de 2017 es va publicar al BOIB núm. 21 l’Ordenança de Subvencions del Consell de Mallorca.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Mitjançant resolució de 22 de març de 2017 el vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports va aprovar la convocatòria de subvencions pel desenvolupament de l’activitat esportiva de les entitats esportives inscrites en els Jocs Esportius Escolars en la temporada 2016-17. L’extracte d’aquesta convocatòria es publicà al BOIB &nbsp;núm. 39 d’1 d’abril de 2017.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">La comissió avaluadora va emetre l’informe relatiu a la resolució de la convocatòria de subvencions per al desenvolupament de l’activitat esportiva dels clubs esportius de Mallorca.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’òrgan instructor de la convocatòria, ha emès l’informe sobre el compliment dels requisits de la bases de la convocatòria esmentada per part de les entitats beneficiàries recollides en els informes de la Comissió Avaluadora.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’existència de crèdit pressupostari adequat i suficient a la partida pressupostària 20.34101.48901 per atendre a la concessió de les subvencions proposades resta acreditada en virtut de la Reserva de Crèdit amb el núm. de referència 220170000451, per un import de 100.000,00 €. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès el&nbsp; previst a l’apartat g) de l’article 1 del Decret de 9 de juny de 2017 (BOIB núm. 73 de 15 de juny de 2017),&nbsp; pel qual es determina l’organització del Consell de Mallorca, i a la base 23.5 de les d’execució del pressupost 2017, correspon al&nbsp; vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports la resolució d’aquesta convocatòria de subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atès l’informe de fiscalització prèvia de 4 d’agost de 2017&nbsp; (ref. FS-009/17)</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Per tot l’anterior, dict la següent</span></p> <p style="text-align: center;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Resolució</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Primer.-</strong> Aprovar i concedir les subvencions per un import de noranta-nou mil nou-cents vuitanta-vuit euros i cinquanta-dos cèntims (99.988,52 €)&nbsp; a favor de les 49 entitats relacionades i en la quantia que s’indica a la taula de l’annex &nbsp;d’aquesta resolució.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Segon.-</strong> Disposar la despesa de noranta-nou mil nou-cents vuitanta-vuit euros i cinquanta-dos cèntims &nbsp;(99.988,52 €)&nbsp; amb càrrec a l’aplicació pressupostària 20.34101.48901, a favor de les 49 entitats beneficiaries que es relacionen a la taula de l’annex i pels imports que hi consten.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Tercer.-</strong> Barrar la diferència entre l’import autoritzat per aquesta convocatòria (100.000,00 €) i l’import disposat (99.988,52 €), alliberant el crèdit sobrant (11,48 €)&nbsp; de l’aplicació pressupostària 20.34101.48901.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Quart.-</strong> Denegar les sol·licituds presentades per les entitats (JEE2017/001) Club Badminton CIDE, (JEE2017/006) Unión Deportiva Collerense i (JEE2017/054) Asociación Palma Padel, atès que no compleixen el requisit d’estar inscrites al Programa Jocs Esportius Escolars a la data de publicació d’aquesta convocatòria (apartat 2.1.2).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Cinquè.- </strong>Acceptar el desistiment a les sol·licituds presentades per les entitats (JEE2017/044) Gimnasio Yong i (JEE2017/051) AMIPA CP Ariany , d’acord amb el previst a l’article 94 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les Administracions Públiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Sisè.-</strong> Publicar aquest acord al BOIB per conducte de la Base de Dades Nacional de Subvencions</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta resolució, que no posa fi a la via administrativa, podeu interposar el recurs d’alçada davant la Presidència del Consell Insular de Mallorca, en el termini d’un mes, comptador a partir de l’endemà de la seva publicació. Contra la desestimació expressa d’aquest recurs d’alçada podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, en el termini de dos mesos, comptadors a partir de l’endemà de rebre la notificació de la desestimació del dit recurs d’alçada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Si han transcorregut tres mesos des de la interposició del recurs d’alçada i no n’heu rebut la notificació de la resolució expressa, s’entén desestimant per silenci i podeu interposar el recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Palma que correspongui, en el termini de sis mesos, comptadors a partir de l’endemà de la desestimació presumpta. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant l’anterior, podeu interposar, si escau, qualsevol altre recurs que considereu oportú.
