concessió als beneficiaris de les ajudes, R 10 de data 28 de juny de 2017, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries, per als anys 2015-2019</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d’acord amb els termes que preveu l’article 45.2 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 43 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident del FOGAIBA, en data 28 de juny de 2017, va signar la següent resolució,</span></p> <p align="center"> <span roman,times,serif;font-size:12px;"><em>Antecedents</em></span></strong></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>En data de 16 de juliol de 2015 es va publicar, en el BOIB núm. 106, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>De conformitat amb l'apartat sisè de l'esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 31 de desembre de2015, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 208 sol·licituds d'ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els interessats assenyalats a l’Annex I adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i s’ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Les actuacions sol·licitades pels interessats compleixen amb els requisits establerts a la convocatòria per tal de poder ser subvencionables.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Tenint en compte que el crèdit existent cobreix la totalitat de les peticions d'aquesta convocatòria no <span style="color: black;">hi ha cap impediment per resoldre aquests expedients sense afectar el que disposa els apartats setè i vuitè de la convocatòria. </span></em></span></li> </ol> <p> <strong><span roman,times,serif;font-size:12px;"><em><span style="color: black;">Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007 ; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006. </span></em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em><span style="color: black;">Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques</span></em></span></li> </ol> <p style="text-align: center;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Proposta de resolució de concessió</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per tot això, s'informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:</em></span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Concedir l’ajuda sol·licitada als beneficiaris pels imports i amb els terminis detallats a l' Annex I , que són un total de 10 expedients i que comença amb </em></span><em><span class='lopd'>(dades personals ocultes)</span><span style="font-family:times new roman,times,serif;font-size:12px;"> i acaba amb </span><span class='lopd'>(dades personals ocultes)</span></em><span style="font-family:times new roman,times,serif;font-size:12px;"><em>, que suma un import total de &nbsp;286.006,96 euros, relativa a la línia d’ajuda relativa a la línia d’ajuda “Inversions a les explotacions agràries”.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l’Annex I. </em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Determinar que, d’acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l’Annex II.</em></span></li>
