de 2016, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 17 de març de 2015, per la qual s’aprova la convocatòria de les ajudes destinades a la protecció de varietats autòctones en risc d’erosió genètica, per l’any 2015</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 17 de març de 2015 per la qual s’aprova la convocatòria de les ajudes destinades a la protecció de varietats autòctones en risc d’erosió genètica, per l’any 2015 especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d’acord amb els termes que preveu l’article 60.2 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 59 de la Llei 30/1992, de&nbsp;&nbsp; novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident del FOGAIBA, en data 30 de desembre de 2016, va signar la següent resolució, </span></p> <p align="center"> <span style="font-family:times new roman,times,serif;font-size:12px;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <em>“</em><strong><em>RESOLUCIÓ DE CONCESSIÓ</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Programa de Desenvolupament Rural de les Illes Balears 2014-2020</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>Mesura 10.1.3- Protecció de varietats autòctones en risc d’erosió genètica.</em></strong></span></p> <p align="center" style="margin:0px;"> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em><span style="color: black;">Convocatòria 2015(VREG 2015)/R1</span></em></strong></span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Fets</em></span></strong></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>En data 26 de febrer de 2015, es va publicar al BOIB núm. 29 l’Ordre del conseller d’Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s’estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>En data de 19 de març 2015 es va publicar, al BOIB núm. 38, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s’aprova la convocatòria per a l’any 2015 de les ajudes destinades a la protecció de varietats autòctones en risc d’erosió genètica.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>En data 11 de juny de 2015 es va publicar, en el BOIB núm. 87, una modificació de la Resolució citada anteriorment.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>De conformitat amb l'apartat sisè de l'esmentada Resolució i l’ordre AAA/872/2015 de 2 de maig, publicada al BOE núm.114 del 13/05/2015, el termini de presentació de sol·licituds va acabar el dia 15/06/2015 i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 71 sol·licituds d'ajuda per a la protecció de varietats autòctones en risc d’erosió genètica (convocatòria 2015).</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Els òrgans gestors del Servei d’Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d’aquesta ajuda.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per a les espècies de faves mallorquines, civada rossa, civada negra i blat xeixa es superen els màxims establerts al punt 2 de l’apartat cinquè de la convocatòria, per la qual cosa per aquestes espècies s’aplica el corresponent prorrateig.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Una vegada revisats tots els expedients, i passat el termini per presentar al·legacions,&nbsp; hi ha 66 expedients que compleixen els requisits per ser beneficiaris d’aquesta ajuda. Per tal d’ajustar la concessió de les ajudes als recursos pressupostaris disponibles, com que el conjunt de peticions ha superat la dotació prevista a la convocatòria, s'ha prorratejat l’import global màxim entre totes les sol·licituds que compleixin els requisits per ser beneficiaris, tal i com preveu el punt dos de l'apartat setè de la convocatòria. El coeficient de prorrateig obtingut és 0,7088.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>A la LLISTA1 adjunta apareixen les persones interessades que compleixen amb els requisits exigits per poder ser beneficiaries d'aquesta ajuda, l’ajuda màxima que els hi correspon a cadascuna d’elles, després d’aplicar les reduccions escaients segons la convocatòria. </em></span></li> </ol> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Fonaments de dret</em></span></strong></p> <ol> <li> <span organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears <span style="color: black;">BOIB núm. 082 de 2007</span>; en virtut de l’Ordre de la consellera d’Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l’assumpció de l’execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l’article 1 que el FOGAIBA assumeix l’execució de la política de la Conselleria d’Agricultura i Pesca referent a l’aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l’1 de gener de 2006.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Llei 39/2015, d’1 d’octubre de règim jurídic de les administracions públiques i del procediment administratiu comú. </em></span></li> </ol> <p style="text-align: center;"> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>Proposta de resolució de concessió</em></span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per tot això, s'informa favorablement i proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:</em></span></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Concedir l’ajuda sol·licitada a les persones beneficiàries pels imports i els percentatges de cofinançament detallats a la LLISTA 1, que suposen un total de 18 expedients i que comença amb </em></span><em><span style="font-family:times new roman,serif;"><span class='lopd'>(dades personals ocultes)</span><span style="font-family:times new roman,times,serif;font-size:12px;"> i acaba amb </span><span class='lopd'>(dades personals ocultes)</span></span></em><span style="font-family:times new roman,times,serif;font-size:12px;"><em>que sumen un import total de CENT DINOU MIL CINC-CENTS QUARANTA-QUATRE EUROS I SEIXANTA-CINC CÈNTIMS (119.544,65 €), relativa a la línia d’ajuda “Protecció de varietats autòctones en risc d’erosió genètica-VREG2015”, amb les superfícies i espècies especificades a LLISTA 1.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Determinar que, d’acord amb el que estableix la convocatòria de referència, les obligacions de les persones beneficiàries seran les indicades a l’Annex I.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Publicar la resolució en el BOIB.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Informar a les persones beneficiàries que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Aquest compromís es considera complit amb una tolerància màxima de disminució de la superfície compromesa de 0,1 ha en grups de cultiu que tinguin fins a 0,5 has de superfície compromesa i un 10% en aquells de més de 0,5 has de superfície compromesa.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>- Participar, durant el període de compromís, en activitats de formació relacionades amb la mesura agroambiental.
