ca 2017-01-12 2017-01-10 ca 2017-01-12 CAIB 589664 560 CAIB CAIB 598 ![CDATA[Notificació de Resolució de modificació de concessió als beneficiaris de les ajudes, RM 1 de data 29 de novembre de 2016, per a la creació d’empreses de joves agricultors, per als anys 2015 a 2019]] 153 ![CDATA[<p> <span style="font-family:times new roman,times,serif;font-size:12px;">Notificació de Resolució de modificació de concessió als beneficiaris de les ajudes, RM 1 de data 29 de novembre de 2016, a l’empara de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 15 de setembre de 2015, per la qual es convoquen subvencions per a la creació d’empreses de joves agricultors, per als anys 2015 a 2019</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">L’apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 15 de setembre de 2015 per la qual es convoquen, subvencions per a la creació d’empreses de joves agricultors, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al <em>Butlletí Oficial de les Illes Balears </em>d’acord amb els termes que preveu l’article 60.2 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l’article 59 de la Llei 30/1992, de&nbsp;&nbsp; novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident del FOGAIBA, en data 29 de novembre de 2016, va signar la següent resolució,</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; “RESOLUCIÓ DE MODIFICACIÓ DE LES ANUALITATS&nbsp; DE FINANÇAMENT DE ALGUNES DE LES AJUDES CONCEDIDES&nbsp; A L’EMPAR DE LA RESOLUCIÓ DEL PRESIDENT DEL FONS DE GARANTIA AGRARIA I PESQUERA DE LES ILLES BALEARS (FOGAIBA), DE 10 DE SETEMBRE DE 2015, PER LA QUAL ES CONVOQUEN, PER ALS ANYS 2015 A 2019, SUBVENCIONS PER A LA CREACIÓ D’EMPRESES DE JOVES AGRICULTORS</em></strong></span></p> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>ANTECEDENTS</em></span></strong></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>En data 15 de setembre de 2015,es va publicar al BOIB Núm. 136 la convocatòria de subvencions, per als anys 2015-2019, per a la creació d’empreses de joves agricultors. Les convocatòries són un total de nou i es realitzen dues convocatòries per a cada exercici, a excepció de 2015, que es realitzà una sola convocatòria.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per Resolució del president del Fons de Garantía Agrària i Pesquera de les Illes Balears (FOGAIBA), de 22 de juliol de 2016,publicada al BOIB Núm. 95 de 28 de juliol, es varen modificar els crèdits i el cofinançament de la convocatòria de creació d’empreses de joves agricultors, destinant per a la convocatòria de 2015 un total de 10.989.227,39 €, distribuïts entre les anualitats pressupostàries de 2016 fins a 2023, essent l’anualitat pressupostària de 2016 la corresponent a l’addició del romanents de l’anualitat 2015 més la inicial de 2016, i establint un nou cofinançament de les ajudes que queda finalment un 41,00% l’UE, un 3.08% l’AGE i un 55,92% la CAIB.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>A hores d’ara s’han registrat moltes sol·licituds de pagament del 50% de l’ajuda corresponent a&nbsp; la primera part, d’acord amb les previsions de l’apartat onzè de la convocatòria. Algunes d’aquesta sol·licituds estan finançades amb pressupost de l’any 2016 i altres amb pressuposts posteriors. Atès que tota l’ajuda s’ha concedit finançada amb una sola anualitat, l’execució dels pagaments ens durà com a conseqüència importants romanents de les ajudes corresponents a l’any 2016, al temps que sol·licituds de pagament d’expedients finançats en anys posteriors no es podran pagar fins l’exercici pressupostaria adient</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Per tot l’exposat, es fa necessari modificar les anualitats de finançament de les ajudes quedant per l’any 2016 els imports que efectivament es pagaran i ajornant els imports del segon tram de l’ajuda a anys posteriors. Així amb els crèdits alliberats dins l’any 2016, es podran finançar expedients finançats inicialment amb els crèdits corresponents a anys posteriors i per tant es podrà atendre la sol·licitud de pagament.</em></span></li> </ol> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;"><em>FONAMENTS JURÍDICS</em></span></strong></p> <ol> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, pel qual s’estableixen les normes que regeixen l’ajuda de la Unió per al desenvolupament rural i deroga el Reglament (CE) núm. 1698/2005 del Consell.</em></span></li> <li> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Programa de Desenvolupament Rural de les Illes Balears, per al període 2014-2020 (PDR),&nbsp;
