<span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Fets i fonaments de dret</strong></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">1. Mitjançant la resolució del director general del Servei de Salut de les Illes Balears de 18 de gener de 2016, (BOIB núm. 10, de 21-10-2016) es va convocar un concurs oposició per cobrir places vacants de la categoria Conductor/a dependents del Servei de Salut de les Illes Balears.</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">2.Un cop finalitzades les proves selectives, el tribunal qualificador ha elevat al director general del Servei de Salut de les Illes Balears la llista d’aspirants que ha superat el procés selectiu i una relació complementària de persones aspirants que segueixen per ordre de puntuació a les proposades, pel cas que es produeixin renúncies o quan de la documentació exigida en la base 11.2 es desprengui que alguna de les persones seleccionades no compleix els requisits per ser nomenada com a personal estatutari fix.</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">Per tot això i d’acord am la base 11 de la convocatòria, dict la següent</span></p>
<p style="text-align: center;">
<strong><span style="font-family:times new roman,times,serif;font-size:12px;">Resolució</span></strong></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">1. Aprovar la llista d’aspirants (Annex I) que han superat el concurs oposició per cobrir places vacants de la categoria de Conductor/a , convocat mitjançant la resolució del director general del Servei de Salut de les Illes Balears de 18 de gener de 2016, (BOIB núm. 10, de 21-10-2016).</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">2. Publicar una llista complementària (Annex II) de persones aspirants que segueixen per puntuació a les que han superat el procés selectiu, pel cas que es produeixin renúncies o quan de la documentació exigida en la base 11.2 de la convocatòria es desprengui que alguna de les persones seleccionades no compleix els requisits per ser nomenada com a personal estatutari fix.</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">3. Publicar la llista de places (Annex III) que s’ofereixen a les persones que han superat les proves selectives.</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">4. En el termini de 20 dies hàbils comptadors des de l’endemà de la data en què es publiqui aquesta resolució en el BOIB, les persones aspirants seleccionades i les que figurin en la llista complementària han de presentar els documents següents:</span></span></p>
<p style="margin: 0px 0px 0px 40px;">
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">a. Fotocòpia del document nacional d’identitat o —en el cas de no tenir la nacionalitat espanyola— d’un document oficial que n’acrediti la identitat, l’edat i la nacionalitat. Els familiars que, d’acord amb la base 2.1. , tinguin dret a participar a en el procés selectiu han de presentar una fotocòpia compulsada d’algun document que acrediti el vincle de parentiu o, si n’és el cas, el fet de ser dependents d’aquests familiars.</span></span></p>
<p style="margin: 0px 0px 0px 40px;">
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">b. Fotocòpia compulsada del títol acadèmic exigit en aquesta convocatòria o certificat acadèmic que acrediti haver duit a terme tots els estudis per obtenir el títol. En el cas de les titulacions obtingudes a l’estranger, cal acreditar que estan homologades pel Ministeri d’Educació.</span></span></p>
<p style="margin: 0px 0px 0px 40px;">
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">c. Declaració jurada o promesa de la persona aspirant de no haver estat separada —mitjançant un expedient disciplinari— del servei de qualsevol servei de salut o administració pública en els sis anys anteriors a la convocatòria, i de no estar inhabilitada amb caràcter ferm per exercir funcions públiques ni per a la professió corresponent. </span></span></p>
<p style="margin: 0px 0px 0px 40px;">
<span style="font-family:times new roman,times,serif;font-size:12px;">d. Llista amb què han de triar —de major interès a menor— els llocs de treball oferts. Cal incloure-hi totes les places. Aquesta llista es pot emplenar per mitjà del tràmit telemàtic publicat en la web <http:// opoibsalut.caib.es >. També està disponible en format d’imprès en paper als Serveis Centrals del Servei de Salut i a les gerències d’atenció primària i d’atenció especialitzada i a la gerència d’atenció a urgències 061 i en la web www.ibsalut.es. En tot cas, cal presentar-la en algun registre segons el que disposa l’apartat següent.</span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">5. Cal presentar tota la documentació en el Registre General dels Serveis Centrals del Servei de Salut o bé a qualsevol dels llocs o segons les formes que estableix la Llei 39/2015, d’1 d’octubre, de procediment administratiu comú de les administracions públiques.</span></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">6. Si no es presenta la documentació en el termini establert —excepte en els casos de força major, que han de ser constatats degudament i, si escau, apreciats per l’Administració mitjançant una resolució motivada— o si en examinar la documentació es dedueix que la persona aspirant no compleix algun dels requisits, no pot ser nomenada com a personal estatutari, per la qual cosa s’han d’anul·lar les seves actuacions, sense perjudici de la responsabilitat en què hagi incorregut per falsedat en la sol·licitud inicial.</span></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">7. Abans d’efectuar els nomenaments, el Servei de Prevenció de Riscs Laborals del Servei de Salut ha d’emetre un certificat que acrediti que la persona aspirant té capacitat funcional per acomplir les tasques del lloc de treball. A l’efecte, les persones aspirants aprovades i les que figurin en la llista complementària seran citades per mitjà d’un anunci que es publicarà en el tauler d’anuncis de la seu del Tribunal i en la <www.ibsalut. es> amb una antelació mínima de tres dies a la data de la revisió. El resultat d’aquest informe serà remès pel Servei de Prevenció a l’òrgan convocant, de tal manera que no és necessari que les persones aspirants l’hi presentin.</span></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><span style="color: black;">8. Publicar aquesta resolució en el </span><em><span style="color: black;">Butlletí Oficial de les Illes Balears</span></em><span style="color: black;">.</span></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;"><strong>Interposició de recursos</strong></span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta resolució, que exhaureix la via administrativa, es pot interposar recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos, a comptar de l’endemà de la notificació de la resolució, d’acord amb el que estableixen els articles 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. També es pot interposar qualsevol altre recurs que es consideri procedent. </span></p>
<p>
<span style="font-family:times new roman,times,serif;font-size:12px;">No obstant això, les persones interessades poden optar per interposar contra aquesta resolució un recurs de reposició davant el mateix òrgan que l’ha dictada, en el termini d’un mes, a comptar de l’endemà de la notificació de la resolució. En aquest cas no es podrà interposar el recurs contenciós administratiu mentre no es dicti resolució expressa o presumpta del recurs de reposició, d’acord amb el que disposen els articles 123 i 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques</span></p>
