següent resolució:</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong><em>&lt;&lt; DECRET 082/2016</em></strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Atès que per acord de la Junta de Govern Local en sessió extraordinària de 12 d’agost de 2016 va aprovar les Bases de la convocatòria per a la creació d’una borsa extraordinària per cobrir les possibles necessitats urgents i per a la selecció d’un peó per el Punt de Recollida Selectiva de Residus, amb caràcter de personal laboral temporal de l’Ajuntament de Sant Joan.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Atès que per Decret de Batlia 071/2016, de 11 d’octubre,&nbsp; es va aprovar provisionalment la llista d’admesos i exclosos, data de la prova de català i la composició de la Comissió Tècnica de Valoració.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Atès que per Decret de Batlia 075/2016, de 21 d’octubre es va aprovar definitivament la llista d’aspirants admesos i exclosos de la convocatòria.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Considerant que la Comissió Tècnica de Valoració el dia 16 de novembre de 2016 es va reunir per examinar les al·legacions presentades, i establir l’ordre definitiu de la borsa extraordinària per cobrir les possibles necessitats urgents i per a la selecció d’un peó per el Punt de Recollida Selectiva de Residus.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>RESOLC:</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Primer.- Aprovar la Borsa de Treball proposada per la Comissió Tècnica de Valoració, en el ben entès que en el moment de fer ús d’aquesta borsa, l’aspirant proposat, d’acord amb la base onzena de la convocatòria aportarà en el termini màxim d’un dia hàbil ( o en el segon dia hàbil següent, si l’oferta es comunica en divendres) els documents acreditatius roman,times,serif;font-size:12px;"><em>Segon.- Aquesta borsa extraordinària tindrà una vigència màxima de 3 anys des de que es publiqui la present resolució al Butlletí Oficial de les Illes Balears.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Tercer.- Ordenar la publicació de la present resolució al Butlletí Oficial de les Illes Balears.</em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><em>Quart.- Donar compte de la present resolució al Ple de la Corporació a la primera sessió plenària que es celebri.<strong>&gt;&gt;</strong></em></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Contra aquesta resolució que esgota la via administrativa es poden interposar, alternativament, els recursos següents:</span></p> <p style="margin-left:36pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">a. El recurs de reposició potestatiu davant l’òrgan que ha dictat aquesta resolució (Batlia), en el termini d'un mes, comptador a partir del dia següent de la publicació de la present resolució en el Butlletí Oficial de les Illes Balears. Contra la desestimació per silenci del recurs de reposició, que es produirà pel transcurs d’un mes des de la seva presentació sense que s’hagi resolt expressament ni s’hagi notificat, podrà interposar-se el recurs contenciós administratiu, davant el Jutjat del Contenciós Administratiu de Palma, en el termini de sis mesos, comptadors a partir del dia següent a la desestimació presumpta. </span></p> <p style="margin-left:36pt;"> <span style="font-family:times new roman,times,serif;font-size:12px;">b. Directament el recurs contenciós-administratiu, davant el Jutjat del Contenciós-Administratiu de Palma, o, a la seva elecció, el que correspongui al seu domicili, en el termini de dos mesos, a comptar des de l'endemà de la publicació de la present resolució en el Butlletí Oficial de les Illes Balears, de conformitat amb l'article 46 de la Llei 29/1998, de 13 de juliol, de la Jurisdicció Contenciós-Administrativa.
