Base Dades Nacional de Subvencions: 311460</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports ha dictat, el 15 de novembre de 2016, la resolució que transcric literalment a continuació:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;"><strong>«Antecedents</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. El vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports va aprovar, mitjançant resolució de dia 5 de juliol de 2016, la convocatòria de subvencions 2016 per a la dotació dels equipaments de les biblioteques, dels arxius i dels museus de les entitats d’Administració local o dels organismes públics que en depenen, i les bases que la regeixen. Aquesta resolució es va publicar en el Butlletí Oficial de les Illes Balears núm. 87, de 9 de juliol de 2016.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. Les comissions tècniques d’avaluació respectives a cadascuna de les categories previstes en la convocatòria (equipaments de les biblioteques, equipaments dels arxius i equipaments dels museus), varen emetre, mitjançant actes de sessió de dia 6 de d’octubre de 2016, l’informe proposta relatiu a la concessió de la convocatòria de subvencions 2016 per a la dotació dels equipaments de les biblioteques, dels arxius i dels museus de les entitats d’Administració local o dels organismes públics que en depenen, previst a la base catorzena de la convocatòria, ateses les categories a subvencionar, segons les bases segona i cinquena, i en relació als tipus de beneficiaris que preveu la base tercera.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El 7 de d’octubre de 2016, l’òrgan instructor ha emès l’informe sobre el compliment dels requisits de les bases de la convocatòria esmentada per part de les entitats beneficiàries proposades i la Unitat Jurídica Administrativa de Cultura ha emès informe favorable sobre els aspectes jurídics de la concessió de les subvencions.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. Dia 15 de novembre de 2016, la Intervenció General ha emès informe favorable de fiscalització de la proposta de resolució de la convocatòria. Malgrat la deficiència indicada per la Intervenció General de no complir amb el principi d'anualitat pressupostària, el conseller d'Economia va autoritzar, de manera excepcional continuar amb la tramitació de l'expedient.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">5. L’existència de crèdit pressupostari adequat i suficient a la partida pressupostària 20.33210.76200 (RC amb el núm. de referència 22016/006001) del pressupost de despeses del Consell de Mallorca de l’exercici 2016, una vegada atès el que estableix la base cinquena de la convocatòria (dotació pressupostària total: (220.000,00 €; dels quals 130.000,00 € es destinen a equipaments de biblioteques, i 45.000,00 € equipaments d’arxius; i 45.000,00 € a equipaments de museus), així com el contingut de les actes les comissions tècniques d’avaluació de 6 &nbsp;d’octubre de 2016, per atendre la concessió de les subvencions proposades per a les categories que s’hi preveuen.</span></p> <div style="page-break-after: always;"> <span style="display: none;">&nbsp;</span></div> <p> <strong><span style="font-family:times new roman,times,serif;font-size:12px;">Fonaments de dret</span></strong></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1. La base catorzena de la convocatòria estableix que la comissió tècnica d’avaluació és l’encarregada d’estudiar i avaluar les sol·licituds així com de fixar l’import de les subvencions de les sol·licituds.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2. El segon paràgraf de la base vuitena recull que el procediment de selecció de les entitats beneficiàries es duu a terme mitjançant concurrència competitiva, i la fixació de l’ import de la subvenció es determina amb el prorrateig de les quantitats que integren la dotació de la convocatòria en funció de la puntuació obtinguda per les sol·licituds. Així, en primer lloc, s'agrupen les sol·licituds en funció de la infraestructura o centre (biblioteca, arxiu o museu) a què es destinen els equipaments, es comparen les sol·licituds en cada grup, i s'estableix una prelació mitjançant l’aplicació ponderada dels criteris d’avaluació previstos en la base tretzena d’aquesta convocatòria; d’altra banda i en segon lloc, les quantitats econòmiques previstes en la base cinquena (dotació pressupostària) es prorrategen entre la suma total de la puntuació obtinguda per les sol·licituds admeses corresponents per tal de fixar l'import de les subvencions, d’acord amb l’establert a la base dotzena, dins els límits recollits en la mateixa base, i fins a l’import de la quantitat econòmica corresponent. </span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">No obstant això, el tercer paràgraf de la base vuitena esmentada afegeix que no cal establir un ordre de prelació entre les sol·licituds que reuneixen els requisits de la convocatòria, mitjançant l’aplicació dels criteris de la base tretzena, quan el crèdit pressupostari sigui suficient per satisfer-les.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">3. El paràgraf cinquè de l’article 24.4 de la Llei 38/2003, de 17 de novembre, general de subvencions estableix que en l’expedient ha d’haver un informe de l’òrgan instructor en què consti que, en virtut de la informació de què es disposa, es desprèn que els beneficiaris proposats compleixen els requisits establerts a les bases de la convocatòria.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">4. El quart paràgraf de la base vuitena estableix que l’òrgan encarregat de resoldre la convocatòria és el vicepresident primer i conseller executiu de Cultura, Patrimoni i Esports.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">Atesos els antecedents i fonaments de dret exposats, i en l’exercici de les atribucions que tinc conferides, d’acord amb el Decret d’organització del Consell de Mallorca vigent i amb les bases d’execució del pressupost del Consell de Mallorca de l’any 2016, <strong>RESOLC:</strong></span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">I- Respecte a la categoria d’ equipaments de les biblioteques:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1- Concedir la quantitat total de 89.871,23 € a favor de les entitats amb les sol·licituds admeses que s’assenyalen en l’annex 1 – (B) i disposar-ne la despesa a favor seu, pels imports de subvenció que s’hi indiquen, amb càrrec a la partida pressupostària 20.33210.76200, RC amb el núm. de referència 22016/006001, d’acord amb l’establert en les bases de la convocatòria de subvencions any 2016 per a la dotació dels equipaments de les biblioteques, dels arxius i dels museus de les entitats d’Administració local o dels organismes públics que en depenen (publicada en el BOIB núm. 87, de 9 de juliol de 2016).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2-Excloure o tenir per desistides les sol·licituds recollides en l’annex 1 A – (B), pels motius que s' hi indiquen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">II- Respecte a la categoria d’ equipaments d’arxius:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1- Concedir la quantitat total de 5.278,99 € a favor de les entitats amb les sol·licituds admeses que s’assenyalen en l’annex 1 – (A) i disposar-ne la despesa a favor seu, pels imports de subvenció que s’hi indiquen, amb càrrec a la partida pressupostària 20.33210.76200, RC amb el núm. de referència 22016/006001, d’acord amb l’establert en les bases de la convocatòria de subvencions any 2016 per a la dotació dels equipaments de les biblioteques, dels arxius i dels museus de les entitats d’Administració local o dels organismes públics que en depenen (publicada en el BOIB núm. 87, de 9 de juliol de 2016).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">2-Excloure o tenir per desistides les sol·licituds recollides en l’annex 1 A – (A) que s’adjunta i que forma part integrant del contingut d’aquesta acta, pels motius que s' hi indiquen.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">III- Respecte a la categoria d’ equipaments de museus:</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">1- Concedir la quantitat total de 15.662,94 € a favor de les entitats amb les sol·licituds admeses que s’assenyalen en l’annex 1 – (M) i disposar-ne la despesa a favor seu, pels imports de subvenció que s’hi indiquen, amb càrrec a la partida pressupostària 20.33210.76200, RC amb el núm. de referència 22016/006001, d’acord amb l’establert en les bases de la convocatòria de subvencions any 2016 per a la dotació dels equipaments de les biblioteques, dels arxius i dels museus de les entitats d’Administració local o dels organismes públics que en depenen (publicada en el BOIB núm. 87, de 9 de juliol de 2016).</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">IV- Revertir a la partida pressupostària 20.33210.76200 i, per tant, anul·lar l’autorització de despesa (A) amb núm. operació 220160014878, la quantitat de &nbsp;109.186,84 €, com a romament total (sumatori resultant dels romaments de&nbsp; 40.128,77 €, 39.721,01 i 29.337,06 € corresponents a les categories d´equipaments de biblioteques, arxius i museus, respectivament –derivats de la diferència entre la quantitat de la dotació pressupostària destinada a cada categoria i la suma agregada dels imports de subvenció de les sol·licituds admeses per categoria-), i anul·lar la retenció de crèdit (RC) amb núm. operació 220160009136 per la primera quantitat abans assenyalada.</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">V. Comunicar aquesta resolució a la Intervenció General del Consell Insular de Mallorca</span></p> <p> <span style="font-family:times new roman,times,serif;font-size:12px;">VI.
